I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.I am still not satisfied and want a new Kousa Dogwood to replace the one that was defective. *** Response to MrS***’s response of 6/27/15.MrS*** said he visited the site and saw a “struggling dogwood”I am enclosing photos, one of which shows this dogwoodAnother photo dated 7/20/shows the condition of the bark after we removed the burlap coveringThe tree was in trouble even before it arrivedMrStirling stated in person that he would have never brought up a defective tree but this tree looks pretty sick to me MrS*** said that “all other plants appear fine and are growing.” I have enclosed pictures of a couple of the red twig dogwoods that show they are not “fine and growing” but are strugglingOne is already deadI have decided not to include these in the complaint as mentioned before because I know it is futile MrS*** said that the “Dogwood was not a Galilean but a Good Shepherd as per our invoice.” The fact is that the tree has many namesThe invoice of 6/12/14 says it is a “Steller Pink Dogwood”, the invoice of 7/3/says it is a “Good Shepherd Dogwood” while the tag attached to the tree says it is a “Galilean Kousa Dogwood.” (See photo) When it comes to the guarantee, MrS*** says that “when planting at a fee rate of 85%, we give a guarantee”. MrS*** then goes into an explanation of an “hourly” rate which does not have the guaranteeHow am I to know whether we are at an 85% or an hourly rateNowhere on the invoice does it say anything about hourly rate or 85% rate or what it means and that it negates the guaranteeAlso, the proposal (in the fine print) states that “guarantees are one growing season, any conditions beyond our control void warranty.” We were also told this verbally in that if we planted the plants ourselves, the guarantee would not be honoredInterestingly, this statement is not present on the invoice of 7/3/ MrS*** states in “B” that they “tolerated a lot of verbal abuse three times by Mr***’s sister”The fact is that my “sister” was only there twice, once in late May when she asked if the dogwoods should be blooming yet and the second time two weeks later when she stopped to say that the tree was deadOn the first visit, she was given a bag of fertilizer to try which we did and it made no differenceAs for abuse, MrS*** was given the facts of the matter and was asked for a new treeWhen he offered $instead of replacing the tree, my annoyed “sister” suggested that he was trying to avoid responsibilityThat was the abuse. One last note - MrS*** suggests that we “should be appreciative of only losing one plant considering a terrible winter”The fact is the winter was not all that unusual and the tree was in trouble even before the winter. How nice it must be to blame all the failures on the weather. Regards,

See enclosed.See the original “proposal” dated 6/12/14 also (enclosed).Our policy when planting at a “fee rate of 85%”, we give a guarantee.THE “ACCEPTED” CONTRACT WAS FOR ANY PLANTS (if not planted by the sister of property owner) to be planted by us “HOURLY” which has no provision for a guarantee. As told Mr. [redacted] and his sister :When planted by the hour, their cost is only a couple dollars “per labor” And NEVER WAS ANY GUARANTEE OFFERED or IMPLIED Ever Especially for a year. This statement was totally FALSE, (see copy of All papers, quote, invoice supplied etc.)B. We tolerated a lot of verbal abuse 3 times by Mr. [redacted]’s sister and diddid try to offer a nominal settlement of $40. to cool her abusive attitude and disruptive behavior at our “center” BUT we will not sit back and offer any more financial help.The work was complimented and PAID for at completion along with a Courtesy discount of $310.88 to help customer defray any “loss” should it be  incurred with a “mid-summer” planting of lawn and shrubbery.They should be appreciative of only losing one plant considering a terrible winter.Bob S[redacted]- Owner
