Customer has filed a complaint alleging the vehicle was sold with an inoperable transmission.Vehicle was sold on eBay and all paperwork signed and Miles at the time of the saleCustomers are welcome to personally check and drive any of our vehicles before final sale, however do to the fact that
this vehicle was sold on eBay customer haven't made any arrangements for the vehicle to be checked or driven prior being sold and transported to final-destination(*** *** ** Omaha NE ***).Vehicle was driven and uploaded to a (Nine) car carrier in front of our dealership without any hesitation or difficulties, and did not present any signs of transmission problems or any other issue at the timeVehicle was loaded on the back of the (Nine) car carrier and may or may not have been unloaded and uploaded multiple times, allowing other vehicles to be picked up and dropped off along the way before reaching final destinationWe are confident that the vehicle left our premises in good condition and presented no issues, we cannot be responsible for what may have happened to the vehicle after leaving the Dealership.If the car have Bad Transmission problem will not drive and go to the top level of the towing trailer as of levle degree angleNevertheless, it is important to mention if the car had any major problem or issues prior to departure our Dealership, the car carrier driver would have noted in the Bill of Lading (invoice) and would have gotten a signature from the seller, a very procedure in the transportation industry.The car carrier driver mentioned, he had to unload the vehicle (*** ***) in-ordupload other vehicles, also mentioned the need to jump start the car multiple times, again we cannot confirm but it may have happened that jump starting the car may have caused some type of damage to the clutchIt's very difficult to have a clear understanding of how a Manual speed vehicle with only 61,miles have left the dealership in a drivable condition then reaching final-destination and wouldn't start and apparently showed an inoperable transmission.Customer have mentioned jump starting the car and having to drive the vehicle to his home without being able to use clutch pedal, saying none of the gears would engageI wonder why customer did not call for a tow truck instead of risking to drive the vehicle that apparently as they are describing showed transmission problemWe have not received any proof or statement that the vehicle has been checked by an authorized mechanic shop or *** Dealership.All documents and paperwork shows vehicle being sold "As Is" and we do have in our possession a video showing the vehicle being driven and loaded to the back of the carrier it's our best interest to clarify any misunderstanding between the Dealership and the customer however it's difficult to confirm and understand what may have happened to the vehicle after leaving the dealership as the car was no longer in our possession.As the customer have been received all paperwork after they purchased the vehicle and signed all the required papers, before they pay the balance, they did mention a few point on the paperwork as notes, and they have the ASC powertrain extended warranty explanse the coverage.However, we are willing to go above and beyond and will accept the return of the car as long as they customer pay the cost of shipping return from Nebraska to the dealership location *** *** *** laurel md ***and the refund will be the Ebay purchase only.Thank youRegards,Dimitri Z***

I am rejecting this response because:
Let me list the facts.  The seller stated in his email responses he posted that everything worked and said the transmission shifted perfect and the car was from Arizona.   
At no time was the car registered in Arizona, the car is not a limited edition as the seller advertised.
The following items were found to be defective on arrival, these are the facts.  Based on the seller saying its a good car and everything is working, I assumed the below items would be working.
Dead Battery would not hold a charge, replacement needed
Ballding Tires, tires needed replacement
Broken Odometer, needed replacement
Broken Radio Speakers, replacment needed
Transmission required service to operate properly
Coolant level was nearly empty, service needed
Serpentine belt and tensioner needed immediate replacement, replacement needed
Dash lights out on 1 side, replacement needed
Headlights barely visible, replacement needed.
Broken Visor Clips, not even present, replacement needed
Rear Brakes and Pads, replacement needed
Wiper blade motor malfunctions
Engine Thermostat malfunction, replacment needed

Dear Sir/MadamThis letter is in response to your inquiry for the letter we received on 12/11/2014. We offered the customer the opportunities to not only test the cars,But to take the vehicles to their mechanics and to thoroughly check them out. We do not under any Conditions knowinglyHide any facts, issues, or defects in any of our Vehicles. Customers to come back. We had several communication with this customer **. We offered him to have his own mechanic check the car out,  but he answer my email by this (I just spoke with the inspection people...they are useless.  All they do is take a short drive and tell me the car looks good cosmetically or not.  I can see in the pics the car looks good so $180 for a test drive seems silly.  Is it possible just to send me some pics of the engine compartment and perhaps do a face time to see it running.  My fact time email is:  [redacted]com  My biggest concern was the tranny....as you said, it shifts smoothly up and down  )Thanks.
 
 We also indicated as he well knows that the car is21 years old and that it will have some issues, as all 20+ year old cars do. We sold the car as is with no warranty, and provided all the information and pictures possible regarding this. We do have several emails and documents to back this BY MVA DOCUMENT  Stated fact, and been send to you by email to show that.As the new customer concerns regarding the case about the car from Arizona I said was driven from Arizona as a last trip not  saying from Arizona or been having a title of Arizona then, in the emails been sent between me and him that’s before he send his money he asked me about the history of the car and I was clear with him about all and he did run the car fax and I did sent him the auto  check history  and he sow. that the car been involving in 2 accident  with clean title and again he agreed on everything and he agree on everything before sending the money And by the low he did sign a waiver  of Exclusive or Modification of Implied WarrantyCS-019 (10-12)Important Notice To BuyerUnder Maryland law, consumers are entitled to an implied warranty, which means that the dealer may be responsible for makingrepairs to defective vehicle equipment that presently exists or may occur in the future. And again as I explained  to him in the emails , its a 21 years old vichel need some stuff to be done to it and as he is an out of state custome there is no inspaction requaerd and the customer responsible to do his  state inspection.And about all what he is talking about the coolant level or tires or belt or head light ......They are cosmetics and I am not  responsible for any of thatAnd as me an owner of business I would like to clear that again the car sold as / is with his acknowledge and he signed on it And I would like to send him $300.00 to close everything  . SincerelyROUTE 1 MOTORS INC MITRI Z[redacted] CELL : ###-###-####FAX   : ###-###-####THANK YOU

Review: After many emails asking the condition of the vehicle I was assured it was in fine condition with only 1 minor issue with the rear window. The car was also advertised as a limited edition coming from Arizona. Neither of which were true as the [redacted] the seller had on file indicated both were incorrect statements. Upon receiving the vehicle the following items were discovered and previously not disclosed. This has turned into a typical poor "used car deal" that good working folks should not have to go though. My accepted offer was based on the answers given originally by the seller and it is unfair not being told the truth up front.

Dead battery: Seller claims new battery was put in and died sitting for two months. Completely untrue, battery was not new nor did it hold a charge after being tested by a repair shop. A new battery if needing a jump will hold a charge, this battery did not. A new battery had to be purchased: $ 165.00

Odometer in the vehicle: Dead on Arrival, does not work....cost of repairs $335

Both Sun visors are broken $50.00

1/2 the dash lights not working

1/2 of the car speakers dead

Rear brakes and rotors badly worn: Cost of repair $300

Outside temperature gauge: DOA

No engine coolant, thermostat DOA.

Wiper motor: not functioning properly: cost of repair $200

Tires need replacment,rears are balding, easy thing for the seller to admit.Desired Settlement: A partial refund towards the repairs is a fair solution. I am not asking for everything to be repaired and would accept $350.00 towards all the repairs needed that were not disclosed. I think that fair considering the car was mis-advertised as well.

It is not a limited edition.
