arial, sans-serif;">Per our conversation this morning here is my in formal response to Mr. [redacted]’s accusation.

When Mr. [redacted] came in he had 2 separate issues, one being that the vehicle shakes badly and the other was it not shifting in to 2nd gear. We requested that he allow us to diagnose the problem, which would cost $99 for 1 hour and he declined. He said “I do not want to spend $100 just to look at it”. Instead he stood at the service counter with our lead technician [redacted], and our Service Manager [redacted] and asked what they thought it could be. [redacted] gave his opinion of various fixes for both issues, which included cam phasers, fuel injector replacement, timing chain, tensioner, and torque converter. After discussing all possible fixes Mr. [redacted] left saying he would go buy his own parts and come back to have them installed. Being that he would not allow us to actually diagnose there is no guarantee that it would fix his issues.  When Mr. [redacted] came back about a week later with a truck full of parts that he bought elsewhere, he wanted to be put in front of all the other customers that were scheduled that week. We informed him that we could not bump other customers out of the way, that we were about a week out from being able to install his parts. He asked if he should take it elsewhere and we told him we would do our best to squeeze him in. It did take about 2 weeks to complete the work he requested, at that time the first issue was fixed, however the 2nd issue of it not shifting out of 2nd was still there. We asked him if he would like us to diagnose the problem and fix it and he said “No”. He then picked up his vehicle and that’s the last we heard from him.

Had Mr. [redacted] allowed us to properly diagnose his vehicle we would have been able to identify the exact problem and fix it properly. Instead he wanted free advice, which we gave him, and he went to a third party to purchase his own parts to save money. I do not believe we should be liable for not fixing a problem that we weren’t allowed to diagnose. We only installed the parts that were given to us at Mr. [redacted] request. Those parts were installed correctly and are in good working order. Additional work was needed to fix the 2nd issue that we could have easily done if allowed.

Review: (Early Aug 2015).Took vehicle in for intermittent shuddering. (I thought torque converter may be bad) Shop foreman stated: truck had bad cam phasers and fuel injectors were leaking.

(Aug 11th). Took vehicle to dealership. Told them that my truck now will not automatically shift into 2nd gear. (transmission). (Aug 12). Gave them parts for cam phasers and fuel injector replacement. Asked if I will be able to get my truck back in a week? Shop foreman stated: have a few vehicles in front of you but I'll see what we can do. I replied, do I need to take my truck elsewhere because of your workload. The reply was no.

(Aug 15): Went by dealership to check status of truck. Service mgr stated my truck has not been touched and he would contact me on Monday, Aug 17th, with an update letting me know if the shop can get to the truck.

(Aug 19) Service Mgr calls and says my truck won't be taken care of this week. And it would have to wait until the following week. I asked, why didn't he call me on Monday like he said he would? He replied, " that's on me"

(week of Aug 24) Shop foreman commenced working on truck replacing cam phasers and fuel injectors. I decided to go ahead and request a torque converter be installed. I, the owner, was providing the part (torque converter).

(Sept 2) Received text from shop foreman stating truck is running great and still has no gear after 2nd.

(Sept 3) I picked up the truck and manually shifted into L2 gear and drove 35 MPH home. Had truck towed to a tranmission specialist.

(Sept 4) Trans specialist called me; stated transmission oil level did not even register on the stick, the wiring underneath the truck from the torque converter install was unsat. They recommended I get another transmission.

My complaint: Strongly feel my truck was misdiagnosed. Truck has intermittent shuddering, suspect transmission. I was told cam phasers & fuel injectors. Invoice states no diagnostics done on trans. Drove away the same way I drover there.Desired Settlement: I would like half the labor cost I was charged returned back to me for service and repairs that were definitely not needed or associated with the original problem, which was the transmission. I was charged $1975.00 for labor. I am requesting a $900 refund and or credit to my debit card.

Review: 9-1-2014 car was dropped off to have clutch repaired. 9-2,9-3,9-4, they kept calling to ask for more time to repair. 9-5 car was to be repaired and ready by 3:00pm. Got to location trans was on floor. During this time I visited twice and saw car outside not even being looked at. 9-6 was told will be ready. Picked up 9-6 and every time you push clutch in it reeves up to 3000 rpm, when stopping to go back noise under car, flashlite they left under car fell out, took it back within 4 miles. Said mafs was bad, I told them no way its a vaccum line you left unhooked. 20 minutes later it was running better, told again was mafs, LOL. was vaccum line they left off. Few weeks later 10-2 I was driving home from dinner and went to slow down at a light and no brakes, no clutch. Called friend to follow me home. Called [redacted] , he gave me tow company number to call Mcdaniels 663-2040. Friend came over next day to aid it figureing out problem noticed no fluid in master cylinder for brakes and said clutch operates off same cylinder. Filled with 1 pint of dot3 and brake and clutch began to work again. Called [redacted] 10-3 to let him know clutch came back after adding fluid and asked why they did not put fluid in clutch during repair. He had no answer but said it shud be ok, to drive it. I again told [redacted] why was this over looked and that I was worried about the damage it mite have caused, he again said no, clutchs are tough, you will be ok, its meant to take abuse. month after that we decided to take the garaged car which is driven very little on a trip. Several times during trip I heard noise from the clutch area, to me it was a bearing noise, rotational in sound but only when clutch is pushed in, pretty much isolating it to a bearing.12-21 which was a sunday so Rosner wasnt open to discuss. 12-23 went by rosner to talk to [redacted] again. Said cant look at it now or this week as Roger was off. would have ot be first of year like the 5th of January. This just kept making me madder and madder. Called the general manager Rick Evans on 12-26 left message to call me back. He did and made an appointment for 12-29 for him and I to sit down and discuss the repairs to my car. I told him I felt the bearing has been destroyed due to the fact they put no fluid in system when they had it apart. He told me it is a closed system so you dont need to. That is 100% total false assumption. A clutch and bearing has to have fluid to operate. Without fluid it burns the bearing up and boils what fluid you have in the system from over heating thusfor making the fluid unable to recover and do the job of lubricating the bearing properly. I then told him bottom line is you guys did a bad repair on my car, nothing but problems and I want and expect it to be fixed. 1-5 dropped off car for repair and what I thought was replacement of bearing. 7 days they kept the car without even replacing the burnt brake fluid as I asked so the clutch would have a change to maybe survive, they did nothing but park my car in the lot until the 7th day and said it was fine. That clutch is suppose to make a noise. I told them again it is not the clutch, its not HARMONIC as clutch's make, it is a bearing. You burnt up the fluid by not adding it first time. I was told it will subside and it is ok to drive it. they say they heard no noise such as a bearing. I heard it twice going home that day so I called the clutch manufactor and asked them about the noise. When I told EXCEDY it made noise when I pushed clutch in he said hold up, its not yer clutch, its your release bearing, the shop should know that. I asked him again, he said all we do is clutchs and kits, it is 100% bearing noise your hearing, the shop killed it the minute you drove away with no fluids in the cylinder. EXCEDY company guy was [redacted] I called [redacted] back and notified them the bearing noise is worse. Was told to bring it in again, but he was not happy. That evening wife and I were coming home from dinner and got off exit 136 , got to bottom of hill to stoplight. Go to put it in first and the gears are stuck in 5th, cant move. I went off, boiling from my ears, so upset. Cut car off got it out of 5th into first and started car and took off but would not come out of first, had to pull over cut off and get out of first now, got into thrid gear, called friend to follow me home as I only had thrid gear. 1-20-2015 I borrowed a tow dolly from friend as was going to take car up to Rosner, when starting car I noticed gearshift was then working in gears. On way to Rosner in [redacted] at light it again stuck in gear so had to go through the process again of cutting it off and on to get anywhere, finally got to sheets to fuel car and waited a while after calling [redacted] to tell him it was going slow as it now gets stuck in gears and wont come out. He said drive it , it will be fine, LOL. that is this guys favorite saying. Once at Rosner dropped off and talked to Roger also, told him the noise is worse and now its sticking in gear, points to bearing, he agreed but said he had to do what he was told and could not make any of those desscisions, but just do as told. Next day car was still in parking lot, not touched. 1-22-15 was called and said ready, but they could not hear noise. I then told [redacted] I was at my end dealing with them on this repair, he said that was fine and that if I wanted to take collection and repair action that was ok, the gm was aware of the situation. I took the keys and said see you in court. This ordeal has gone on for 5 months, lack of ability to repair a car, un knowledgable staff from the General Manage to the Service Manager is unbelievable. They have put me through[redacted]. I went and got 2 bids to repair car on 1-22-2015 before picking up my car from Rosner. I pretty much made up my mind I will just take them to court and sue but in meantime I want my car fixed. On 1-27-2015 I dropped my car off by another shop to have it fixed, they called me in 1 hour from the time dropping it off and said fluid is also burnt and the bearing fell out in pieces, also dowel pins were scarred up like someone had used pliers on them so they had to replace as well. I informed them please save me the bearing and parts, except for fluid, no way I can carry that around but I want the parts Ther bearing that was new when Rosner installed it is in pieces and photos have been taken of it. If they would of just listened in the begining this would be nothing more then a bad day of repairs but it has turned into a 5 month journey to [redacted]. By the way the shop that re-installed another clutch system as no one wud replace just one part, was done in 5 hours[redacted]5 hours[redacted] same day[redacted] and OMG it is smooth and OMG. Rosner Ford is not suitable for working on cars for sure.Desired Settlement: Refund total cost of initial first clutch and parts plus labor as well as new shop replacement clutch that had to be installed due to Rosner's lack of proper repair and costly time period of destroying customer quality and confidence.

Response:

The offer that was talked about was not 100% but rather labor only refund of 677.00 I had purchased a slave assembly and clutch system, that due to the negligence of Rosner Ford from improper installation was destroyed. The parts cost involved were another 493.82 plus the 677.00 in labor.Since [redacted] with Rosner was not willing to fix the problem the car had to be taken to another dealer to repair at which that cost was another 1207.30 out of my pocket. If Rosner had fixed the problem or offered a resonable refund of damaged parts also which photos are available as proff then this issue could of been resolved. So to clear the air the cost of 1207.30 is including parts as well as the labor only offer they made of 677.00.. Repeat , they did not offer 100% refund but merely labor.

I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
