Purchased vehicles in 2016, for business and personal The vehicles are as advertised, they are used vehicles and if purchased in NYS are fully inspected by Rosenthal Enterprises prior to purchase The prices are also very competitive and customer service is excellent Our experience was very professional and honest

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The car advertised on [redacted] was clearly not as advertised. I've attached multiple pictures and have many more if needed for any judicial proceeding. The seller took pictures of the vehicle at angles not to show the damages, to include the undercarriage. The car was specifically not photographed with the lights on, as his other vehicles on [redacted], because the right headlight was completely rusted out and not operating. As you can see by the pictures, there is no reason why these damages should not have been captured since the seller did take 60 pictures of the car not showing the damage. The following issues were not disclosed and are not part of normal wear and tear for a 30 yr vehicle. Even private sellers on [redacted] and listings such as Craigslist disclosed problems with the car as well as things that aren't working. Inside the vehicle not working and never disclosed: Cruise control not working, gas gauge not working (stuck on just over a half a tank), sun roof not working, power antenna not working, rear electric window not working, rear door panels completely separated from the panel, rear window switch broken. Engine compartment issues not disclosed: Diesel fuel leaking from fuel pump. I am required to park on the street with a large oil container to capture the leaking fuel, other oil leaks. When I drive the car and the engine gets hot with the diesel fuel leaking on it, it begins to smoke. Body: Excessive rust not disclosed. Two of the rear jack points are completely unusable since the rust has completely deteriorated the jack access points. These need to be completed refabricated. The two front jack points are very close to not being useable. There are several other serious rust holes throughout the undercarriage. The entire spare tire wheel well is rusted and unusable. I had to remove the spare tire to keep it from falling through. The only thing holding the spare tire was the rubber undercoating. The trunk was soaking wet when I got the car. I noticed a two inch hole that was completely rusted through at the top of the trunk. The left rear fender is completely rusted through to the interior of the car. Note the 3 rush hole through the frame.
It is baffling how a mechanic with 30 years of experience and a seller with 15 years of experience could have missed these glaring problems. This was clearly an intentional misrepresentation of the car and I have the before and after pictures to show. The seller states the car's oil was changed. I can send another picture, but its thick and black. Also, the brakes squeal and sound like metal on metal. I haven't had them checked yet, but need to because even after the fuel leak is fixed (which will cost me $500 from an independent mechanic), this car is not safe to drive. I think that's why the seller discourage me from picking up the car in NY and said he would have one of his reputable shippers to ship the car. 
I have been in contact with [redacted] and they are investigating this seller as well for several other issues. I am also in the process of working with the NY States Attorney.
Also, for the record, I initiated every phone call and email to the sellers, Avi and Megan. I can prove this with my emails and phone calls in any judicial proceeding.

The seller continues to say that he accurately described the vehicle and I encourage you to look at his description and pictures and compare it to what I have sent you. Many of the pictures didn't attach in previous responses so I added a few more today. I have dozens of pictures that would never go unnoticed by a 30 yr mechanic and a 15 yr sales person. Look at the gaping hold in top of the trunk where water is pouring. How can you open the drivers side rear door and not see the 3 inch rust hole? The bottom of the doors are completely rusted through, the jack points are useless and the spar tire wheel well is totally rusted. How can this go unnoticed? How can the fuel leak go unnoticed? Anyone taking this car for a 3 minute test drive would have noticed the other issues. Why wasn't this disclosed? This rust damage is not typical of a 1986 Mercedes, I can assure you that and will have any witness come to court to testify. I will document every discrepancy, which I have already outlined in this report. There are lemon laws that govern these types of transactions and the before and after pictures with the full documentation of the items that were damaged or inoperable and not listed on the original [redacted] listing.
The seller promised a $300 refund for the issues that I identified in my initial call with him which included rusted out jack points, sun roof, electric antenna, electric switches, etc. The seller told me on ** March that he would send out the check and never did. I suspected this after I spoke with him. It's the poor service after the sale.
I am willing to negotiate a settlement on this car prior to seeking legal action against the seller. If we can't come to an agreement, I will file a claim here in the County Court in Virginia. I have ample evidence with expert witness testimony to substantiate my claim.

I have been selling vehicles on [redacted] for 15 years with a 100% rating and have always been extremely precise and given my customers additional information on their vehicle because the majority of my customers are buying based on my perfect rating, my pictures, my description, and our phone...

conversations.  I sell almost 30 vehicles per month nationwide.  As you can see from our listing that was attached  you the customer we have almost 60 detailed pictures and a very fair description of this vehicle and if you review our [redacted] site ([redacted]) you will see every vehicle is pictured the same way and always has been for 15 years.  We always go the extra mile for our buyers to the best of our ability.  You will also read our very clear Terms of Sale in the [redacted] listing for the vehicle in question which is the same for all our listings.  It tells a buyer what to expect when purchasing a used vehicle.  This is vehicle specific and that is explained to the potential buyer as well.  This Mercedes is a 30 years old car and has almost 150,000 miles on it.  The vehicle has all the expected wear and tear any vehicle would have at that age and mileage.  Me and the buyer has detailed phone conversationsystem about the common rust issues these old Mercedes Benz'S have and he was given pictures to show it.  Even though our terms of sale discuss this and we tell customers to expect maintenance and repairs we went ahead and did numerous things for the buyer.  He received his vehicle after our independent mechanic who has been in business for 30 years went over.  We paid almost $500 to have some maintenance done that we didn't have to do.  He received a vehicle with, new brakes, a new windshield, an oil change, new bulbs, etc.  This is all expected maintenance that any vehicle would need especially one that is 30 years old but we did it for the customer.  On a vehicle that only cost $3,500 for us to spend $500 on items the buyer has already been made aware of shows how we operate and why we have such a stellar rating.  The vehicle is from Connecticut and we are a dealer in New York.  In Connecticut any vehicle that is 30 years old they do not issue an actual "title" anymore due to the vehicles age.  The paperwork is equivalent to a title but not called a title anymore based on their state motor vehicle's rules.  There is no issue or misrepresentation on that it's just a different terminology based on that states rules.  I was nothing but helpful, available, accommodating, and polite throughout the entire transaction with this customer.  I even answered his call at home with my family one night at 9:00 in the evening to help him when the third party transport company was delayed on the vehicle delivery.  I also kept in full contact with him and the transport company to make sure the delay was resolved.  I am not a shipper but I stayed involved so the buyer would have his car.  I even offered the buyer another  $300 refund after I already spent $500 for him on maintenence, but if he's planning on attacking me like this because he had different expectations on a 30 year old vehicle then why would I send him the refund?  Him and I agreed the refund would go towards some other maintenance items even when I had no obligation to do that and our add clearly states that the vehicle was sold with "no warranty".  He has now opened this case and gone back on his agreement and now is trying to get $1,500 on a $3,500 car.  I feel I've been more than fair and now I'm the one being taken advantage of.  If your office needs proof of our email conversations regarding the title, the vehicle, or receipts from our mechanic on the work we did please just let me know.Thank you for your time on this matter.
