Complaint: [redacted] I am rejecting this response because:Ross Landscaping and Irrigation, owner [redacted] ***, tends to attempt to blame the customer for his poor work and workmanship There are a number of YELP reviews that corroborate If the [redacted] sales person called out pressure treated cedar, then Ross Landscaping and Irrigation should be able to produce receipts from [redacted] as to that fact - I have not seen a receipt for materials EVER As I said, a number of fencing professionals have seen the fence and the catastrophe it has become, and each of them has said the wood in NOT cedar I would not have known this had [redacted] not refused to return to the property and fix the issues Now that I am aware, I refuse to accept a product that is not the cedar which was bid and represented by Ross Landscaping and Irrigation I am told the Pressure Treated Pine is known for warping and not being a stable product for fencing - this is the reason I specified CEDAR in my request for proposal I have emails and texts from [redacted] refusing to fix his work on the premise that the city of [redacted] passed the inspection There was no "yelling" on my part The city is unaware of what was bid and what should have been built and they inspected one week after it was put up, before things started going horribly twisted In the meantime, posts, boards and gates are warping and pulling away from one another The fence will be falling down on itself within the year If the Revdex.com is interested in seeing the rude and very scary texts and emails [redacted] sent to me, I am happy to provide them Sincerely, [redacted]

To whom it may concern,   This letter is in follow up to the complaint by [redacted]. I received the permit from the City of [redacted] which was required, completed the work and the Inspector City of [redacted] signed off and commented to advise [redacted]...

[redacted] that it had passed inspection and to please stop calling the City number at [redacted] required that she inspect the fence herself before I would receive final payment. [redacted] inspected fence and told me it looked very nice at which time she paid the bill in full. Two weeks later when [redacted] emailed me about issues with warping pickets and a problem with the gate, I returned her email. Due to weather I was not able to get back as soon as she wanted so we scheduled a date in which I added a latch to lock it from the inside and also replaced the 20 pickets [redacted] mentioned in the complaint. While I was checking the gate, [redacted] was drinking and yelling at me that I need to check the pickets. I replaced the pickets and chose to leave as she was becoming hostile and I did not want to be liable for what she may do. I told her I would come back at a later date when she was not there to avoid any further confrontations but [redacted] demanded that she be there. I took the 20 pickets I replaced to the dump and absorbed the cost. I contacted [redacted] and asked if the pickets are made of pine or cedar. Since I was told by the sales person that they were pressure treated cedar. The sales person told me that they were not poisonous and have not had any issues with any customers for over 10 years. The [redacted] manager gave me the wood distributor’s number and advised me to give them a call. I am awaiting for a reply. All work was completed at or above industry standards and I have fulfilled what appeared on my bid. Tell us I wrote Ms. [redacted] several bids as she constantly changed her mind. When submitting my bid to Ms. [redacted] it includes my labor costs in the amount of $75.00 p/hour which appears on the bid as “work to be provided” and explains how and why I am doing the work listed on the bid. still outstanding is a grand total of $1902.42 which includes $473.03 for the grading bid and $1429.39 for the (Tree replacement per the HOA rules (see below).The amount outstanding includes payment for 2 trees which were written in to the escrow to comply with HOA rules. Upon completion of planting these trees, Ms. [redacted] was to submit an invoice to her HOA; however she never sent the information for the HOA to pay the $1429.39 which was approved prior to the start of the job. I went back and reviewed the emails from [redacted] (Realtor) and located where to submit the invoice which I did electronically and copied Ms. [redacted] and [redacted] to keep everyone in the loop. I have fulfilled what was included and approved by Ms. [redacted] and require the remaining grand total of $1902.42.I will email all correspondence referencing the complaint ID and have provided the contact information below for [redacted] since she is familiar with the situation and the work agreed upon between Ms. [redacted] and myself. I also have pictures of the site before and after and verified that the drainage and sump pump were working before leaving her house. I am rejecting this response because:[redacted] has the check for the trees from the HOA.  I will not pay for services he did that were expressly discussed for him not to do.  I paid him for the materials, though I was overcharged.  He flooded my basement, put rock down that I now have to remove, and has cost me considerable time and money.
