On April 28th, a complaint was lodged with the Revdex.com by a member of 9Round Catskill who had signed a contract for a month membership which was significantly discounted due to her paying in full for her membershipThe Consumer had come in for a Free first time workout and apparently enjoyed the workout that is why she became a "member" and paid in full for month membershipThe Consumer states that she has never gone and worked out at the facility which is true The Consumer stated that she did call the gym and after a review of the schedule it is believed that she spoke to an employee who is no longer with the facilityAfter interviewing the rest of the staff and the gym manager, all of the employees state that they never got a call from the consumer stating any of these issues in the complaintEven the employee who signed the consumer up for the pay in full membership stated that he didn't receive a call from the consumerI personally have been working in the gym and haven't received a call from her or any voice messages on the machineMy wife and I are more than accessible inside and out of the Gym and knowing that, when a call comes in for either her or I it is usually followed up with a text message from the employee working in the gym or at the very least a hand written note it left for the manager stating the reason for needing to get in touch with the ownerWe have mediated membership issues before between the manager and members and have not had any issuesThere are several ways to contact usEnd result of this complaint is that because she purchased something regardless of whether it is a gym membership or other product, the fact that she didn't Use it doesn't warrant a refundCase in point for example: If [redacted] purchases a car from the local car dealership and doesn't drive it for six months does that warrant him to return the car and expect a refund? I am more than fair in the way I run my business and this isn't the first business I have ownedYou will see from the attached membership agreement that the consumer signed and received a copy of via an email address chosen by the consumer On February 19th , The Consumer purchased the month pay in full membership is non transferable to other gyms and non refundableThe refund request according to the official complaint filed with the Revdex.com has also been outside of the rescission period as wellThe Consumer also had the opportunity to get immediate service by coming into the gym to speak with one of the employees which most likely would have been the manager requesting to see the ownersI look forward to hearing back from you on this matter [redacted] and getting your take on itFeel free to call me to discuss the matter at your leisure if you feel inclined to do soThanks in advance for you attention to this matterPlease also be advised that a hard copy of this letter has been sent to the above addressBrian Kozloski Owner 9Round Catskill
