December 28, 2017Dear *** ***,This letter is to refute the
above-referenced complaint that our previous customer *** *** has
filed. Rolls Auto Sales is a small
business auto dealership that has been in existence for over yearsWe
exclusively offer used automobiles, all of which
are on an “As Is” basis with 3rd party warranties available for purchase.
We do not employ a mechanic on premises, therefore we make every effort
to educate our customers as to the buying process. On March 10, *** ***
purchased the *** *** from us (for $28,and not the $31,she is
stating) along with an extended warranty from ***. At the time of purchase this vehicle had
54,miles. The customer purchased the
vehicle year and months ago and until now we have not heard from her
regarding any mechanical issues. Also,
since she stated the mechanical issues started year ago which was months
after purchasing the vehicle we disagree that there is any fault or
responsibility on our part and respectfully decline her request for a refund or
to buy the vehicle back. Our advice is that since the
customer purchased a warranty which covered the period of months or 26,
miles (whichever came first) she should call the warranty company to see if it
is a covered repair and ask for a new mechanic referral. As *** *** did not provide repair bills or
mention the current mileage we do not know if her warranty is still in force
but is she has not driven it more than 26,miles in the months since her
purchase she should still have a remaining warranty. While we are sympathetic to her circumstance
her complaint seems directed at the inability of the mechanic who she has paid
to resolve the issues and not necessarily Rolls Auto Sales and we ask that you
please dismiss the complaint.Thank you for your time and
should you have any questions, please call me at ###-###-####.Sincerely,Michael M

Dear *** ***,*** *** was aware at the time of purchase that she was putting down $plus tax and tags. I have attached her Bill of Sale so that you can see the total down payment was $3171. This was paid by $from her debit card and a check (written out in her handwriting)
for the amount of $(see attached). In addition, ** *** also signed a receipt at the time of purchase for the amount of $(see attached). Please feel free to contact me should you have any further questions regarding this matter.Sincerely,Heather P***

Dear *** ***,We received the above-referenced complaint from you office on June 23, and are responding as requested. Please note that our office moved and is not at *** *** *** *** ** *** and all future correspondence should be sent there and to the email of
*** and please remove *** *** as the contact as she is no longer with our dealership. Thank you in advance for updating your records. In response to the complaint from *** *** regarding the Nissan Murano she purchased on 2/17/2017, I would like to advise you of the fact that she knowingly purchased the vehicle with 173,miles on it in "As-IS" condition. These facts were noted on the enclosed documentation and during *** ***'s "Customer Interview" with her finance company. At the time of purchase there were no problems and the vehicle was available for her to have her mechanic look it over. Additionally, Rolls Auto Sales did purchase *** *** a GWC Month/4,Mile warranty at our expense as a courtesy as we have done with other customers in the event of unforeseeable mechanical issuesIf *** *** was experiencing issues immediately after her purchase she would have been able to contact the warranty company to have the repairs done at the cost to her of only the $deductible since the warranty would not have expired until 5/17/or 177,miles. As ** *** has not referenced dates she saw a mechanic or enclosed any repair quotes I can only assume the issues began after the warranty expired and not right after her purchase. I am sorry she is having issues with the vehicle but we are not going to be able to just "put her in another car" as she requested.Should you have any questions, please contact me at *** *** ***.Sincerely,Michael M***

Dear *** ***,We have never threatened to ruin your credit as we have nothing to do with reporting to the credit bureau and we have asked you repeatedly to please bring your vehicle in so that we can address your complaints. We cannot help you if you do not give us the chance. Please call me to make arrangements to bring your vehicle in so that we can address the issues that you have with it. If you do not trust us you have a third party warranty that you can use at the mechanic shop of your choice. If the shop that you take your vehicle to finds something wrong with the vehicle that is not covered under your warranty we will see that the repair is taken care of.Sincerely, Heather P***Rolls Auto Sales

 Complaint: [redacted]
I am rejecting this response because: It was said to both my grandmother and myself that if we did not pay for the car that they would destroy our credit. This car sounds like any minute it is going to break down and I do not feel safe in the car. It sits in my parking lot more than it has been driven. We do not want the car and do not want to deal with the drama that the dealership has brought onto us. Including the lies and sneaky ways they handle things. They sold a car that was in an accident without notifying us, they allowed to car to have drugs in it, as well as not be fully inspected. I have heard nothing but horrible things about this place from multiple sources. They need to refund the bank their money and take their car back.

Ms [redacted], I spoke with PennDot and they reported that the issue that they are having with you is not because you bounced your check for taxes and tags, their issue is that you put a stop-payment on your check.  I'm sure that you are aware that to put a stop payment on a check you have to...

know the check number, who the check was written to and the amount.  Even if you were unable to provide the bank with one of these three things, it shows at the very least that you were aware of the check and knew that it was going to be processed by the state. Your paperwork has not been lost and I would be more than happy to provide you with copies for your records. Sincerely,Heather P[redacted]

Review: Bought a care on September 12,2013 and as soon as we got the car we had to give it back to them for repairs on it ,its been about three times and they are very disrespectful and we been patient with them with this whole process they gave us a loaner car that was very used and dirty and smell like smoke neither me or my wife smoke and we have 6 kids and 1 is handicap he can't even walk and for them to take us threw that and I have to pay the payment s to the bank and never really got to drive the car and we gave them cash upfront for the deposit can some one please help us and the owner of the company say they should charge us more for the car the car wasn't fix .Desired Settlement: Fix all the proble** and give us a better warranty on the truck and to pay the 1st and 2nd months payment cause we still don't have the truck and its the 10th of October and we couldn't enjoy our truck.

Response:

Dear **. [redacted],

I am writing this letter in response to the complaint sent to you by **. [redacted]. When **. [redacted] brought the vehicle back approximately 10 days after it was purchased because the check engine light was on, we sent it directly to one of the shops that we use to have it looked at. It was then found to need a lifter assembly. So we paid $736.97 to have the lifter assembly replaced. On Saturday, September 28th, **. [redacted] called to tell us that the vehicle stopped running with his family in it. So we sent a tow truck to his location with a loaner vehicle on it for him to drive so that he and his family would not be stranded without a ride. It was then found that the engine needed to be replaced. When this was found out, we called **. [redacted] to let him know that we were going to replace the engine for him and that we would pay his first payment for him because he had been so inconvenienced. We told him that we would call him when the vehicle was ready to be picked up. **. [redacted] showed up at the dealership with his family on Tuesday, October 8th without us calling him to tell him the vehicle was ready. When we told him that the vehicle would not be ready for another couple days, he started to complain about the loaner vehicle and demanding that we give him his vehicle back. We offered him another loaner vehicle that would better suit his large family but he declined that vehicle. We also offered to unwind the deal altogether and give him back his trade-in vehicle (that we had already paid off) but he also declined that offer. After making his entire family stand on the sidewalk for about 30 minutes and not saying anything to us, he put the family back in the loaner and drove off. **. [redacted] picked up his vehicle on Friday, October 11th and has had no proble** with the vehicle since he picked it up. Unfortunately even though all of our vehicles are state inspected every once in a while unforeseen mechanical problems arise with the vehicles. When this happens, we do our best to rectify the situation for the customer. We were never rude or disrespectful to **. [redacted] and we feel that we really did our best to extend every courtesy to him.

Please feel free to contact me should you have any further questions regarding this matter.

Sincerely,

Consumer

Review: I purchased a vehicle from Rolls Auto Sales in May of 2014. The vehicle was a 2009 [redacted]. I was told that the vehicle "needed nothing" and that it had never been in an accident. Within a week of purchasing the vehicle, I noticed a gap in the front bumper of the vehicle. I also noticed that the windshield on the vehicle had been replaced. Both of these things indicate that the vehicle has been in an accident. Since I was concerned about it, I took the vehicle to a body shop. After looking it over, they concluded that the bumper was not even made by [redacted] itself and that it was an aftermarket part that did not even fit correctly. I also noticed that they sold me the vehicle with a missing lug nut on the rear passenger tire. I then noticed even another problem when I washed the vehicle. I began to spray the vehicle with a hose and noticed that paint chips started to appear all over the hood and around the rest of the car. I believe that the paint chips were there when I was sold the car, but were covered up with colored wax so that I would not notice it until it was already sold to me. Finally, I had the car checked out mechanically. I was shown the engine bay and the battery was corroded and in completely horrible condition. I also had the oil changed on the vehicle and was told that the oil filter was so dirty that it looked like it hadn't been changed in an extremely long time. I took the vehicle back to the lot to express my concern about these problems and was only told that I would be given a lug nut. I was told that since I purchased a used vehicle, that the other problems were part of buying it. I ran into another problem when I attempted to cancel the extended warranty I purchased with the vehicle. I went to the lot and was lied to and told that I had to cancel through the bank, when it contractually stated that I was to cancel through the dealer. They continuously gave me lies and deceit. It was not until I threated to file suit that they finally let me cancel the warranty.Desired Settlement: I would like to either have all of the problems with the vehicle properly taken care of, or be refunded my money and taken out of the auto loan for the vehicle.

Response:

July 10, 2014 Dear [redacted],Attached is a copy of both the [redacted] and [redacted] showing that the vehicle that [redacted] parchased was not in an accident. I have also included a copy of the receipt from the third party inspection station that the dealership used to state inspect the vehicle. Finally, I have enclosed a copy of the letter that was sent to the finance company with the reimbursement check for the warranty. In regard to the warranty cancellation, [redacted] called;and asked that the warranty be cancelled on the 17th of June. We told him that we had to look into what the procedures for this were and had the refund check sent out to the finance company on the 18th.Sincerely, Michael M.

Review: I started to purchase a vehicle on 03-30-13 I took possesion of the car 03-30-13 so I drove the car and realized it had some defects called on this matter 04-01-13 they told me to bring the car in I brought the car in 04-03-13 they told me they weren t going to fix the problems I was having so after sitting there for about 10 min they agreed to put new tires on the vehicle and brakes and sent me to there service center when I got there the guy didnt want to put new tires on or brake pads so I took the truck back to them and stated I no longer wanted the vehicle because of there dishonesty at no time when I took the car back they said I would forfiet my down payment which is 1800.00 dollars and when I was looking at the contract they trying to be dishonest with the bank I was attempting to get the financing through they told the bank I put down 3162.00 when I only put down 1800.00 so they refuse to give me my down payment back even though I gave the truck backDesired Settlement: I would like to recieve my 1800.00 back

Response:

Replied to an advertisement two months ago, they advertised as one thing, but it was another. They changed the markings / emblems on the car to make it a higher model. After I discovered the issue (when I took the car to my local dealer), I called them to advise them of the problem. They basically said to much time had passed and "YOU OWN THE CAR - SORRY!" Really upset, I probably overpaid by $5,000 and will never recover. Buyer beware! Once they get your money, you have no recourse but to pursue it legally - which costs $$$$$.
