I am rejecting this response because:This is a lie. I have already discussed this with RPM and his attorney. Not once have they admitted the fact I cancelled the consignment on the phone in February BEFORE THE SALE, nor have they even mentioned they had my address, my alternate phone number, my alternate address to contact me on. Their information is incorrect.

I am rejecting this response because: I will repeat myself again..Because Bailey failed to properly water test the boat ,water leaks were not discovered and therefore I was sold a almost brand new boat with 4 hours on it that leaked through the transducer plate from the first launch of this boat in October. I have verification that the plate was not installed properly from the marina that is doing the warranty work..they will find the other problem with the hull after water testing properly!! I did not take the boat back to Bailey as he failed to issue me the transfer warranties for the boat and motor at time of sale of which I had no such knowledge of..He failed to install a transducer plate properly that caused one of the leaks of which I discovered in the first 5 minutes after launching in October,2016. Bailey could care less about customer care  manners and has lied to me on many fronts on this issue. I have documented emails and texts from him saying boat was water tested and there are no leaks..I have witnesses that can prove otherwise. They owe me compensation for time off work and 2 trips to california to have warranty work performed . I find that Bailey is not competent of repairing this boat due to his past performance. I am the Victim here and it has cost me a lot of money in trip charges and time off work and it will cost me 4 months at the least of missing prime fishing here in Arizona. Boat is in California  Bailey will never see me or the boat again unless I find Kit R[redacted] the original owner and get a different story...This other leak could be a manufacturers defect but had the boat been tested properly these leaks would have been found by Bailey before the boat was sold..I am anxious to find out the issue with the other leak and how fast they found the problem..Bailey owes me for all the grief he has put me through..[redacted]

This customer did  put his 2006 Alumacraft 145 Fisherman boat, 2006 W.C. mfg boat trailer, and 2006 Yamaha 25hp engine on consignment with Roger's Performance Marine on November 22, 2014. We sold the boat in February 2015. Customer provided us a phone number to contact him and address on...

consignment sheet. Rogers Performance Marine called numerous times to the number provided the voice mail on the phone said it was his phone we left messages. We sent letters and certified letters out and were returned to Rogers Performance Marine. When he did he did contact Rogers Performance Marine he never once told us his number had changed or his address had changed according to what he had written down on our consignment sheet. We attempted to contact customer in March about the sale and needed titles . We never spoke to him in February he never returned our calls from voicemails left. And nothing was mentioned about taking it off of consignment. He sent our store an email regarding the status of his boat. Now that we had a way of communicating with him we notified him that his boat had sold in February. Customer was very upset and would not speak to us via phone. We stated that we had sent him certified mails and left voicemails  (which we have record of) notifying him we needed titles. He then stated his phone was no longer working and no letters were sent. Customer did send us titles but however they were not signed. We contacted him via phone and email and he kept stating he wanted the boat back as it had been sold to a customer we could not do what he requested. He never requested the boat to be taken off consignment and Utah law on consignments states there has to be a written notice from the customer and the collateral has to be picked up from consignor. The customer then contacted the Utah State Motor Vehicle Enforcement Division. They did come and question Rogers Performance Marine saw our records of, phone calls, letters, and emails. They said that there was no charges to be pressed against Rogers Performance Marine that the customer did not provide correct contact information. The MVED officer also stated that the customer was within the lines of doing communications fraud and could be charged. After this Rogers Performance Marine hired an attorney and communicated with the customer through email. Eventually the customer did send a power of attorney to Roger's Performance Marine. We feel like we did exactly what we could do provided the information provided from the customer.
