To Whom It May Concern;
Ms*** *** did purchase a Hyundai Sonata from us on 08/19/for $26,This was higher than the actual retail value of this car at that timeWe did this in order to absorb the negative equity that Ms*** had on her trade in of a *** CivicWe
allowed her $20,in trade in allowance for this vehicleThis was much higher than the trade in value of her carHer payoff was $20,on the CivicWe were not the selling dealer when she purchased her Civic
Ms*** contacted us few days later and said she wanted to trade the vehicle in and she was not happy with itIn New Mexico there is not a "Cooling off Period" so once you sign a contract for a vehicle you own that vehicleWe advised her we would do everything possible to help her out of the Sonata and into another vehicle
On 08/27/Ms*** returned to our dealership to trade her Sonata for a Hyundai ElantraA vehicle two years newer then her Civic and her SonataUnfortunately, the negative equity that Ms*** rolled into the Sonata loan from the Civic loan had to go forward and on her new loan for the Elantra
Ms*** is failing to disclose she had negative equity (appx $5,to $6,000) going into her first vehicle purchase with usOn the second vehicle purchase from us, the negative equity was simply moved to her new and final loan with us
Roswell Hyundai does not owe Ms*** $5,that she is requesting because she had at least this much negative equity on a *** Civic she brought to us for her trade in
Respectfully submitted,

To whom it may concern,
[redacted] visited our off site tent sale in Ruidoso Downs on Monday, July 27, 2015. At that time she filled out a Registration Survey. She provided us with her Social Security Number, Date of Birth, Employment Information, Monthly Income, Housing...

Information, ect, ect.
At the bottom of the Registration Survey it asks for the “Applicants Signature” above the signature line is the following statement, “I hereby authorize dealer to obtain credit information to expedite my purchase and to see if I qualify for SPECIAL INCENTIVE PROGRAMS”. [redacted] clearly signed this document. I have attached a copy of it for review.
In the automotive business we do not make “soft” credit inquires. My employee’s do not advise prospective clients that we are making a “soft” or “hard” inquires on their credit. It is simply a credit inquiry.
When I returned [redacted]’s call yesterday and heard her concern, I tried to offer her a resolution. She would not listen to me and simply demanded we remove the inquiry. We cannot just “remove” and inquiry. She filled out the registration, signed it and had intent to buy a car. The only reason she did not purchase from us is she is too upside down on her car vehicle loan. When [redacted] finally allowed me to speak, I told her that her best option would be to dispute the inquiry with her credit monitoring service if she does not want the inquiry on her credit bureau.
Unfortunately, Roswell Hyundai is unable to remove a credit inquiry when the prospective client authorized the credit inquiry and had intent to purchase.
Respectfully,
Mike H[redacted]
