Review: On March **, 2013, I [redacted] purchased the property located at [redacted] from Ron Jon Holdings Enterprises Inc. (seller: [redacted]).Ron Jon Holdings Enterprises Inc. (seller:[redacted]) signed a property disclosure letter and give verbal confirmation that they were no leaks and or defects to the property located at [redacted].Ron Jon Holdings allegedly misrepresented the condition of the property located at [redacted]. Ron Jon Holdings knowingly failed to disclose property defects.Per [redacted]; property was on the market for a year with no problems. According to [redacted] even during Hurricane Sandy they remain no flooding, no leaks and no interior or exterior damages.Inspection report mentioned nothing of below defects. Date of occupancy was 03/**/2013.Con Edison was called because a gas leak was present on 04/**/2013.Over the course of two months the below defects were discovered and [redacted] was contacted on numerous occasions and asked to keep his word. [redacted] stated should I have any problems to please contact him and he would take care of it. As of today the problems that persist at [redacted] are:Boiler room wasn't fireproof, gas line joints leaking , electrical wires from boiler wasn't covered, broken train line in bathroom floor...basement flooding due to missing gutters and hairline cracks along house foundation and also main drain line ..no insulation in basement walls... 2. Major water leaks in second floor bedroom and over head window frame due to roof leaks! This leaking proves to be very chronic which caused ceiling to collapse. 3. Structural damage to siding due to bulge on the side of the house ...not sure what's causing it 4. Preexisting foundation problems and violation of city codes on premises. 5. Water meter on premises was never installed which is a violation of city codeDesired Settlement: Would like for [redacted] to keep his word and make the necessary repairs to bring house up to code, install water meter, fix leakage and ceiling damage and replace drain pipe.

Please be advised we represent the ASH Holdings Enterprises Inc. regarding the above captioned complaint. We ask that you direct any future contact to this office. The within dispute arrises out of [redacted]'s purchase of some real property previously owned by ASH Holdings Enterprises Inc.

ASH Holdings Enterprises Inc. is not a business falling under your guidelines and simply sold a piece of real property improved by a single family home. ASH Holdings Enterprises Inc. is not a builder and the home was not new construction. The parties entered into a standard "as is" contract of sale with a merger clause and any defects [redacted] were alleging were unknown at the time of closing or were compensated at closing. An attorney represented [redacted] on the sale and the purchase price was reflected in the condition of the home.

Prior to entering into the contract [redacted] conducted a home inspection whereas certain repairs were agreed upon. The repairs were completed. Prior to closing [redacted] raised additional issues regarding the homes condition and a credit for repairs was agreed upon and issued at dosing. [redacted] did a final walk through prior to dosing and failed to raise objection.

At closing, [redacted] was granted a repairs credit and an additional $500.00 credit was granted in lieu of a property condition disclosure and no such disclosure letter was issues as your claimant alleges.

Notwithstanding the fact ASH Holdings Enterprises Inc. has no knowledge of any defects, the parties entered into an "as is" contract of sale with a merger clause whereas purchaser waives any post closing claims once the deed has been transferred. The parties closed and the deed was recorded. [redacted]'s time to make objections has expired. [redacted] conducted an independent home inspection, was represented by counsel, did a final walkthrough all without incident. It comes at a surprise that .[redacted] now expects ASH Holdings Enterprises Inc. to cover post-closing damage for an older home.

ASH Holdings Enterprises Inc. made no warranties and Purchaser is entitled to no warranties and frankly, the property's price reflected the condition. Should you have any questions or comments please feel free to contact me. I remain
