We are in receipt of the complaint you filed with the Revdex.com on May 27, regarding a service charge you were assessed According to our records, your account was opened in December at our Hwy Banking Center when it was a branch of State Bank. In 2007,
Prosperity Bank acquired all branches of State Bank and on April 12, 2007, we mailed you a letter and a disclosure spelling out the terms and conditions of your account effective May 18, A copy of the letter and disclosure is included with this response for your review. In the disclosure, we indicated that there would be an account maintenance charge of $during any month in which the minimum balance in the account was less than $ During the month of March, your minimum balance was $and during the month of April, the minimum was $253.35. Both months were assessed the disclosed $maintenance fee. On May 2nd, in a good faith gesture, we refunded one of the charges meeting you half way and would have been happy to convert your account to a product with either a lower or no minimum balance requirement. You opted to close the account instead, which of course is well within your right We do apologize for any inconvenience and would be happy to discuss account options with you should your banking needs change

I am rejecting this response because:was a long time ago and I have no recollection of the disclosure they say they sent me. I received a list of fees late last year that was to be effective 1-1-17, which I have scanned and attached. There are a lot of fees on there but I didn't see a minimum balance fee

Good morning.As for the first part of the complaint pertaining to the fraud department contacting Ms*** husband and giving him information about her account, we don’t have anything to do with that and I don’t have any idea who the individual was that did this. I agree that this
should never have happened. My CSR, *** ***, spoke with Ms*** on several occasions but never spoke to her husband. My CSR was working closely with our debit card fraud department to try to take care of Ms*** needs. The dispute was filed on 1/18/2018. The fraud department requested a police report for the larger transactions. However, Ms*** told Josh that she had outstanding tickets and the police department wouldn’t give her a police report until her tickets were paid. She stated that she didn’t have the money to pay her tickets and Josh informed her at that time that there was a time frame for these type of disputes to be honored. The police report was never provided and the dispute was denied on 1/29/2018. I was not aware that Mc*** had obtained the requested police report. We just confirmed with the fraud department that if Ms*** will present the requested police report they will reopen the case. We are contacting Ms*** to inform her of such. I hope this is helpful. I am rejecting this response because:2007 was a long time ago, and I have no recollection of the disclosure they say they sent me. I don't feel that I was properly notified of this fee that they started charging me.  It does no good to send you the disclosure after they start charging the fee.
