Rosemont at Heather Bend has received and reviewed the complaint filed by [redacted] The applicant submitted an application at our community Rosemont at Heather Bend on 10/10/The applicant signed the Texas apartment association rental application per paragraph 3; application deposit may or may not be refundableIn addition to any application fee, you have delivered to our representative an application deposit in the amount indicated in paragraph The application deposit is not a security depositHowever, it will be credited towards the required security deposit when the Lease Contract has been signed by all parties; OR it will be refunded under paragraph if you are not approved; OR it will be retained under paragraph or 7, or if you fail to answer any questions or give informationAcknowledgment; You acknowledge that you had an opportunity to review our rental selection criteria, which include reasons your application may be denied, such as criminal history, credit history, current income, and rental historyYou understand that if you do not meet our rental selection criteria or if you fail to answer any questions or give information, we may reject the application, retain all application fees, administrative fees and deposits as liquidated damages for our time and expenses and terminate your right of occupancyI have attached the signed paperwork by the applicant TAA rental application, Pinnacle application qualification criteria, along with the denial of the application letterRosemont at Heather Bend will not be able to refund the applicant the amount of $100.00, as a result of the applicant not meeting the rental selection criteria

I am rejecting this response because: I was informed by the employee at Rosemont at heatherbend that I would be receiving my holding fee back, she also informed me that the holding fee was to secure the apartment for me while the application was being ranShe then went on to tell me that the only thing that would be non-refundable was the application feeNow I understood the fact that the application fee was non refundable, that fee is needed to even run the applicationbut she told me that I would be getting that holding fee back if the application came back deniedI have those papers from the application as well and no where in there does it say that Rosemont at heatherbend would be stealing my money if my application came back denied

However, it will be credited towards the required security deposit when the Lease Contract has been signed by all parties; OR it will be refunded under paragraph 10 if you are not approved; OR it will be retained under paragraph 6 or 7, or if you fail to answer any questions or give false information. Acknowledgment; You acknowledge that you had an opportunity to review our rental selection criteria, which include reasons your application may be denied, such as criminal history, credit history, current income, and rental history. You understand that if you do not meet our rental selection criteria or if you fail to answer any questions or give false information, we may reject the application, retain all application fees, administrative fees and deposits as liquidated damages for our time and expenses and terminate your right of occupancy.
