July 19, Attention Bertha Bejarano, This letter is in response to a complaint you received, ED # from [redacted] On April 15th, 2017, we were contacted by business owner [redacted] from A.P.S Muscle Cars, located at [redacted] ** ***Phone number ###-###-####He contacted us about a customer's car he was building, " [redacted] 's El Camino that needed some exhaust work to finish the car." The initial conversation took place over the phone between us at Roger's Exhaust; [redacted] from APS Muscle Cars; and [redacted] regarding the work to be clone on the El CaminoHe wanted to install an exhaust system using Borla MufflersAn estimated cost of $was verbally agreed upon with no mention of any specific Borla Muffler system to use [redacted] from APS had the vehicle transported to us at Roger's Exhaust requesting the job to be completed on April 18th, We took care of said vehicle using Borla Mufflers part number This is a commonly used and accepted mufflerThe work was completed by the requested date of April 18th [redacted] from APS picked the vehicle up and was very satisfied with the workHe paid us in full the same day he picked it upSeveral weeks later, we heard from the owner [redacted] He was happy with the quality of the job we had doneHe told us he had been talking with the company Borla and had decided he wanted one of their specialty mufflers, part number We checked with Borla for [redacted] and they explained that it would be about months to have them builtThere was a considerable cost difference between the two part numbersThe original muffler is $(our cost) a piece, for a total cost of $for a pair, required for the jobThe specialty muffler were at a cost of $apiece, $for the pair [redacted] was aware there was a cost differenceWe at Roger's Exhaust placed the order for the custom specialty mufflers for [redacted] , per his requestTwo months later we received the mufflers from BorlaOn contacting [redacted] , we informed him there would be no labor charge only the cost difference in the partsThis was $each for a total of $for the pair [redacted] came by the shop without the vehicle feeling that we should just give him the new Soda mufflersWe explained that without swapping out the original Borla mufflers, he would be responsible for the full cost of the new custom specialty mufflersHe felt that was unacceptableWe then contacted [redacted] at APS regarding the dispute in the price differenceHe explained that there had been an additional fee of $he had charged to have the vehicle transported from Paramount, CA to Fontana, CA and back to the shop when the job was initially completedin our conversation, [redacted] explained that [redacted] had not actually paid [redacted] for the exhaust work that had been completed in April APS had paid Roger's Exhaust, due to our agreement with ***APS was our customer, for the original exhaust installation, not [redacted] Our response to this complaint is that we will gladly switch out the original Borla muffler part number for the specialty muffler number Since this was a custom specialty muffler, Borla does not accept them backwe advised [redacted] that the additional cost would be $and we would remove the original Bode muffler, or we could sell him the custom specialty Borla mufflers with no swap for the original parts at a cost of $a piece, a total of $for the pairWe believe this was a fair compromise since there had been no specific mention of which part number that [redacted] wanted during the original conversation on April 15th, only that he wanted the Borla mufflersIt was our misunderstanding when we ordered the custom specialty mufflers that [redacted] would be willing to pay the difference, since he knew there was a cost differenceHe had told us that he had looked them up on the Internet after the original work was completedWe have agreed not to charge a labor charge for the swap of mufflers [redacted] 's complaint stated that we "have to eat whatever inconvenience or expense for a job done" is unreasonableWe do not feel we are at fault for him doing additional research after the initial work was completedOur original job agreement was with [redacted] at A.P.SMuscle Cars [redacted] was ***'s customerWe have found out from [redacted] that [redacted] has not paid him for the initial work installing the Borla mufflersOur offer to [redacted] to not charge for labor and to swap out the original mufflers for the custom specialty mufflers still standsWe feel this is more than fairHopefully, this helps to explain the entire situation regarding the work done for [redacted] E [redacted] on his El Camino_ If you have any questions, please contact us at the shop phone number ###-###-#### or by email: [redacted] Sincerely, Roger's Exhaust Shop

I am rejecting this response because:
August 3, 2017 Atten: Bertha Bejarano Re: complaint # 12256689 From: [redacted] E_ [redacted] i am not sure who wrote the response letter from Rogers's Exhaust shop but it does not sound like Sparky, my original contact person. I spoke with Sparky several times regarding the muffler exchange. Sparky exhibited a more sincere and trusting telephone persona. This response has the edge and overtones of the person who claim to be the owner a,k,a. Roger. I was directed to the office / waiting room by parity, we have never spoken again to this day. Roger the person # spoke with instead of speaking with Sparky, seized the moment and projected a demeanor that put me in a defensive posture, He had everything to say during my visit. I never spoke with Roger prior to that day regarding the repair of this malfunctioned transaction. The subject of upgrading my muffler has obviously lost important facts in translation. Nevertheless, my main objective has not been altered; I simply want the Pro XS muffler replaced with the S type muffler I Order at no further cost or expense_ Fabricated truth and insinuations will not alter the fact. Rogers Exhaust shop charged for something they did not install, mistakenly or intentionally they are responsible. They have to absorb the loss and inconven?ence regardless. An equitable resolution can only be attained after they admit their mistake and apologize for my Inconvenience. Now that l am realizing their propensity to distort the truth, that seems unlikely_ I arn sure Rogers Exhaust shop is not in business to lose money, no business is, but ripping customers off is a foul business practices This response letter has been embellished and spun to make me look like an eccentric void of logic and a person who doesn't pay his bills. The fact is; Rogers Exhaust shop received full payment as evidence by their receipt and by their own written admission. Their attempt to escape responsibility for a mistake highlights a serious character flaw. A legitimate attempt to resolve this matter has not been projected in an serious and acceptable manner. A Is what it is" statement and the threat to return the product if I did not bring forth more cash does not work for me. This car is a personal project for me nothing more_ I'm not in this to turn a profit or to be taken advantage of_ There are peculiarities about this transaction that are noteworthy! Why would APS muscle car inc. drive SO miles one-way to install a muffler in a Chevrolet? Who would accept a $900 estimate without at least an explanation of what to expect for their money? Le. what does a $900 Borla muffler system consists of? They made no mention of that conversation in their response fetter! Why would Rogers's muffler shop order a specialty muffler, which is nonreturnable ( With no credit card number or down payment of at least 50%, this is a common practice with special orders. Who authorized the order? I sure did not; it was a replacement muffler to correct an in-house mistake not an upgrade on my part and they knew it. Someone at Rogers's muffler took responsibility for ordering the muffler! After being notified that, the muffler has finally arrived at Rogers Exhaust shop. I drove 51 miles from my door to Rogers's muffler shop to assess the location, speak with Sparky in person, and to put in writing the installation of the replacement muffler. The car still had to be returned to their shop via an appointment. (By the way, I am an AAA member with RV and motorcycle towing privileges) I would never pay 5200 to have my car towed before using AAA. Something else they neglected to document on the receipt, if anything, the transportation fees should have been on a separate bill from APS. The only logic I can conceive of; APS must have been compensated by Rogers's Exhaust shop_ It was not my idea to use their services and I had no prior dealings with the people at Rogers's Exhaust shop. simply trusted APS Inc., which I have had prior dealings with to use a credible and trustworthy outfit to do the work that we agreed on. I fully understand that estimates are just that, estimates and going over an estimate for one reason or another is common. However, trickery and foul play is something I cannot tolerate. According to Rogers Exhaust shop, l concocted a truly insane soundings scheme the bizarre nature of his implications makes me wonder what they are capable of. Obviously, they have no conscience and embarrassing them into rectifying the situation is not going to work, unfortunately! I need to document my side of the story, as would any honest customer. I probably will avoid future contact and will actively alert potential customers via social media. I am very willing to exercise any Revdex.com recommendations regarding my situation and its solution. The bottom line to all this is not a complaint about the quality of their work but the resolution of a mistake and the manner In which they solved it. I hope that APS muscle car Inc. and Rogers Exhaust shop are not in concert with negative behavior! An estimated cost of $900.00 was verbally agreed upon with no mention of any specific Borla Muffler system to use. [redacted] from APS had the vehicle transported to us at Roger's Exhaust requesting the job to be completed on April 18th, 2017. We took care of said vehicle using Borla Mufflers part number 40352. This is a commonly used and accepted muffler. The work was completed by the requested date of April 18th. [redacted] from APS picked the vehicle up and was very satisfied with the work. He paid us in full the same day he picked it up. Several weeks later, we heard from the owner [redacted]. He was happy with the quality of the job we had done. He told us he had been talking with the company Borla and had decided he wanted one of their specialty mufflers, part number 400773. We checked with Borla for [redacted] and they explained that it would be about 2 months to have them built. There was a considerable cost difference between the two part numbers. The original muffler 40352 is $100.00 (our cost) a piece, for a total cost of $200.00 for a pair, required for the job. The specialty muffler 400773 were at a cost of $270.00 apiece, $540.00 for the pair. [redacted] was aware there was a cost difference. We at Roger's Exhaust placed the order for the custom specialty mufflers for [redacted], per his request. Two months later we received the mufflers from Borla. On contacting [redacted], we informed him there would be no labor charge only the cost difference in the parts. This was $170.00 each for a total of $340.00 for the pair. [redacted] came by the shop without the vehicle feeling that we should just give him the new Soda mufflers. We explained that without swapping out the original Borla mufflers, he would be responsible for the full cost of the new custom specialty mufflers. He felt that was unacceptable. We then contacted [redacted] at APS regarding the dispute in the price difference.
