taken to the builder who rejected it because it did not fall within any written guarantee or warranty he was give when he purchased the home. We cannot deal directly with this complainant unless directed by the builder. However, the driveway was inspected and found to have a few minor shrinkage/settlement cracks which are hair line and fall within ACI standards for concrete cracking. The driveway concrete strength is well beyond the design limits for PSI strength so there are no structural issues. His complaint is a cosmetic issue (and a severely minor one at that) and is in no way a valid warranty or guarantee issue. It is a subjective observation that has no engineering or professional backing and therefore has no validity as a complaint.

was never compromised and there is a safety face between his property and the new construction. The city of [redacted] has been out to the site and has confirmed that there are no code issues or dangerous conditions. All excavations have since been backfilled and graded to better than original conditions eliminating any POTENTIAL threat of collapse or compromise of the property in question.

There is no misrepresentation of the facts stated in my complaint. The cracks in my driveway along with the 5 inch gab between my driveway and the soil that had begun to tilt into the excavation is documented by photos & can be corroborated by city of [redacted] staff as well as my neighbor who is willing to sign a sworn affidavit. My property was compromised & the feeble attempt by the concrete contractor to cove it up by not only filling in the gap with dirt, but the cracks in the driveway are dishonest & fraudulent. The staff from the city of [redacted] said to me"you'll probably get a new driveway out of it." Also, when questioned why a stop work order had not been submitted I was told by the same individual "Is your car in the garage? I would move it out of there if I were you" (moving it down the driveway.
