2001, that a customer has interpreted our standard Contract for Preliminary Design (copy enclosed) as excusing them from paying our bill if we do not cease work without first requiring that they replenish their retainer. The claimant initially asked us to create a preliminary design of a custom, two story home. Later, the claimant asked us to change the design, create a three dimensional topography, and perform light studies on the proposed preliminary design. Per our usual practice, we sought to educate the claimant on the costs associated with designing a custom home prior to commencing work, and specifically told her that the initial costs of the preliminary design, exclusive of the other services we provided (e.g. changes to the preliminary design, the topography model, and the light study) could be up to $4,000. Additionally, we directed the claimant our website, which discusses the fees we charge for custom design work – http://rocioromero.com/pdf/CustomDesignPrecedents.pdf. In sum, the complaint makes no mention of the quality of our work or the reasonableness of our fees. Rather, the complaint is that we did not stop work on the claimant’s project and request that she pre-pay for our services prior to our completing the work. We did our best to educate the claimant of what our services would cost, and provided her with a quality product at a reasonable price. Respectfully, we believe the claimant should pay for the products she requested and received.
