car was sold AS IS per State of MN guidelines. Even if I gave her the State of MN used auto 30 days or 1000 miles powertrain warranty that I am required to do for vehicles less than 7 model years and under 70,000 miles, she did not complain until at least 6 months after she bought the car. This vehicle did belong to my brother and he had purchased the vehicle from the original owner. The original owner had to have a used engine installed because of mechanical failure to the original engine. The used engine was installed by a Nissan Mechanic prior to my brother taking ownership and he was told that the motor had less miles than the miles on the vehicle at the time I did not find out about this until she had owned the vehicle over 6 months and her mechanic discovered that that was not the original engine. It was never an issue.
As far as the possible accident, car panels or body parts get repainted for many reasons, a scratch, dents, eggs (nasty to car paint), that a customer may choose to have done without involving an insurance company. Many dealers including all the franchise dealers have body panels touched up to make the vehicle more attractive to the potential buyer. Most of the larger dealers have their own body repair shops on site. So unless the owner made an insurance claim, there really is no way to know why something was repainted or repaired or replaced.
I did not have any concerns as my brother had driven the car for 9 months, or so, without any problems. Putting a used motor into a car does not change the value of that vehicle nor does the State of MN require any notation or disclosure concerning the repair. I could understand her argument if this was a Classic, Antique of Exotic car, where as a greater value could be placed on the car if the vehicle had all original parts, but it is not. A 99,000 mile car or any car, for the sake of argument, WILL break down eventually, without notice as they are machines with moving and working parts. We did not mis-lead the buyer in any way and feel this complaint is unfortunate but baseless. Any questions please give me a call.

I asked out right if It was the original motor and they knew my concerns when I called them after only 2 months of owning the car it had major problems.. They said at that time they did not know the engine had been replaced!! They even talked to my boyfiriend Tom and told them the same thing. They are lying to cover their mistake. I called them several times and Gary told me he would check into it. I have payed well over 3500 in car repairs since I purchase the car less then 2 years ago and I told them up frony before I signed that I wanted an car that would not require expensive repair and was reassured that because this was the ownwers sons car it was in grerat condition. That is the truth!! The passanger car door handle had been damage and was not reveiled to me it does not close now and the truck latch also releases when ever it wants. Being the sons car I am sure they knew of all theses problems before selling . Lemon sellers!!!! I make little money and needed a good car that would not cost me tons of money or have as many problems as this car has I told them up front and the told me that this car was a good clean car, when in fact they lied about the motor being original and did not reveal this very important fact and it had been shaddley repaired with wrong gaskets and sells to con seal all the problems. They promise that all cars are looked at and inspected prior to sale so when I ask if it was the original motor etc they said yes. And yes it does make a difference in the car value if the motor has been replaced. Not stupid !!!They are fraudulent in their dealings.
