I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

On August 1st, 2015 (not February 1st, 2015 as indicated in the complaint), [redacted] signed a contract to purchase a Polaris Slingshot using a total down payment of $6,495. [redacted] signed all loan and DMV paperwork. The loan was funded immediately online at the time of sale by Freedom Road...

Financial (one of our many lenders, based in Reno with corporate banking offices in Chicago) using [redacted] original down payment of $6,495. After the loan had already funded, [redacted] changed his mind and decided he wanted to put even more money down on his purchase. Even though banks do not typically modify their lending agreements once funded, we agreed to accommodate this request and started the process with Freedom Road Financial. We indicated to [redacted] at that time that we would go to work right away with the bank to get this change completed. Our [redacted] worked diligently with Freedom Road Financial to modify [redacted]’ loan contract, but unfortunately it takes a very long time for a large bank to unwind a funded loan and modify the deal terms once it has been funded. Fortunately, we successfully completed that modification with Freedom Road Financial on 9/17/15. Because of the length of time it took to complete (which we felt bad about but had no control over), we were able to successfully negotiate a full 1% point drop in [redacted]’ interest rate with the bank (from 6.49% to 5.49%) which will save [redacted] nearly $500 over the course of the loan for his inconvenience. We believe that [redacted] is now very happy with the change in his loan term after the sale, as well as our ability secure a sizable interest rate discount. We hope that [redacted] feels that our resolution was worth the wait despite the inconvenience. When we last spoke, [redacted] was very happy and grateful that we were able to resolve this issue for him. Review: The dealership had me sign a contract then submitted incorrect contract paperwork to the finance company.[redacted]). When the finance company called to do a phone interview they asked about the down payment and purchase price I told them what I agreed to,signed and paid. I was then asked about an additional $1300 that they had been told I put down. I stated what my contract read. When myself and co applicant where called by the dealership we were told to lie about the down payment and purchase price. We did not lie or agree to this.

When we called [redacted] to make our first payment we were informed our contract was rejected due to incorrect information on the contracted submitted by the dealership. I then called Roseville Yamaha's finance manager [redacted]. He told me a corrected contract would be sent for us to resign. However the contract received was falsified and fraudulent. At this point I called and spoke with [redacted] I was told to sign the contract and lie to [redacted]. He was doing us a favor. I called several times and requested the correct contract with correct amounts as per the original contract be submitted to [redacted]. We have informed him we would not sign a fraudulent or falsified contract.

We have received registration from D.M.V.

The dealership processed the check in the amount of $553.41 for the down payment.

I received a text message on Dec. 3, 2015 stating that the vehicle will be reported to the

repossession department for further review. We have tried to make payments to no avail because of the dealerships falsified and fraudulent paperwork. We were informed no payments will be accepted.Desired Settlement: We would like the contract issue resolved with the correct paperwork we signed submitted to the financial institution. So we can enjoy the vehicle we purchased.

Dear Ms. [redacted], I have had time to review and research the issues surrounding Revdex.com Complaint ID #[redacted]. I’ve responded to each allegation IN CAPS below: (1) “The dealership had me sign a contract then submitted incorrect contract paperwork to the finance company ([redacted]). We did not lie or agree to this.” IT IS COMMON FOR ANY VEHICLE DEALERSHIP (CAR, MOTORCYCLE, RV OR BOAT DEALERSHIP) TO USE REBATES FROM THE FACTORY TO ASSIST OUR BUYERS IN PURCHASING THE VEHICLE THEY WISH TO PURCHASE. PER CALIFORNIA LAW, THERE IS NOTHING ILLEGAL OR FRAUDULENT ABOUT THIS PROCEDURE. A DEALERSHIP IS FREE TO USE ITS REBATES IN ANY MATTER THEY WISH -- EITHER KEEP THEM AS ADDITIONAL PROFIT TO THE DEALERSHIP, OR GIVE THEM BACK TO THE CUSTOMER (IN THE FORM OF A DISCOUNT, AS AN ADDITIONAL DOWN PAYMENT, REBATE CHECK, OR WHATEVER THE DEALER MAY CHOOSE). IN THE CASE OF [redacted] AND [redacted], THE ADDITIONAL DOWN IN THE FORM OF A REBATE FROM ROSEVILLE POLARIS WAS NECESSARY IN ORDER FOR THEM TO BE ABLE TO QUALIFY AND COMPLETE THE FINANCING OF THEIR PURCHASE.MS. [redacted] AND MR. [redacted] HAVE CONTINUOUSLY REFUSED TO SIGN THEIR FINANCE PAPERWORK PROMPTING THE LENDER TO REFUSE THE FINANCING AGREEMENT. AS A RESULT, MS. [redacted] AND MR. [redacted] HAVE A VEHICLE IN THEIR POSESSION WHICH ROSEVILLE POLARIS HAS NOT BEEN PAID FOR. PER CALIFORNIA LAW, ROSEVILLE POLARIS HAS THE RIGHT TO CANCEL THE CONTRACT AND RE-POSESS THE VEHICLE BASED ON MS. [redacted] AND MR. [redacted] FAILING TO EXECUTE THEIR FINANCING AGREEMENT. THIS RIGHT OF THE DEALER IS OUTLINE IN CA DMV LAW FORM 553, WHICH MR. [redacted] AND MS. [redacted] SIGNED (SEE ATTACHED SUPPORTING DOCUMENT). WHILE IT IS NOT OUR DESIRE TO PREVENT MS. [redacted] AND MR. [redacted] FROM KEEPING THE SUBJECT VEHICLE, WE HAVE BEEN FORCED INTO REPOSESSION PROCEEDINGS TO GET THE VEHICLE BACK, BASED ON THEIR FAILURE TO CONSUMATE THE FINANCE AGREEMENT. AS OF TODAY, ROSEVILLE POLARIS HAS NOT BEEN PAID – NOT BY THE FINANCE COMPANY, NOR MS. [redacted], NOR MR. [redacted]. THIS IS ALL THE RESULT OF MS. [redacted]’S AND MR. [redacted]’S REFUSAL TO SIGN THE LOAN PAPERWORK. We have informed him we would not sign a fraudulent or falsified contract.” THE CUSTOMER WAS NOT TOLD TO LIE, BUT RATHER TO INDICATE TO THE BANK THAT THE TOTAL ADDITIONAL DOWN PAYMENT WAS $1,300 WHICH IS COMPLETELY TRUE AND ACCURATE. THE SOURCE OF THESE FUNDS WAS REBATED MONEY FROM ROSEVILLE POLARIS, IN WHICH WE GAVE THE REBATE MONEY FROM POLARIS BACK TO THE CUSTOMER IN THE FORM OF A DOWN PAYMENT (RATHER THAN KEEP IT AS PROFIT FOR OUR DEALERSHIP). WITHOUT DOING THIS, THE CUSTOMER WOULD NOT HAVE QUALIFIED FOR THE PURCHASE. SOME LENDERS ACCEPT THIS, AND SOME BANKS DO NOT. WE HAD NO REASON TO BELIEVE THAT OUR LENDER WOULD NOT ACCEPT DOWN PAYMENT ASSISTANCE FROM THE DEALER; HOWEVER, IN THE CASE OF MS. [redacted] AND MR. [redacted], THE BANK DID NOT ACCEPT DEALER ASSISTANCE ON THE DOWN PAYMENT. THIS IS ACTUALLY A VERY COMMON SITUATION IN AUTO SALES, BUT NOT SO COMMON IN THE SALE OF MOTORSPORTS PRODUCTS. THAT IS WHY ALL DEALERS HAVE A “RIGHT TO CANCEL” CLAUSE IF THE DEAL IS NOT “BOUGHT” OR PICKED UP BY THE LENDER. BECAUSE THE CUSTOMER WAS NOT COMFORTABLE WITH THIS NEW REQUIRED STRUCTURE (AND HAS SINCE REFUSED TO SIGN THE NECESSARY FINANCE PAPERWORK), WE NOTIFIED THE CUSTOMER THAT WE COULD TERMINATE THE CONTRACT AND RE-POSESS THE VEHICLE IF THEY WISHED. AGAIN, THIS IS NOT OUR PREFERENCE BUT WE HAVE NO CHOICE AS TO-DATE, WE HAVE NOT BEEN PAID FOR THE VEHICLE. (3) “We have received registration from D.M.V. The dealership processed the check in the amount of $553.41 for the down payment. I received a text message on Dec. 3, 2015 stating that the vehicle will be reported to the repossession department for further review. We were informed no payments will be accepted.” I AM DEEPLY DISTURBED BY THE ALLEGATION THAT ROSEVILLE POLARIS CREATED “FALSIFIED AND FRAUDULENT” PAPERWORK. THAT SIMPLY IS NOT TRUE. I WOULD CAUTION MS. [redacted] AND MR. [redacted] AGAINS SUCH STATEMENTS, AS WE DO NOT TAKE SLANDEROUS AND LIBELOUS STATEMENTS LIGHTLY. WE HAVE BEEN A MODEL DEALERSHIP IN ROSEVILLE, CA SINCE 2003 AND HAVE ALWAYS OPERATED WITH THE HIGHEST OF ETHICS. TO-DATE, WE HAVE ONE OF THE BEST NATIONWIDE REPUTATIONS IN OUR INDUSTRY AND HAVE RECEIVED NUMEROUS INDUSTRY AWARDS FOR CUSTOMER SERVICE AND PERFORMANCE. HAVING SET THE RECORD STRAIGHT ON THE ABOVE FEW AREA OF THIS TRANSACTOIN, I PROPOSE RESOLUTION: (1) ROSEVILLE YAMAHA HAS WORKED WITH THE BANK TO GET $553.00 CASH DOWN PAYMENT ACCEPTED/ALLOWED BY THE LNEDER (WITH NO ASSISTANCE FROM ROSEVILLE POLARIS IN TERMS OF REBATES OR ASSISTANCE IN THE AMOUNT OF $1,300 AS PREVIOUSLY REQ’D). (2) BECAUSE IT HAS BEEN PAST 30-DAYS, THE CURRENT VERSION OF THE SALES AGREEMENT HAS NOW EXPIRED. THEREFORE ROSEVILLE YAMAHA HAS PREPARED AN UPDATED CONTRACT (ALL THAT HAS CHANGED IS THE DATE).(3) MS. [redacted] AND MR. [redacted] AGREE TO SIGN THE NEW FINANCE AGREEMENT, WHICH WILL REFLECT EXACTLY THE SAME AS THE ORIGINAL CONTRACT (WHAT THEY WANTED THE FINAL CONTRACT TO REFLECT) IN TERMS OF TOTAL PURCAHSE PRICE, INTEREST RATES AND DOWN PAYMENT OF $553.00. HOWEVER, WE WILL NEED THE NEW LOAN DOCUMENTS TO BE SIGNED AND RETURNED WITHIN 72 HOURS OF RECEIPT VIA OUR OVERNIGHT. ANY DELAY IN RECEIVING THE DOCUMENTS BACK IN A TIMELY MATTER WILL RESULT IN RE-POSESSION PROCEEDINGS. THIS IS OUTSIDE OF OUR CONTROL AS WE HAVE CERTAIN INSURANCE AND BANKING REQUIREMENTS ON OUR UNSOLD INVENTORY THAT WE ARE BOUND BY AS PART OF OUR DEALER AGREEMENTS. WE WILL PROVIDE THE OVERNIGHT ENVELOPE. ANY QUESTIONS OR CONCERNS SHOULD BE DIRECTED TO [redacted], OWNER @ [redacted] Please note that if we do not receive back the newly signed Sales Agreement in a timely manner, we will unfortunately have to resort to re-posession. Yes we accept the proposal. We were never informed of any "rebates". We agree to sign a new contract as long as it reflects ALL of the original contract details.We would advise the owner to educate his employees on personal values and ethical work habits. Looking forward to receiving correct documents and getting this matter resolved.

Review: On February 1, 2015 I purchased a Polaris Slingshot from Roseville Yamaha Kawasaki Polaris. I signed a Promissory Note Security agreement with Freedom Road Financial listing the Cash Sales price as $23,297.99 including sales tax, license fees and a service contract. The down payment was $6495..00. Roseville Yamaha did not provide me with a copy of the Freedom Road Promissory note. I acquired a copy from Freedom Road Financial on August 17, 2015.Prior to taking delivery of the vehicle, I decided to make an additional down payment of $2500.00, making the total down payment $8995.00. Roseville Yamaha did not execute an amended Promissory note but assured me it would be done shortly.I have in my possession a Deposit Summary (Deal Number 8870) dated August 2, 2015 listing total deposits of $8995.00.Despite many promises from [redacted], the [redacted], to date September 11, 2015 Roseville Yamaha has not provided me with an amended contract or refunded the additional $2500. which would be acceptable to me. Freedom Road informed me today that Roseville Yamaha did provide them with an additional downpayment that lowered the principal amount but did not amend the contract or the monthly payment. This is contrary to my wishes and the information provided me by [redacted] who promised many times to execute an amended Promissory note to lower the monthly payment which was the purpose of the additional downpayment..Desired Settlement: Amend the Promissory note as promised by the dealership to lower the monthly payment.
