Review: On 3/27/14, I parked my 2010 Black [redacted] in the shared private parking lot between [redacted] High School and the local welfare office. I parked my car in the fire lane near the exit to the school at 1:20PM and placed my blinkers on. I am the softball coach at the school and needed to finish loading the equipment into my car. When I came back out with my team 15 minutes later, my car was gone. I acknowledge that my car was parked in the fire lane, but it was in a private parking lot and according to the law, a phone call must be placed to the towing company to tow the car, which did not happen. This is a normal practice done by the employees of the school, and the building manager or building security notify the security director of the school: [redacted], if they need a car moved. They will call and ask if the car belongs to a employee of the school, and if it does not, then they will call the tow company to have it removed. The sign posted it from [redacted]'s Towing Company located at 5050 Umbria Street.

I notified the security director: **. [redacted], who walked next door to the welfare office and asked them if they knew what happened, because the procedure is for the security from the welfare office building to notify him if a car needs to be moved. They said that the towing company who services the lot came through the lot and took my car without permission and called after to say that they just towed a black [redacted]. No one from the school or welfare office was present when the car was towed and no one from either building called to authorize the tow. According to the laws that I have read, the owner of the property must be present and make a call in order for a car to be towed, therefore [redacted]'s Towing located at 5050 Umbria towed my car illegally without authorization. Both **. [redacted] at the school and the welfare office called [redacted]'s towing and asked them to return the car, and they refused. The towing company was not able to provide a name of a person who called for the tow, but continued to claim that a call was made. They offered to cut the fine to $100 instead of $200. The company claims that they received a call to tow my car, but the receipt says that the car was towed at 1:25 PM, 5 minutes after I parked it. There would not be enough time for the towing company to come all the way to the parking lot at [redacted] in 5 minutes. Security from both buildings deny that they placed the call, and [redacted]'s Towing continued to refuse to return the car. I called the towing company before going to pick up my car to ask if I could use a credit card, and they said the only payment option was cash, which according to Vehicle Code 22658 Section (k)(1) is illegal.

When I went to pick up my car, the blinkers were still on and the battery was dead. The office only took cash, no credit, which according to laws I have read is also illegal. The cashier was not able to provide me with any pictures of my car that they took showing it was parked illegally, or pictures showing the condition of my car before it was towed. The battery was dead and the front bumper is damaged from the tow. I left my phone number and address requesting the pictures of my car.

I called the following day, 3/28/14, at 1:30 PM to again ask for the pictures of my car. I was told that they would be texted to me within a half hour, and have yet to receive them. The company continues to lie and say they received a call from the security staff to tow my car. My blinkers were on, which obviously meant I would only be a few minutes, and no phone call was made to the company requesting a tow. Therefore I would like a full refund of the $100 I was charged for the tow as well as the pictures that I have requested of the condition of my car before the tow. On the receipt, my license plate number isn't written correctly, and the address that my license, car registration, and insurance are all registered under is not listed. There is no signature from any employee or owner of the building permitting the towing of my car from the private lot and there is no signature by myself or an employee from Roxborough/[redacted]'s Towing to verify that there was no damage done to the car upon the tow. If I do not receive a full refund, I will take [redacted]'s Towing to small claim's court to sue for the unauthorized tow of my car as well as the damage done to the bumper and battery due to the tow.

I am rejecting this response because:

Again it is illegal to accept cash only. It is also illegal to tow the car without someone from the property signing for the car. My car is damaged from the tow and I still have yet to receive pictures. The next step will be to get a lawyer and sue for the damage done to my front bumper and dead battery from the tow, which I have documented with pictures. No one from the company signed the receipt that there was no damage done to my car and neither did I. The space was left blank. The company operates illegally. Since my tow I have seen the truck parked outside of the lot waiting for someone to park in the fire lane and the driver will immediately pull in and tow. As stated previously, no call was placed for the tow and I can provide written statements from multiple sources verifying this information, if the tow company cannot provide proof that there was a call, they need to issue a refund. Also if they cannot provide proof that an employee or owner of the property was present to sign for the tow, then the tow was illegal because according to the law it is illegal to tow from private property without the owner of the property being present. I'm not sure how toe company is even able to argue against this when I I provided the law codes for Pennsylvania in my original complaint. The parking lot is private property and allows employees to park temporarily in the fire lanes.

POLICE CAME LOOKED UP THE CAR TAGS AN SAID IT WAS TOWED AWAY BY ROXBOROUGH TOWING/ [redacted]'`S TOWING THEY TOOK THE CAR. THE CAR IS PERMITTED TO THAT APARTMENT HOUSING THEY CAME IN HOOKED UP TOOK CAR AWAY WHEN THEY SHOULD HAVE NOT .Desired Settlement: HAD TO PAY $200.00 TO GET THE THE CAR OUT
