[redacted] on Monday, December 25, 2017Dear [redacted],My name is [redacted].  I am the co-owner and Secretary/Treasurer of Ross-Wells, Inc.  Ross-Wells, Inc. is the company named in the complaint from [redacted] to the Revdex.com with a designated complaint ID number of [redacted].  I would like to answer this complaint for my brother even though during the cited phone conversations he was located across the room from me.  Upon my probing of this call where he seemed upset, he subsequently gave me details as to what that call was about.  As a result of my only being able to state facts that I directly know, the defense of the representations will not include anything but facts backed up by other individuals or my personal knowledge.  This complaint has done nothing but shock me with [redacted] and our company being portrayed as the “Bad Guys”.  Since I am an accountant and not talented in written prose, I will respond in the form of an outline.Facts regarding Ross-Wells that answer errors in this complaint or the cause of a delay in payment of the demanded refundThe Wells brothers purchase of the company that is Ross-Wells, IncRoss-Wells, Inc. purchased by John and Robert Wells on March 24, 1984.Ross-Wells, Inc. has operated and its predecessor companies have operated in the same business lines since the early 1950’s.Prior to the purchase by the Wells brothers in 1984 the company was started by Wilfred Ross and Loyal Wells in the early 1950’sDuring the 1960’s the company was sold to a conglomerate known as Beatrice FoodsAll the while until the Wells brothers purchase of Ross-Wells, the company was run by its original owners Wilfred Ross and Loyal Wells for Beatrice Foods.It is difficult to determine where [redacted] possibly got her information that there was any change in ownership of Ross-Wells that in any way reflected the changing of formulations of the product she used or any other member of the same co-op had any change thereto for the entire existence of the co-op to which she joined in late 2017 and received 2 orders.The formulation of the Eureka/Titan Blue raw dog food.The formulation of Eureka/Titan Blue raw dog food dates back to at least the 1960’s with a few minor tweaks along the years.The original use of this formulation was as mink food A good mink food will be a great dog foodWith the exception of a supplemental vitamin mineral pack added at minute levels (including the carriers-at levels of the entire pack of below 4 lbs of the pack per 10,000 lbs of finished product) only as an insurance policy to prevent deficiencies that may exist in what is sold as a complete diet.  The ingredients in this complete dog food are all raw meats or other proteins non-meat (primarily low heat level cooked eggs).At a point in time exceeding 15 years ago the vitamin mineral supplement pack was changed. The change in the vitamin mineral pack was subsequent to Winston Hobgood having designed and purchased packaging that reflected the meat components and the actual prior contents of the previous vitamin pack.Winston Hobgood owned the trade name and label of Eureka.Ross-Wells, Inc. had always been the formulator of the mink premix/dog food that at various times was sold and labeled under Ross-Wells, Eureka and TITAN BLUE names and labels.The wrong addressing of your letter to Ross-Wells regarding the complaintRoss-Wells, Inc. moved its physical office location in Mequon, WI in November of 2015.Even prior to the move from 6200 W. Mequon Road to 10520 Baehr road, we never after about the year 2000 had a mail receptacle  at our physical address due to multiple snow plow incidents of our mail box being destroyed on the four lane state highway in front of our former location.Ross-Wells, Inc. has always told all its customers and suppliers to never utilize the physical address, but rather use the P.O. Box 426 USPS addressing.The post office usually has returned anything addressed to 6200 West Mequon Road to the sender. Google/other internet browsers for some reason, without us being able to find out how to change, have our address as 6200 W. Mequon Road.Thus your complaint was actually placed into our P.O. Box 426 for pickup on Friday December 22, 2017—already extremely close to the 7 day limit for us to answer your complaint letter dated December 15—the actual day of the last conversation between [redacted] and [redacted] and also the date [redacted] sent his personal check to [redacted] to satisfy her demands.We are thus explaining the delay in response to your letter that was actually received on December 22, 2017.We are actually very amazed the post office would place a letter in our P.O. Box that was addressed to a non-existent street address.   Even during the years we were located at 6200 W. Mequon Road it was extremely rare for an article or envelope to make its way into our P.O. Box if thus addressed.Again this entire explanation is simply to explain the delay between your mailing and our receipt of the Revdex.com complaint.  We would never sit on and not immediately respond to such letter, especially if feeling the facts were so wrong as in the case of the Balkovek claim(s).Facts regarding the payment of the complaint and its delay Even before the receipt of the Revdex.com complaint [redacted] had personally sent a personal check dated December 15 (the same date as her last call to him) to Jennifer Balkovek.A copy of the cleared check with Chase bank notes on the side of the copy indicate a posting to his account on December 21, 2017.The copy of this cleared check as received from Chase Bank is attached belowThe check was made out for $489.70—the exact amount of the claim in her complaint to the Revdex.com.There is no way [redacted] sent this check knowing of or in response to the Revdex.com complaint.  We just got the actual complaint from the Revdex.com on Friday December 22, 2017.   This check was written personally to expedite the payment since Ross-Wells, Inc. only cuts checks once per week on Mondays.  Such checks generally being mailed on Tuesdays.[redacted]’ check was written and mailed on the same day (December 15, 2017) as the last phone call between him and [redacted].  The [redacted] check cleared and was posted to his account on Thursday December 21, 2017.The delay between the phone call expressing the last complaint and the posting to his account can be explained in the following possible delays:Possible delay in mailing from the office mail out box---I was out sick on Friday December 15, 2017 and am the primary person delivering the mail to the Post OfficeThe weekend (2 days delay)The mail (up to 4 days delay at prime Christmas mail season)The possible delay of [redacted] not either receiving from her mailbox during working hours or not depositing the check on the same day the check was delivered in the mail to her address.The bank clearing process (up to 2 days from deposit of a check until it is posted to the bank the check was drawn upon)All of this together indicates timely action on the part of Ross-Wells/[redacted] regarding [redacted]’s desired refund even though the representatives of Ross-Wells still believe this claim and subsequent repayment to have been without merit.Confusion regarding the Eureka/Titan Blue differenceIn the early 1990’s, as I recall as to the timeframe,  Winston Hobgood approached the manager of the Medford, WI meat blending and freezing operation to get a viable dog food to sell to the mushers in the Alaska Iditarod.It was decided to use the Ross-Wells premix as a base for this desired product.Winston Hobgood worked with Ross-Wells for many years utilizing the base mink premix that Ross-Wells had sold as such and also as a raw complete dog food.During this time of labeling the exact same product both as Ross-Wells and Eureka dog food it was determined it would be much more efficient to only inventory, have packing materials for and distribute both Ross-Wells and Eureka dog foods under the Eureka name and labeling.Winston Hobgood was to purchase all packaging, be available for consultation regarding his dog experience, create a website, provide his trademarked name of Eureka and forward leads originated from the website to Ross-Wells, Inc.For this Winston Hobgood received a per pound commission for all Eureka produced for Alaska customers or for Ross-Wells customers in the lower 48 states.See the discussion below regarding how Eureka/Hobgood did not have an accurate website for the Eureka products.TITAN BLUE and Eureka were and are exactly the same formulation.Ross-Wells was never deceptive about the Hobgood wrong stated facts on their packaging and website.See item VI. A. below to see how any deception was actually the result of Hobgood action or actually inaction to change the labels of Eureka to truly reflect the changed supplemental vitamin mineral pack in the dog food.Upon the formal decision in July of 2017 for Eureka and Ross-Wells to go our separate ways, Ross-Wells took the opportunity to correct the labeling and ingredient list previously misrepresented by the Eureka Labeling and website.    How Ross-Wells markets the Eureka/Titan Blue productsRoss-Wells sells the type of product purchased by [redacted] to co-ops or individuals that are in a position to distribute these products.Ross-Wells has never had nor desires to have any retail presence for its productsRoss-Wells’ primary business is the wholesale truckload quantity production and delivery of bulk raw meat ingredients to the major pet food companies.Ross-Wells has never had a websiteRoss-Wells has no marketing staff and actually utilizes the group/coop leaders to perform the marketing function and the truckload quantity shipments are handled at the plant manager or [redacted]’ level.Group leader reaction to problematic single instance complaintsI personally called the group leader through whom Jennifer had ordered her Titan Blue dog food.  She indicated no other group member had any similar complaints about the exact same product from the same production batches.  There were other comments where other members of the same group actually refuted Jennifer’s statements and claims.I had explained in an August 2, 2017 email to the group leader that Eureka and Ross-Wells would be going our separate waysI told all group leaders of the discontinuance of the Eureka name and replacing such name with our own TITAN BLUE name for the exact same product sold under the Eureka label and name. Labeling differences vs actual content of the productDuring the life of Winston Hobgood there was a change in the composition of the vitamin mineral pack added to the Eureka/Titan Blended complete dog food.  Ross-Wells informed Winston Hobgood of such change and since he had to pay for the packaging and any changes to the printing plates used to create the packaging labels---his response was he was not going to change the labeling from what it had previously read.  He said it was an insignificant aspect and would not be worth the cost.Upon the death of Winston Hobgood, Ross-Wells made a conscious decision to not change the ingredient list to reflect actual since at this point Ross-Wells representatives felt the relationship with the estate of Winston Hobgood (the Hobgood children that were never involved in Eureka and lived across the country from Winston) was strained and based on non-factual beliefs of the children of Winston Hobgood.  At this point after the death of Winston Hobgood, Ross-Wells was paying for the packaging starting with the death of Winston and for the roughly 2.5 years of involvement of the children the representatives of Ross-Wells felt the name EUREKA was fragile as to our continued use as actually bore out in the summer of 2017.  In July of 2017 just after receiving their first half of 2017 commission check, the Hobgood children, through their lawyer, sent Ross-Wells a letter indicating the demand to discontinue using the Eureka name or label assuming the Hobgood children were not satisfied with the commission arrangement that paid them for the shielding name, a website and their forwarding sales leads from the website to Ross-Wells.  At this point Ross-Wells changed the name to TITAN BLUE. With the Hobgoods/Eureka no longer being a concern to taking proper actions and correcting the labeling, we corrected the labeling of the TITAN BLUE (formerly Eureka) ingredient list to what was actually contained inside.  Such change in the packaging and ingredient lists occurring during the fall of 2017.The primary change was to the items in the vitamin mineral pack that had been changed many years ago but still indicated what was in the original vitamin mineral pack at the time Winston Hobgood bought his original packaging printing plates to label the Eureka products.Facts regarding “Eureka” as a label, product, company and websiteWinston Hobgood owned and trademarked the name EurekaRoss-Wells always had formulated and owned the product and production capacity to produce Ross-Wells /Eureka/Titan Blue dog foodEureka always operated as a website run by Winston Hobgood The children of Winston Hobgood were to update the Eureka website, allow Ross-Wells the use of the name Eureka and pass along sales leads that originated through the Eureka website.The Hobgood children never did maintain the website and only infrequently passed along leads attained through the Eureka website.The Hobgood children assumed they had more than they actually had when they inherited Eureka from their father in 2014 upon the death of Winston Hobgood suddenly from an unknown bout with cancer.Facts regarding the potential causations of the original problem and the emotional reactions of dog owners.Ross-Wells was accused by Jennifer Balkovek of falsely designating the ingredients of the Eureka vs TITAN BLUE.  During the entire existence of Jennifer Balkovek as a user of TITAN BLUE, Ross-Wells never represented the statements made by any member of the Hobgood/Eureka website to be true statements.In fact, there were several statements on the Eureka web site that were wrong.The supposed offender (as stated by Jennifer Balkovek) creating problems with the Balkovek dog was yeast.We have been told by true experts yeast is a probiotic and inert at worst.It is truly my belief Jennifer’s dog is displaying an allergic reaction to chicken or poultry.Jennifer Balkovek always purchased TITAN BLUE which is primarily formulated using poultry.All the symptoms she designates as her dog having are extremely similar to the signs of a chicken or poultry allergy in a dog.  Ross-Wells has products that are exactly the same formulation, but without any of the poultry and beef muscle meat replacing such poultry on a one or one basis.  This product seems to clear up the type of symptoms Jennifer is currently mentioning the yeast (at its absolute minutel level of inclusion) had caused.The beef complete balanced dog food is called TITAN RED and has worked very well for dogs that seem to display the symptoms of a poultry allergy in the dog.Ross-Wells’ desired response to the Revdex.com filed claim from Jennifer Balkovek is for it to just be dismissed and not be published or available to the public since even a refuted complaint is still a wound and can lead to an unearned scar or possible bad decision that is not fact based.  The desired refund was sent even prior to any notification from the Revdex.com.I can provide more facts and other names of people indicating their statements to me, but it is my desire to not drag other people into this mess unless I must to keep my and my company’s reputation.Thanks for your time reading all my detail.Robert L.
