also scammed
Went to a home show in Rhode Island and saw the Rubaroc kiosk, Long story short we paid appr.$10,000 doe the deck around our pool. We were satisfied with the job until little pieces of started flaking up. Turns out "dealer had no affiliation with Rubaroc.. He did after many phone calls to give us the solvent and epoxy for us the apply(he said his installer probably didnt use proper proportions.) here we are two years later and same thing happening only now he wont return our calls. Rubaroc wont help because he wasnt one of their dealers they said, All we need is the materials and we'll do it ourselves but they're only sold to contractors. So now what?

We purchased a Rubaroc Safety surface threw Full circle Landings in April of 2016 and the system was installed the week of June 20th 2016. During our meeting with the sales representative (*** we discussed the Rubaroc system with a Rubaroc 10 year warranty. We also were discussed drainage modifications to the decking prior to the surface being applied. When the installers showed up on the first day they did not know anything about the modifications that where discussed but they ensured us that it wouldn't be an issue so we let the installers complete the job as quoted. Around April 2019 we contacted Rubaroc requesting repairs on a portion of the decking that is coming up and left a voicemail to return our call. A couple months passed *** we noticed larger chunks coming loose around the pool surface. We called Rubaroc in Florida starting June 7, with 4 phone calls and no answer, On June 12th and 13th we tried again with 5 calls with no answer. On June 24th we called again and finally got a hold of April that stated she would have a manager call. After a week we called back and were asked to provide the original bill of sale and a picture of the product left behind for future repairs which we complied to and were told again a manager would be in contact. After no contact from said manager we tried contacting them again on July 11th with no response, we called their Canadian headquarters and they would have someone contact us from the Florida office. The following follow up call to Rubaroc we were told that the product installed by Full circle Landings was not a Rubaroc product and they were not liable for the repairs. On July 19, 2018 we received a letter from Rubaroc stating *** Landings was not and had never been an affiliate or representative of Rubaroc USA, INC. They were an independently owned and operated business that signed up to purchase surfacing materials only from Rubaroc USA, LLC., a Coppell Texas based rubber surfacing installation and material distribution company that at the time was affiliated with ourselves; Rubaroc USA, INC, a Delaware based company and the USA headquarters for Rubaroc. The following are links showing their affiliation between Rubaroc and Full circle landingshttps://marketersmedia.com/sarasota-pool-resurfacing-company-offers-safe... Landings, like any other independent contractor had a choice to buy their surfacing materials from wherever they choose, and although they had the ability to purchase genuine Rubaroc material it was discovered from calls from their unhappy customers with installation issues that they had been misrepresenting themselves by calling materials 'Rubaroc? when that was not the case. This was clear as they had not been purchasing Rubaroc materials to do the projects they were installing. We have a picture of the bag the materials came in and clearly it is a Rubaroc product. They also stated that they never been affiliated with Full circle landings when we have the proof not only the materials have the Rubaroc labeling but we also have a design that the template had to be ordered directly from Rubaroc Headquarters and is currently on display of their main web page. Their president *** States himself that Rubaroc is 'not being a franchise type business we operate only through our dealers, we want to ensure dealer success'. https://www***.com/franchise-for-sale/rubaroc-business-opportunity-dealer/(Start video at 1:55) At the time of the reported issues from their clients, we repeatedly attempted to contact*** Landings to ask them to take responsibility for the issues with their installations and find out why they had been calling materials Rubaroc when they were not purchasing Rubaroc material. The attempts to contact them were all uns

Desired Outcome

Other (requires explanation) RepairWe want Rubaroc to repair the faulty decking.

Rubaroc Response • Jul 24, 2019

As our letter that was mailed stated, our company did not sell any product to the contractor in question and the customer is not a client of ours. We understand the confusion caused by the contractor fraudulently using our branding, however as we have explained we did not sell any product to them and so cannot accept responsibility for something we had no involvement in. If we were in a position to pursue trademark infringement legal action towards the contractor, we would, however the principle of the company has passed away.

I submitted a deposit on a flooring install, that was not completed. I am requesting a refund on the money paid.
On September 26, 2017 I made a payment to Rubroc in the amount of 2590 as a deposit for a flooring installation in a home gym. After consulting with Alexis as well as the install manager- Jim Schwartz- at Rubaroc, I was advised to hold off on the flooring install until the rest of the work was completed.
I did so, and contacted Rubaroc in July 2018, requesting an installation. Alexis no longer worked there, and I spoke to Taylor Faunt. She assured me that Barry would call me to schedule an installation.
Barry never did call me. On August 1, I asked for color samples to be sent to me. I was told by Taylor that they would send, but I never received them. Taylor said she would remind Barry to call me.
August 13- Taylor said that Barry would call me.
August 15- I ask if everything is okay. I ask why no one is answering my calls or emails.
August 16- I receive the number for Tom- an installer. He and Barry are out of the country completing an install. They still can not schedule an install date. I ask if I should expect them to give any advance notice... Taylor asks for the square footage and other details of the project. All that information has been submitted and is recorded on invoices.

August 17-22, I communicate with Taylor via email. We discuss colors. She does not respond to my numerous requests to schedule an installation. Says that the guys have to finish current jobs before they can schedule anything. Won't give me a time frame either. I ask if it can be done by the end of August? End of September? I am getting increasingly confused. She says that they can't schedule a date because it may rain. My installation is indoors. Won't rain there.

August 29- Taylor says she will have a clearer idea within a few days regarding install dates. Hmm.

Through this, I have tried calling the office repeatedly. My calls and messages are unanswered. Frustration is mounting.
When I finally speak to Taylor, she informs me that the staff has changed and currently there are only two installers- one in TX and one in Canada. There are no local installers.
September 2- I email Taylor and the rest of the company an ultimatum, asking for an installation or a refund.
September 6- I email that I will contact Revdex.com.
September 7- Barry responds. Barry! Finally! He says they will issue a refund. I tell him that I am disappointed that it reached this point and would have been happy for them to install. Barry says there'll be some guys in my area the next week that will be happy to install. I agree to that.

September 9- October 9- Good-bye Barry. Good- bye Taylor. No one has responded to my emails or calls since September 7. No refunds has been issued and no install has been made. Please refund $2590.00

Desired Outcome

Please issue an immediate refund in the amount of $2590.00.

Rubaroc Response • Oct 25, 2018

We are very sorry for the inconvenience caused to the customer during this project. We are issuing a refund for the full amount paid and our office will notify the customer when they can expect to receive it.

Customer Response • Oct 28, 2018

(The consumer indicated he/she DID NOT accept the response from the business.)
Rubaroc has told me in the past that they would issue a refund for this job, which they never did. The company response indicates that they will reach out to me, and send an immediate refund. They have not contacted me to inform me of this, nor have I received a refund. When the refund is received, I will accept their response as satisfactory.
Thank you.
