yes I contacted them 6/**/many times with no resolution and they said the airline denied the request.this is a airline issue and they should contact me directly to resolve this issue or work with the travel agent to resolve the issue. they are trying to point fingers no which wont be tolerated

I am rejecting this response because: The fact the motorcycle had an oil leak was not mentioned to me before purchase and because of this I believe the dealer has breached the warranty and should make the necessary repairs to fix the oil leak permanently and not just with a seal which would only be a temporary solution. I will pay the $25.00 dollar maximum that is required by law but not the amount that what was quoted to me for these repairs by the dealer.

Mr. [redacted] purchased a used motorcycle from our dealership that had been in our inventory for approximately 30 days. During that period of time, the motorcycle was ridden from the shop to the display area and back 5 days a week. At no time did our team notice any oil leak. Subsequent to his...

purchase, Mr. [redacted] returned the motorcycle to our dealership with a complaint of a small oil leak. We did an inspect & report telling Mr. [redacted] that the leak was from a permanent grommet on the wires that come from the stator and out through the engine side cover. The only way to replace that grommet is to purchase a complete new stator (which is perfectly functional) and replace. This is in fact a $900+ process and the only factory alternative to replace this rubber grommet. We indicated to Mr. [redacted] that this repair would be at his expense (less an offered discount) if he wanted to proceed. He indicated he did not and felt that the repair should be covered under warranty. The motorcycle was sold to Mr. [redacted], "AS IS - WITHOUT WARRANTY". However, the motorcycle is subject to the NM Motor Vehicle Quality Assurant Act which provides motor vehicle purchasers in NM with a 15 Day / 500 Mile warranty of merchantability. This is not an express warranty and has narrow limitations. This repair would not qualify as a void of this warranty. Included below is an excerpt of the state statute, including the mandated wording that appears on Mr. [redacted]'s contract. All that being said, we believe there is a simple potential solution to Mr. [redacted]'s oil leak. We believe that the grommet can be sealed with case sealant. This is not the "factory" solution and may or may not be a permanent alternative. We are willing to attempt this repair without cost to Mr. [redacted] as a one time gesture of goodwill. We have reached out to Mr. [redacted] to discuss this possible alternative but he has been unresponsive. 57-16A-3.1. Used motor vehicles. (2003)"New Mexico law requires that this vehicle will be fit for the ordinary purposes for which the vehicle is used for fifteen days or five hundred miles after delivery, whichever is earlier, except with regard to particular defects disclosed on the first page of this agreement. You (the consumer) will have to pay up to twenty-five dollars ($25.00) for each of the first two repairs if the warranty is violated."The inclusion of this statement … does not create an express warranty.    C.   An implied warranty of merchantability is met if a used motor vehicle functions substantially free of a defect that significantly limits the use of the used motor vehicle for the ordinary purpose of transportation on any public highway….

R&S Response:Over the 30+ years Team R&S has been serving the motorcycle community in Albuquerque, we have worked very hard to provide a level of customer service above our customer’s expectations. As a shop run by real people, occasionally there are issues that occur along the way. We have...

NEVER and will NEVER make any attempt to deceive or defraud any of our valuable customers. That being said, we are in agreement that there were some errors that occurred in the handling and completion of Mr. [redacted]’s damage repairs. There was definitely a break down in the communication between our Team, GEICO and Mr [redacted]. Because there were multiple (and different) people involved in the original estimate, supplemental estimate(s) and the repairs, there were some things that were done that we did not get paid for and a few items that unfortunately were overlooked in the process. When the issues were brought to our attention by Mr [redacted], we immediately went to work to make the situation right. The unrepaired parts were immediately ordered, Mr [redacted] was contacted and told everything would be made right, and we contacted GEICO to make sure they were in the conversation loop. As of today, we have completely reconciled the various parts of the paperwork with GEICO and all remaining parts have arrived and are available for installation (at no additional charge to Mr [redacted]). We have made several attempts to finalize this process with Mr [redacted] (including installing the parts, giving him the parts to install as he wishes or working with another shop to install the parts at our expense). We look forward to completing this process at Mr [redacted]’s convenience.
