Complaint[redacted] reubin is scaming people out of their money. He was given a $1000 an we didnt get the house so mr reubin ran off with our money. I have been trying to recover my money for 3 1/2 weeks now. An he is not answering the phones nor returning phone calls. Mr[redacted] Ruben of Ruben and Ruben Realtors made promises of selling and purchasing of a property. Mr.Ruben advised us to give him money per the bank Selling my property -[redacted] had authorization from me to communicate with my bank to sell my property as a short sale. Back in January 2014, the bank mailed me a letter to short sale the property. I complied with the letter. I faxed[redacted] everything they asked for, which included hardship letter, financial statement & authorization letter. I received 2 foreclosure letters in the mail. One in July 2014 - I asked[redacted] why are they trying to foreclose on my property if you have it on the market for sale and we have a buyer. I also asked if the contract was pending. His reply was that he put the house on the market for sale and it is contract pending.[redacted] told me to fax him the foreclosure letter and he will handle it from there. I would always ask[redacted] questions regarding my property throughout the year because he never kept me up on current events. I even asked if I can view the property online. He said that I couldn't see the property because only realtors that have access to[redacted] can view it. Days later, I received a letter in the mail from Bankruptcy Court needing me to fill out paperwork. I DID NOT give permission or sign any paperwork for[redacted] to file bankruptcy.[redacted] had all my personal information because he was supposed to be communicating with my bank. That is how[redacted] handled it. October 2014 - I received another foreclosure letter in the mail. This time I called the bank myself on November 4,2014. I spoke with Mr.[redacted] who sent me the letter back in January. I asked him why are you keep sending me foreclosure letters after I responded to your letter. I also told him that the property is on the market and contract pending. Mr. [redacted] informed me that the property was NOT on the market. I said that I was told by[redacted] that it was. I also asked Mr.[redacted] when was the last time you spoke to[redacted]. He replied he hadn't spoken to[redacted] about the short sale of my property since JUNE 2014!! That's why I was receiving those foreclose letters. I explained to Mr.[redacted] that I faxed in all required documents back in January and May of 2014.[redacted] called me back in May to say that he needs the information again (because he misplaced it). I informed Mr.[redacted] that I will be seeking another realtor as soon as possible. I did obtain another realtor, [redacted] of [redacted], who helped me. She was very patience and understanding. Before Ms.[redacted] got started on the process, she looked into[redacted] to see if my property was listed. It was not. Ms.[redacted] listed the property for short sale and gave me all the paperwork that was required for the listing agreement for me to sign. This was something that[redacted] did not do. I didn't even know that you had to sign a listing agreement with your realtor. Ms.[redacted] explained all of that to me. Also, gave her authorization to speak with Mr.[redacted] and everything that was needed to get in contact with him.My property foreclosed December 11, 2014. Even though I got another realtor, it was too late because short sales take, at least, up to six months of processing.[redacted] Ruben of Ruben and Ruben Realtors did NOTHING to help us. He lied to me over and over again about handling the short sale of my property. All he had to do was comply with the letter sent by the bank back in January 2014. He had PLENTY of time and opportunity to work out something with the bank. I was left with NO CHOICE but to move or live on the streets. I THANK GOD EVERY DAY FOR FINDING A HOME IN TIME.Desired SettlementMy husband and I just got married February 15, 2012. We were trying to buy a house. We were referred by our co-workers who bought a house through[redacted]. The loan was going to be in my husband's name since I was short selling my property. My husband was approved for a FHA Loan and begin the process of looking for a house.During the year 2013, we visited so many houses, put contracts on each house that had our interest, paid earnest money on each of them and went through so many banks ([redacted] Credit Union,[redacted] and[redacted]). Every time we put a contract on a house,[redacted] would always come tell us that the bank is asking for this amount of money. At first, the asking of money from[redacted] would start out as the sellers want more than the normal $500 earnest money. So we agreed and gave the sellers what they asked for. Next,[redacted] would say that we have to pay him closing costs and down payment toward the house per the bank.[redacted] advised us that he will be speaking to the bank on our behalf. If we have any questions about the loan, call him. We agreed to this as well. Lastly,[redacted] would then come back and say that the bank needs to see that you have 2 months of reserved mortgage. We only paid the reserved mortgage once. There was a couple of incidents were[redacted] would say that the bank has ran my husband's credit and found some creditors on his credit report that needs to be paid off. One creditor was [redacted] Insurance. He owe them $364. The second creditor was [redacted]. He owe them $988. There was another bill he had to pay but I can't recall who it was. My husband owe them $800.[redacted] advised us to give him the money and he will pay off the creditors, so on the credit report it will be ($0)zero balance. We agreed and gave him $2,152. Come to find out those bills were NEVER PAID.[redacted] called me one day to say that the bank had ran my husband's credit again. He was trying to find out who was [redacted]. I googled [redacted], got the number and gave it to my husband. My husband called and found out that the bill have not been paid.[redacted] apparently forgot that we had gave him the money to pay that bill off. So I took it upon myself to call [redacted] Insurance and found out that the bill still exists.[redacted] was asked about those bills. He replied that he paid them. My husband and I gave[redacted] a grand total of $20,001 for the purchase of a house we never received. This also spilled over into the current year,2014, with no purchase of a house and no more money was given.In conclusion, my husband and I had a terrible and super long process experience with trying to purchase a home. We trusted and believed what[redacted] was telling us was true. As you can see,[redacted] was handling 2 different things for us. None of which, there was no resolution. Even though I bought a house 5 years ago, we didn't know what to expect. We didn't have anyone to tell us otherwise. We have given[redacted] money to purchase a home but we ended up with the short end of the stick. Sometimes we referred back to our co-workers but they said he works slow. One time I even went to talk to the loan officer at [redacted] Credit Union,without[redacted] knowing, to find out what was taking so long. The loan officer wasn't at work. I left my husband's phone number to call. Once she returned to work, the loan officer called[redacted] about the visit.[redacted] was very upset that he wasn't notified first before I spoke with the loan officer. I thought that was unusual. Why would he be upset? With[redacted], the last bank, we had no contact with the loan officer. We were basically waiting for him to call us with news from the bank. We would call him if we didn't hear from him. We would have to call him several times before he answers. He excuses for not answering - he had to go to the dentist, doctor, class/meeting or get his car fixed. I know that trying to purchase a home may be difficult at times but not what we experienced. The reason Ms.[redacted]' house was forclosed in November is that she had not paid a payment on her house in over two years. She was gainfully employed for this entire period. Her employers for this period were [redacted] and [redacted] and the [redacted] Service. 2. Her complaint further omitted information pertinent to this matter.[redacted] was the first lender for her house. She was in arears with them when she first contacted me. The loan was subsequently transferred to the current lender and her arrearage continued without further payments. 3. Several key factors in this matter have been misrepresented in order to delay due process and blame others for her failure to meet her contractural obligations. The result was that she remained in the house for over two years without making a mortgage payment. In my opinion, this was a deliberate attempt to defraud[redacted].4. I actively marketed her short sale to my other clients. A binding contract was written with one of these clients to purchase the property. At this point it was not necessary to list the house in MLS.5. As far as the suggestion that I filed a bankruptcy for her without her knowledge is a vicious notorious lie. I filed the voluntary petition for Ms.[redacted] at her request to delay the forclosure. She was notified by the bankruptcy court when this was filed. I would not file a petition for anyone without their permission.6. I was referred to the[redacted] by a very satisfied previous client. At the time,[redacted]' credit was adequate to obtain a home under some lenders guidelines while Ms.[redacted] credit was not. I attempted to guide[redacted] in improving his credit score by suggesting certain actions. Discrepancies in[redacted] interviews with lenders resulted in his moving from one lender to another.7. I have always worked dilligently for my clients and that is the reason a former client referred the[redacted] to me. I had obtained preapproval from each lender mentioned in this complaint. Ms.[redacted] assertion that I misled them is not accurate. Ms.[redacted] suggests that the closing failure was due to my actions but nothing is further from the truth. While the pending investigation prevents me from disclosing details, the closings failed when[redacted] could not produce stipulated doccumentation for the lender. 8. I have supporting documentation that I can supply if needed. Unfortunately, my efforts to facilitate these transactions failed. Short sales exist for those with a hardship and the[redacted]' total income would not support their claim. It appears that Ms.[redacted] was attempting to manipulate the system to sell her home on a short sale without making her mortgage payments while having her husband buy a more expensive home in his name. The [redacted] rule for short sales would possibly present serious implications to Ms.[redacted].9. The reason that my house went into foreclosure because[redacted] Ruben did not complete his job as a real estate agent. Yes I am gainfully employed with two jobs NOW but at the time when I was behind in my mortgage payments I did not have the two jobs. As I explained in my hardship letter written to the bank faxed to[redacted] Ruben, I was off from work February 2011 until January 17, 2012 due to issues with my left foot which caused the delinquent of my account and other bills. By the time I got another job, it was too late to catch up on the missed payments. IF[redacted] Ruben did his job he would have saw the reason in the hardship letter.2. My complaint did not omit pertinent information. Yes[redacted] was the lender and the loan was transferred & yes I was in arrears when I first contacted[redacted] Ruben (that's beside the point) BUT he left out that the house was suppose to be sold as a short sale which he did not do.3.NO key factors has been misrepresented. Yes I remained on the property for two years without making mortgage payments. But as I have repeated several times that[redacted] Ruben was the REAL ESTATE AGENT for this property.[redacted] Ruben was hired two years ago to short sale the residence. He did nothing. I am not the blame for the property foreclosing when I tried to resolve missed payments issue with the bank by sending in all required documents they asked for back in January 2014. So how is that defrauding[redacted]?4.The listing of the property was one of the necessary requirements for the short sale. I received a letter requiring to list the property & authorization to speak with the listing agent along with check stubs and the hardship letter per the bank.[redacted] Ruben received all documents what he did with them is unknown. As far as the binding contract with one of his clients, it did not exist per the buyer and the new real estate agent.5. As I stated in my previous complaint, I DID NOT GIVE PERMISSION for[redacted] Ruben to file bankruptcy on my behalf. In my complaint,[redacted] Ruben told me several times that the house is contract pending and actively on the MLS. In[redacted] Ruben's response to my complaint, he said there was a binding contract. If this is true, then there is no need for me to ask him to file bankruptcy. He file bankruptcy after I received the first foreclose letter to stop it. If he did his job to short sale the property as he was hired to do, I would not have received any foreclose letters nor would he had to file. 6. Yes he was referred by a very satisfied previous client but my husband and I ARE NOT VERY SATISFIED CLIENTS with the work of[redacted] Ruben. He seems to forget for some reason I was not trying to purchase a home but my husband was. I was only trying to do a short sale. My credit score is not a factor. Yes he attempted to guide[redacted] in improving his credit score by taking money from us to pay off[redacted] creditors which NEVER happened.[redacted] had an interview with a loan officer at [redacted] Bank but as I stated in my previous complaint there were other lenders[redacted] did not interview with (Hope, [redacted] and [redacted]). How can there be any discrepancies in[redacted] interviews with lenders that resulted in moving from one lender to another without[redacted] ever interviewing with the other lenders??? 7.Mr. Ruben may have worked diligently with his other clients but became indifferent somewhere along the way with my husband and I. Yes he obtained a pre-approval letter from the lenders but that is far as the loan went. I don't understand why he seems to constantly mention his previous clients when he haven't satisfied us.[redacted] produced every document that was asked for by[redacted] Ruben to ensure the closure of the loan.8.[redacted] Ruben is not the only person that can supply supporting documentation, if needed, so can I. By the way, still waiting on him to supply the supporting documentation in regards to the $700 in services already rendered and $3,100 in charging brokerage fees to my husband and I for obtaining his services as a real estate agent with our signatures in an email that was sent to me from him. "Short sales exist for those with a hardship and The[redacted]'s total income would not support their claim".He is absolutely correct BUT[redacted] Ruben has once again forgotten that in the hardship letter he received I did not have the total income. He has also forgotten that I was not married at the time of the hardship nor does the short sale concern[redacted]. The loan was in my name.[redacted] and I married February 15, 2012. The loan was already behind.[redacted] Ruben was hired toward the end of 2012 to short sale the property and my husband was going to purchase a home in his name. I hate to be redundant but the truth is the truth. As far as the [redacted] rule is concern, it is unknown to me and how could it possibly present serious implications to me when I have tried on numerous numerous occasions to get this matter resolved with[redacted] Ruben. All he had to do was take the time out of his busy schedule to short sale my property and complete the requirements requested by the bank or current lender instead of doing nothing. Doing nothing is what caused some of these problems rather than taking money from clients that are trying to succeed in life. 9. Yes there is a written agreement between[redacted] Ruben and us concerning the monetary settlement BUT we haven't received it. In[redacted] Ruben's email dated November 13, 2014, my husband and I will receive our refund of $14,049 minus $3,100 if he provided the documents with signatures in twenty-one (21) calendar days. He did not. The twenty-one calendar days ended on December 4, 2014. Then I received an email on December 4, 2014 stating he has mailed the refund via [redacted] Service which we didn't received. Here it is January 20, 2015 and WE STILL HAVE NOT RECEIVED THE REFUND. If he was so concerned about how satisfied his previous clients were, then he would have taken the initiative to satisfy us by canceling the check, issued another one and call us to come by his office to pick up the refund in the amount of $20,001.Final Business Response

Cleo R[redacted] of R[redacted] and R[redacted] Realty allowed a home at [redacted] in Cordova, TN to get sold from under us and will not give us earnest money.Cleo R[redacted] of R[redacted] and R[redacted] Realty is extremely unprofessional and should not be in business. He was hired to assist us in locating a home in the Cordova area. He was more than an hour late to all of the showings. He never took the time to locate a home for us even though we described to him what we were looking for. We had to look for the homes ourselves and we had to contact him several times before we could even get a response back. Three contracts failed due to his unprofessional and untimely responses. The last straw was in Sept when we finally did place a contract on a home on 9/10/15. After that we paid for a home inspection,an appraisal and had given him earnest money . Apparently all of that was done for no reason because almost two months later we found out that the house had been sold due to Mr.R[redacted] not giving the listing agent our earnest money. He had never given us any indication that the home was pending a sale or even sold when it finally was. We had to find out through Realtor.com. After that we called and texted him numerous times asking for our earnest money back and he has not responded. My husband sent over a form requesting our money back within 48 hrs and we still havent gotten our money. He avoids our calls and text and when we finally do get in touch with him we have to contact him from another number just so he would answer. When he answers he quickly says I will call you right back but never does.Desired SettlementI am looking to get my $1000 earnest money back along with the appraisal fee of $425 because the appraisal was never done due to the contract being voided by the listing agent.

Cleo Ruben is scamming people out of their money, I have given this man a total of $3600 that he has not returned...I have petition in which I need only 10 more signatures to have this man arrested and charged with fraud...he is getting away with playing with people hard earned money and this needs to stop...i
