We were consigned a freezer in our restaurant consignment auction and sold it at auction on 6/5/18.? The auction clearly states all items are being sold as is where is with no guarantees or warranties either expressed or implied.? However, upon hearing from Mr*** of the non working
condition we agreed to a refund.? The notice from the Revdex.com of Mr*** complaint was received after this and before the check had actually been mailed.? He has since been mailed a check for the refund of his purchase price? Unfortunately we can’t, nor can any auction company be 100% sure of the working condition of all consigned items although we certainly make that attempt.? We sell items as ‘Where-Is’ but when buyers get items in a nonworking condition we try to work with them and not take consignments from those individuals in future auction.? Many auction houses are strict behind these terms and do not allow any refunds regardless due to selling as is where is.?
