Complaint: [redacted] I am rejecting this response because: MrA [redacted] made multiple statements in his response He did not speak to my husband on multiple occasions regarding this issue Mr A [redacted] avoided his phone calls There was house wrap under the siding, but it had been removed prior to taking the picture Part of our loss was paid by our insurance, but the insurance did not cover the total loss, therefore there is no insurance fraud I have already contacted an attorney and spoken with my insurance agent regarding what I can and cannot recover from Rolling River Construction Unlike MrA [redacted] we are law abiding and try to always do the right thing.I want to thank the Revdex.com for trying to resolve this issue, but I will take if from here Sincerely, [redacted] ***

Hello Revdex.comI am writing this in response to a complaint filed by
[redacted]. [redacted] filed a claim with Allstate for an ice dam. Allstate
covered the loss. Then [redacted] sent me a letter demanding $1,000.00 or she
was going to sue me for her out of pocket money. I am not responsible for...

the
ice damming nor am I going to pay a $1,000.00 for an ice dam that is out of my
control. I talked to [redacted] on more than one occasion about this
situation. [redacted] said there were no leaks when it rained after the ice dam was
gone and there were no leaks before the ice damming, so this is clearly an ice
dam problem. The photo that was sent to me shows the water line is above the
step flashing. There is clearly water staining from an ice dam. I told [redacted]
there were thousands of homes leaking in the valley due to ice damming and this
is something that is covered by home owners insurance. [redacted] said Allstate the
insurance company was covering the damage from the ice dam. With the insurance
company covering the ice damming it is clear to me the deductible must be
$1,000.00 (The out of pocket money). In the photo sent to me by [redacted] shows
we used step flashing as well as modified bitumen in the cricket area. This is
above and beyond code. The problem is we had an extreme winter and this home is
not built for these conditions. In the attached is a photo that shows there is
no house wrap on the walls as well. House wrap is code and there is none on the
walls which is part of the problem. I’m sorry they had problems like thousands
of other people in the valley but this is no fault of mine. This is ice
damming. This is why Allstate covered the loss. Do what you will but I am not
paying the $1,000.00 deductible for an ice dam I can’t control. This is illegal
(insurance fraud) for me to pay the deductible. Allstate or any other insurance
company does not cover poor workmanship but they do cover ice damming. This is
why it was a covered loss. If you call any insurance agent in Boise Idaho and
ask if they had Ice damming issues this past winter you will find it was a huge
problem. The news reported ice damming on roofs as well as roof collapsing all
over the valley. The news reported we had the worse winter in 57 years. This
winter was extreme like what you would have in the mountains and they have
extreme winter conditions and codes to match. If this does go to litigation
there will be a counter suit for attorney fees and I will pursue insurance
fraud charges once I win the law suit.David A[redacted]
