Initial Business Response /* (1000, 9, 2015/08/24) */
In response to the complaint #XXXXXX:

After much investigating on the deposit of $500.00, I find no evidence this amount of deposit was ever paid. When Mr. [redacted] signed the lease he signed with [redacted] Realty, who was the property manager...

at that time, those records were handed over to me when I became the property manager on the property and I see he paid a 350.00 deposit. But that deposit will not be returned due to the fact that we had to clean the apartment, i.e.; sweep the floors, shampoo the carpet, and remove the pet odors. The cook stove still had dishes in the bottom when we cleaned the oven, etc.

A 30 day notice was not given. And he lived in the apartment a few days without paying rent.

After speaking to the maintenance man on the matters of repairs he told me he went at least 3 or 4 times to fix something and could not find anything wrong with what the tenant was complaining about. He is willing to make a written statement if needed.

On the matter of roaches, it was my observation that the tenants with animals in their apartments were the apartments that appeared to have the roach problem. We have sprayed almost every 3 months, according to the weather, as we spray the exterior as well as the interior.

Mr. [redacted] left his apartment keys as well as the mailbox key on top of the hood of my car when he left. If another tenant had not told me the keys were there, I would have not known he left them there.

I am sorry he feels his experience was not a good one.

(Revdex.com Comment)- attached copy of Residential Lease Form showing: (3. Security Deposit: Tenant shall deposit with Landlord the sum of $500 to be held by Landlord for the term of this Lease and as a guarantee of the performance by Tenant of the agreements herein contained. Landlord is authorized to expend such sum as may be necessary to cure defaults by Tenant or to repair damage done by Tenant. The remaining deposit shall be returned to Tenant within 30 days. In the event the damage deposit is not sufficient, then Tenant agrees to pay such additional amount upon notification of the amount. This deposit is not to be construed as a payment of any rent due.
Final Business Response /* (4000, 18, 2015/09/14) */
I have spoke with the former property manager that took the deposit for Mr. [redacted] and leased the property to him. It is my understanding that $350.00 was for the property deposit and would be returned if the property was left in the condition it was leased in, and a 30 day notice was given. $150.00 was for the pet deposit which was a non refundable deposit/fee, and she tells me Mr. [redacted] knew this at the time he leased the property. She is willing to make a written statement, if needed.
