My memory of this file is not the same as Mrs ***. I personally handle every warranty and or customer service issue that comes through to my central office via a telephone answering service. My company has been roofing in over states for the last plus years and I
have over roofs under warranty at all times. Every times a bad storm hits in over cities I handle warranty calls. I handle an average of warranty calls a week. When I received this call for the first time I informed the *** that I provided a year written workmanship warranty that details my responsibility and the property owner's responsibilities and that my responsibility had ended at the end of years.I informed them that I am sorry they had a leak and would consider accepting responsibility for the repairs if they would proceed in the following manner and if I could prove the repairs that were needed were a result of my warranty. It is similar to an insurance claim. There is a policy. There is a claim. An adjuster does an inspection. Sometimes there is damage that is not covered by the policy. Sometimes the damage claimed is not caused by an event that is covered by the policy. My policy is workmanship for years. It is over at years, there are no exceptions unless I make an exception on a man to man basis. In this case I ask the Akin's to find a guy or contractor to come to the house to take pictures and to call me while they were there so that I could be a part of the documentation and discussion process. For the last years this has been a very effective way of handling warranty calls. It helps for several reasons. 1) It gets me the pictures so that I can tell what and where a leak is occurring and whether or not I am responsible2) It allows me to ask the inspector his opinion as to where the leak is occurring and what he suggests be done to correct the leak3) It allows me to negotiate a price with the inspector to repair the leak in those cases where I am responsibleWhy the *** chose to go around me on this I do not know or understand. They called my partner *** *** to see if they would handle it. My son just happened to be visiting with *** *** and they involved him as if I was not a part of the process. This past week Mr*** called my son directly and I just happened to be with him. I took over the phone call and MrAkin and I got into a sort of verbal disagreement. Mr*** informed me that he was a contractor in the home improvement business. Mr *** informed me that he was at the job and discovered that no drip edge was used and that he negotiated a refund from the contract. Mr *** informed me that he hired "his guy" to do repairs. As a contractor in the home improvement business one of the facts that Mr*** understood not to be in dispute was the period of time. However, if you ask him he will certainly say he doesn't agree, however, it is not a negotiable situation. He knew that my warranty was limited. He knew I wanted and that I deserved the pictures and the discussion before he proceeded with any repairs that he wanted me to handle. After the fact it becomes an argument. Apparently this is how he wants to argue. After ignoring my effort to help, after going around my back, after threatening to sue me,, after finding out he is a home improvement contractor himself. I am not responsible. I do not owe Mr Mrs Akin anything. Do you know how many severe thunderstorms with miles plus per hour wind driven torrential rainfalls exceeding 2" per hour since I installed this roof.Sorry I can't help on this one

Complaint: [redacted]
I am rejecting this response because:I never collected any insurance proceeds as they are being returned to the Insurance company, and the owners phone call never once included any mention of this matter being settled, and I find his conduct on the phone rude and offensive much like the actions of his project manager. if the owner would like to make a response and leave out the unfounded accusations then this matter is most likely to be settled.

Mr. [redacted]’s memory isn’t very good because what he stated
in his letter is not correct. I called [redacted]’s office on Monday January
11.  The lady who answered was very nice
and said she would have [redacted], the owner get in touch with me.  The next day he did call and I told him that
we had a leak and asked that he look at it. He told me that he was busy but
would try and get one of his people out later in the week.  That didn’t happen so I called back and he
said “oh yeah”, that he would get someone out that week.  That never happened.  In the meantime, it was raining every week
and we were afraid of additional damage.
I called a friend of mine who is in the roofing business to please come
out and take a look.  He sent one of his
people and found that in places there was no flashing and/or very little and
the wrong kind.  They took pictures and
explained the problem.  This is now going
on three weeks and all the rain we were having was very concerning as you might
imagine.  I again called [redacted] and he
ask that I send him the pictures and explained to me that his warranty was only
5 years.
In the meantime, my wife had contacted [redacted] here
in Atlanta and the owner informed her that they were not affiliated but they
had had several others call her with complaints about [redacted].  She also gave her [redacted]’s sons name and
number.  She did call him and he told her
he would talk to his dad and get back to her. Again we got the run around and
so we had another company, “not one of our guys” repair the roof and take
pictures as he did the repair and we found even more problems which we
documented.  We own an insulation company;
we do not go on roofs or do any roof work period.  No one ever went around [redacted].  He did not do what he said he would. Which
should have told me all I needed to know.
Then last week I called [redacted]’s son since we had not heard
back from him, and he put his dad on the phone.
But I had another reason for my call.
I had a gutter contractor whom we do business with, check out my gutters
and gutter protection.  He found that
when [redacted]’s company re roofer the house they’re installed the gutter
protection incorrectly thus making it ineffective.
[redacted] asked if I had pictures and asked how much I had paid
the other roofer.  He then proceeded to
tell me he would do nothing.  When I told
him about the gutter protection he asked me what I did and I told him I was in
the home improvement business and he thought that was very funny.
I have been in the home improvement business for over thirty
years.  I do not and have never done
roofing nor do I ever intend to.  I do
however sell gutter protection, and insulation to dealers across U.S.  as well as do sales and marketing
consulting.
So did I go on the roof to check it out after it was installed?
No.  And I wouldn’t know what to look for
if I would have.  I do not like [redacted]s
and I do not get on roofs.
What I do know:  We
contracted with [redacted]’s company to replace the roof on our house because it
supposedly had storm damage.  We asked
them to also install drip edge on the house which they never did but they did
refund a portion on the job because they did not do it.  I also asked that they disconnect and remove
the attic fan and install ridge vent. They did not disconnect nor remove the
attic fan but just covered it up.  They
did install the ridge vent.
While I appreciate the 5-year warranty but what they installed
did not fail it was never installed correctly in the first place.  They were negligent in their installation
process from the beginning.  And while I
do not know about roofing I do know about the gutter and gutter protection
products they destroyed.  The product was
designed to go over the first row of shingles and under the second and has
special clip in the gutter to screw the gutter protection to. [redacted]’s roofers
put it under the first row of shingles and nailed it through the roof which
will also start to leak at some point but also made it ineffective for the most
part.  Did I inspect it? NO.  I don’t get on roofs!  Please understand My brother was killed from
a fall from a building and I will not get on a roof, especially one as high as
mine.  I expect people to do the job
correctly they were paid to do.
This type of shoddy workmanship is what gives the home
improvement a bad name.  [redacted] is what we
call a storm chaser.  Taking advantage of
people who have had an unfortunate event in their lives and jumping on it for a
sale. All [redacted] needed to do is what he
said he would do, which was to send a crew out to our home to repair it, not
lie to us about coming and then NEVER showing up or even calling.  I have the bill and cancelled check for the
work done by another roofing company and just because I am in the home
improvement business does not mean that I have anything to do with roofs.  [redacted]’s company is responsible for this and
what is more, he darn well knows it!  Furthermore,
[redacted]’s is the one who mentioned me suing him and then told me that is would be
FUN!  The Revdex.com holds companies up to a
higher standard than this and I certainly hope they will look into the sham
this company is and how they treat customers that put their trust and money
into them.
Regards,
[redacted]

Very sorry to hear about the contract issue. We must reserve the right to accept or reject all offers and contracts generated by our sales people in the same manner as a property owner cancels at will.  Very sorry we dropped the ball getting the money back to you.  We have sent the money...

back to you at this time.  Please let me know if you have any other questions. [redacted]

Mr. [redacted] originally posted this exact text on my facebook page Sunday 9-24-2017 after my office sent him a collection letter.  I called Mr. [redacted] and told him we had agreed to settle his account as he requested. We have settled his account as requested.  If you will notice from Mr....

[redacted]'s comments, he is very happy with the work, he just demanded to keep some of the insurance proceeds.  Very difficult for Contractors when Homeowners utilize a Revdex.com complaint to settle financial business....especially when an agreement was in place.  We made the simple mistake of sending a collection letter after we had agreed to settle with him.  Sorry about that Mr. [redacted].

Mrs [redacted] and I have communicated directly each and every time she has called me.  I repaired her first leak with flashing and new shingles where the two roof intersections meet.  I repaired her second leak by replacing plywood and shingles in the middle of the slope of the roof where no...

penetration existed.  At this time I believe Mrs. [redacted] may be asking why I didn't or I have not fixed the interior damage caused by the second leak.  I will call her right now and figure this out.  Should be no reason why she felt that I was neglecting her.  I wish she had not made a complaint.I will take care of her asap.

This is communication.  Not the correction. I will have this corrected within 30 days.
