Good Afternoon ***Here is RPM Central valley formal response to Mr [redacted] Revdex.com complaint.We do not feel that Mr [redacted] is due any more then the dollar refund that he has received from RPM from his $security deposit that Mr [redacted] had with RPM we tried several times explaining to Mr [redacted] over the phone and he would not accept the answer would just start to get angry.I have attached the move in property condition report for your review showing the condition that Mr [redacted] received the property from RPM when he moved in on November of we have also attached the Move out property condition report when Mr [redacted] moved out unfortunately Mr [redacted] did not return as agreed as you will see in the photos and reports several items damaged and not cleaned as agreed per his signed rental agreement that Mr [redacted] had with RPM we have also attached for your review.We have also attached the detail security deposit deduction summary that shows detail by item what was charged against Mr [redacted] security deposit.The repair complaints that Mr [redacted] has also mentioned all were fixed resolved when in timely manner per each incident there are somethings RPM just can not control someone breaking into the US Mailbox Modesto Local PostMaster was contacted reviewed the mailbox breakin and several police reports were also taken just a very serious issue the Modesto is having with mail theftwe got keys to Mr [redacted] soon as we received them from the U.S Postal Postmaster here in Modesto RPM does not have any control over the time U.S Post Office takes to resolve keys and mailboxes.Regarding Mr [redacted] complaint on charging him for day notices that is standard with all tenants this is what Mr [redacted] agreed to when Mr [redacted] signed the attached RPM rental agreement also attached the rent roll, for your review showing that Mr [redacted] was late with his monthly rent in more then just occasion as he mentions in a month periodPlease let us know if you need anything else from us at this point we look forward in getting this complaint resolved

My wife and I have been renting from RPM Central Valley going on 2 years now and it has been a great experience. Making payments and maintenance requests via the portal is super easy. If you have a maintenance you usually hear from them within 24 hours which is great. I would definitely recommend them to anyone looking to rent in Central Valley.

Violation of Owner / Management agreement contract

1. Eviction protection: According the agreement we chose eviction protection plan. But when it did come for the actual eviction process, RPM mentioned that they had stopped the service.

2. Maintenance - proper approval process was not followed by RPM. There were situations where the tenant decided to handle major repair work without proper authorization by the owner.

Proper walk-through of the property was not done. For ex - alarm system in the house was damaged and this was not included in the report.

3. Periodic statements - We did not receive periodic statements on our property.

Tenant contract

1. Pets - We as owners had a no pet policy. The contract was in violation all through the tenancy as the tenants had a pet and the pet policy was not enforced

2. Maintenance -

Garage was self fixed - and the tenant took the garage door openers and keys to the houseDesired Settlement: Eviction proceedings - need refund of all the money spent on eviction

Pet policy violation - Need the extra deposit that was not collected for pet maintenance

Response:

In regards to the above complaint, RPM Central Valley has had open communications with the owner the entire management term. We do have supporting documents to back up each complaint.

1. Eviction Protection was no longer offered to any owner as of January 01, 2013. A letter dated 12/12/2012 was sent to all owners in our portfolio.

2. Lease Agreement clearly stated NO Pets. No Pet addendum was signed by all parties.

3. Maintenance issues: All maintenance was to be approve by this owner only. Owner denied all repair requests. Example, tenants pad out of pocket for a garage repair and remotes. Garage was not opening properly in the up or down position. Tenants deducted from rent. This was a safety issue that the owner did not address.

4. Periodic Statements are given with each owner draw on the 8th business day of each month. They are also in our system for owner to view at anytime. Owner knows his log in password. This was also sent ot owner as Going Green (paperless).

5. Garage remotes were taken by the tenants. Towards the end, owner decided to evict these tenants for non-payment of rent.

6. Rekey: When possession was restored to RPM, we rekeyed the home for safety. We have supporting emails.

7. Eviction: This was the choice by owner to evict. Tenants would not leave the home.

8. Owner was compensated $605.00 for 1/2 the eviction cost. Check #[redacted]

In closing, we here at RPM followed all company policies and procedures with respect to the management and rental agreement. Please note that owner was compensated.
