sold me a scratched item as new. sold me a scratched item as new. and when I wanted to return it they told me that I had scratched it in spite of the fact that I sent them an email that very same day that I had received it. They agreed to take it back for a hefty restocking fee and once I spent [redacted] to mail it back they said they couldn't sell it as new due to the scratches. I mailed it back in the same packaging as it was received.Desired SettlementI would like my money refunded [redacted]Business Response The customer Purchased a New Honda Windshield from us via [redacted] The item had very light scratches from the packing plastic which was noted in the listing. Most people would not have noticed, but it is our goal to disclose anything we sell with all details. The customer installed the windshield on his motorcycle and then decided he was not happy with the item. We agreed to take the windshield back as the customer was not happy. Our terms were that the windshield must be returned in the same condition as received. The customer shipped the item back to us and complained of the excessive return shipping cost. Once the item was received as per our returns Dept, heavy scratches were noticed on the windshield. These were not scratches from moving around in the box. This item looked like it had been on a bike for several years. The customer filed several charge backs and complaints with [redacted] Backup documentation was provided to [redacted] and the case was decided in our favor. Our goal at Ronnies Mail order is 100% customer satisfaction. In this case we could not work with Mr. [redacted] as the item was installed and heavily used.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I did purchase the windshield from them. When I received the windshield it did have scratches on it.Scratches that were obvious not scratches I would have expected to be on a factory new item. The packaging, when received, was obviously opened and not as if directly from the factory. The very same day I received the windshield I emailed them with my concerns, stating "there are scratches on this windshield, how can you sell this as new?"I did try the windshield on my bike for a day or so, had a number of conversations with the seller who agreed to take it back for a hefty restocking fee and I had to ship it back at my expense. I agreed. I sent the iem back in the very same packaging that I received it in. They claimed in emails and phone conversations that the scratches occurred in the packaging on the way back to them. They knew I only had it a couple of days. I have emails that contradict their statements. How can they claim that it has very warn scratching if I only had the item a couple of days? I feel they originally sold a used item as new and chose not to be stuck with it any longer when I wanted to return it. I feel they are dishonest people. Final Business Response We have resolved this issue with the customers credit card company; Based on emails and other documentation the credit card company was in favor of us. The windshield was NOT sold as new and the very light scratches were noted to the customer. The item was not received back in the condition it was sent to the customer in. We will not come to a "middle" solution here as we have taken the necessary steps to notate the condition of the item and as far as we are concerned the issue has been resolved. The item is no longer on sellable condition due to the heavy scratches.Ronnies Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The following is the response that Ronnies had sent to me after I returned the windshield to them:[redacted]I recieved the windshield today. The windshield has many scratches and scuffs that it did not have when I shipped it to you. I cannot resell it in this condition as a new windshield. Please let me know how you would like to proceed.In this email they stress that they cannot sell it as new which tells us that they represented the windshield to me as 'new' with scratches on it when sent to me.Again I stress that they admit sending me a windshield with scratches as new and 'they' have said that it was received back with scratches. They sent it with scratches and now are not accepting it back with scratches, I'm not following the reasoning. They have not proven that the windshield was in worse condition when they received it back from me just their word. And at this point any proof may be tainted. They sent it scratched and received it back with the very same scratches. I returned it in the very same packaging that they sent it to me in.I have spent an additional $60 to return it to them and would like the $275 plus the $60 for the cost I incurred.[redacted] never took the time to hear the facts, I was disappointed with their procedure.
