If UPS failed to label item properly, Re: Handle with care and or Fragile, who should be responsible for replacement ? On June *, 2011 I went to the UPS store # [redacted] to ship an LG 42 inch smart television to my son who was in college in Texas. The store was very busy. I did not have the original packaging, nor do I have the receipt. When my turn eventually came, the clerk who was assisting me left me for a while to check if he had a box to fit a television of that size. He returned and claimed he didn't have a box, but would make one. He gave me a cost for preparing and packaging the television and shipping it to my son. The total cost for repackaging and shipping the television was $129.77. (See copy of bank record attached.) I was not offered shipping insurance and I didn't remember to inquire about it. The clerk asked how was I paying, and I gave him my debit card. I asked him if there was anything else I have to do, and he replied: No that is all. I would take care of it. The television was packaged by UPS and shipped by them to my son. When my son received the package, there was no labeling stating 1) Fragile, or 2) Handle with care. (See photos attached). UPS failed to apply due care and diligence in labeling the package for delivery. When my son opened the packaging and the television was damaged. (See photos attached). UPS was immediately contacted. It was delivered on 6/**/2014 and UPS picked it up on 6/**/2014 to investigate the damage claim. They verified that it was damaged whilst in their custody, and asked the cost of the item. Since I did not have a bill, they stated that they would accept verification of the cost, if a like and similar television can be referenced with the cost. This was done via the internet services and the price of a like and similar television was given to them with the advertisement. The television cost $899.99. Following this several calls were made to UPS store and conversation made with the [redacted] , who claimed that she had to also get a comparison on line, and submit, and is now awaiting final payment. I had to leave the country due to bereavement. Upon my return I saw an envelope from the UPS store. In it was a check for $170.00. After several calls to the [redacted], I eventually spoke to her and inquired about the check enclosed with no explanation. She informed me that since the item did not have insurance, she was paying the first $100.00 and part of the shipping and packaging cost. Thus the check for $170.00 is full payment. This is dishonest. UPS received an item without damage, did not offer insurance, packaged the item themselves, and failed to write on the packaging Handle with care or Fragile. (See photos attached). As such they should be liable for the replacing the item, that they have collected and verified to have been damaged by them. It is reasonable to expect that a shipping company of that statute would at least have Handle with care or Fragile placed on the packaging. The extent of the damage is reflective of an item being thrown without due care and diligence. The outcome sought is replacement of the television of reimbursement of the cost.
