? I am rejecting this response because: e: Complaint # ? [redacted] , ? Yes I would certainly agree that there are not only several miss-statements; however there is NO miss-understandingsI do not consider myself to be a Stupid Woman ? I find it interesting that who ever calculated this did a very poor job The MSRP according to the document in my possession states the MSRP is $34.200.00, it also shows the added Technology Package as $4,and the Premium Package as $4,It also shows the following: Cargo Tray $100.00, iPod cable $35.00, Wheel Locks $ Also included is a fee for “Inland Freight & Handling” in the amount of $ All toll this is a total of $44,385.00! This is listed as the MSRP!! With Interest etcthis is about as close to $50,as you can get ? So apparently we have a rather large discrepancy If, as they state I was sold the car for $34, that is $more than the original MSRPIf, in fact there was as stated a $Factory Rebate, I never saw itSo apparently either the dealer got the Rebate, or it was subtracted from the amount of the car which would make it $31, Even if they added the following: $4,300.00, $4,800.00, $100.00, $35.00, and $this would total $40, I did not include the Freight & Handling, as I do not feel this would be my responsibility! I also wrote a check in the amount of $25, which would leave a balance of $15,to be financed ? Since, they claim that this vehicle was being driven by someone else I should NOT be responsible for the $4,300.00, $100.00, $35.00, or the $which equals $4, ? This vehicle was financed through Wells Fargo @1.9% APR for a total of $20,which leaves us with a discrepancy of $13,926.28, and adding the above amount of $4, equals $ 18,Which is OWED to ME!!! along with the Interest that I have had to pay ? Up on the advise of the Finance MgrI did opt for the “Diamond Package” mainly because he assured me that not only did I have road side service, but it also took care of any and ALL repairs other than the standard Tires, Breaks, and Oil ChangesIf, there are any doubts there were witness with me who will testify in Court to his statements The Finance Manager, advised, that even though the vehicle had a yrOr 100,mile Warranty Bumper to Bumper that the “Diamond Package” would ensure that all other issues would be taken care of ? Now to my visit of 2/9/18, what would you think if a Service Writer told you that you needed (4) tires and the Alignment and that the tires were “A Special Order” I am sure you would inquire as to the priceWhen he told you that they were $1,for each tire, and the Alignment would be extra what would be your response? I took my car to Good Year and asked them to give me a quote for (4) of the best tires they had and asked them to include the fee for alignmentThe manager went out checked the tires size and quoted me $1,and it included the alignment ? Of course the Battery was a “Special Battery” which cost $I can go anywhere Auto Zone, Riley's, Napa, even Walmart and find the same Battery for $This is clearly a case of price gouging ? When I took the car there on 2/9/18, they did not bother to tell you that after waiting 41/hours, I was driving home and the car began to make a strange noiseI called on my way home and asked “What the hell did you do to my car?” they asked why, I told them it was making a strange noise that it did not make before I took it inThey told me to come backBy now I am almost home and said, NO! I took the car back on Monday, and according to Kris Canfield,”We are Slammed today, can you bring it back tomorrow?” I brought the car back on TuesdayNow just because I am Retired now does not mean my time is not worth anythingAll toll I spent almost hours driving back and forth only to find out that the stupid Tech had included a “LEAF” when he changed the air filter Just so we are clear when I was working I made $an hour! ? Now to the Engine Restoration: Ever since I have owned this car Black Carbon has come out of the Tail Pipes, It looks nasty and I have asked everyone Why it does thisNo one seems to have an answer I get “don't worry it is just Condensation” or “I don't know” I have asked and asked what an “Engine Restoration” and once again NO ONE KNOWS! ? I have recorded conversations with [redacted] the current Sales Manager, along with witness at the time of the contract signing I am making request to the Bureau of Automotive Repair, and will asked them to schedule an appointment with a Referee to see if the vehicle will pass Smog and find out what indeed an “Engine Restoration” entailsIn the event that there is a serious issue I will file a complaint for the Lemon Law under the Stat of California ? As you may have already guessed I too am respectfully declining the statements made by Hyundai Inland Empire ? Cordially ? [redacted] ? ? ?

[redacted] , I’m in receipt of the follletter our client wrote to my response (complaint ID#12809395) Thank you for your assistance in trying to resolve these issues, I certainly do not like having issues with clientsUnfortunately I do not see where our business has done anything outside our business that would lead this client to the point she feels she is entitled to a full refundNone of her statements have been fully accurate nor do they match the document trail she herself has copies ofI welcome your feedback if you see any different or understand how I can resolve this matter with the client in a meaningful and fair way If you can acquire written authorization from the client authorizing me to share copies of the sales contact and MSRP, I’d be happy to share them with you so you can review with the client, or [redacted] could share them with you directly, in either case I think it would be clear to you that there were no mis-statements about price in my first response [redacted] is looking purely at base MSRP, she did not purchase a base model, she purchased a vehicle with added packages and factory optionsAs for inland freight, that is part of every manufacturers MSRP, not just Hyundai’sI do not calculate the MSRP nor do I print them, those are calculated and printed from the manufacturer and associated with the base vehicle, options and freight which also determine the final cost top the dealer I reviewed the purchase contract again, and the $2,rebate is clearly stated and calculated on line 6e per California law In fact we did not have the tires in stock (so yes, we would have to order them and any item we are out of stock on we “special order” to get the item delivered faster for a client as opposed to a stock order)There is a misunderstanding on price, we did not quote $1,per tire, the quote was for all tiresThe quote is precisely $1,for the tires plus $for mounting and balancing We do not sell tires for our brand that cost $1,per tire, nor have we ever charged any client $1,per tire As for battery, they infact are a bit more expensive on the Genesis as the car has so much modern electronics the load capacities are much higher and the battery much bigger than our typical Hyundai batteryWe realize there are off brand batteries that can be purchased at a lower cost, they may or may not have the required load capacities The client indicates that she asked and no know one knows what an “Engine Restoration” isI clearly addressed this in my initial response (see below) The “Engine Restoration Required” is not written on the repair order, what is written is “Technician also recommends engine performance restoration service” Nothing indicating a “requirement”This is a fuel system cleaning To my knowledge I’m not aware that the client took this vehicle to any smog inspection station and that it failed, so I’m not aware of any need to make an appointment with a Referee Station, (typically a Referee Station gets involved when a vehicles has failed multiple smog inspections or an owner cannot afford to make the needed repairs to make a vehicle smog compliant)That being said, if a Referee Station has agreed to look at the vehicle under these circumstances, I welcome it as it should help clarify the clients concerns If you have any feedback you would like to share with me, I would certainly appreciate it [redacted] General Manager

Re: Complaint# [redacted] , I’m in receipt of your letter regarding complaint from [redacted] (Referenced above and copy attached) Unfortunately, there are several mis-statements or mis-understandings on the clients complaint As for clients statement that her repair order for a “used Hyundai” I’m unaware of any line on our repair orders that define a vehicle as new or used, by definition any vehicle coming in for service is a used vehicleEven a new vehicle sold today by California law would be classified as a used vehicle as soon as it hit the streets, so any vehicle coming into our Service Department would have that classification, unless it was still unsold and in our inventory On the repair order, the inspecting technician had recommended new tires due to age of tires as they where showing cracks(Client declined) Client did not pay $50,plus for the vehicle, Sale price of the vehicle was $34,with an additional savings of $2,in factory rebateThe vehicles MSRP was $44, Client purchased a “Un-registered Factory Executive Vehicle” on 12/14/The vehicle had 6,miles on it at time of purchase and as disclosed on contract and all DMV paperworkThe vehicle was sold on a Used Vehicle Retail Installment Sale Contract (RISC) as required by California lawAdditionally, client signed and initialed a “Vehicle Prior History Disclosure” form which additionally identified the vehicle as being a “Unregistered Factory Executive Vehicle” Thus the reason for the over $10,in savings from MSRP that the client benefited from by purchasing the Factory Demo with 6,miles on it The document that client is referencing is the MSRP on the vehicleAs previously stated the vehicle was “Un-registered Factory Executive Vehicle” in fact this was also noted on the MSRP which client is in possession of that this was “Demo for Kavita Patel” Based on the above and the fact that the vehicle had 6,miles on it at time of purchase, I cannot see where client was at any point under the impression that the vehicle had not been previously used The ’Smog Rating” that the client is referring to is the emissions label on the MSRP of the vehicle, it rates vehicles from 1-on emissions in comparison to all other new vehicles on the market at the timeA rating only suggested that the vehicle produces average emissions which for any luxury sedan is on parThis has nothing to do with wether a vehicle will pass emission testing in a future date The “Engine Restoration Required” is not written on the repair order, what is written is “Technician also recommends engine performance restoration service” Nothing indicating a “requirement”This is a fuel system cleaning I will respectfully decline the clients request for a refund of $50,for all the above reasons mentioned above

Re: Complaint# 12809395    [redacted],    I’m in receipt of your letter regarding complaint from [redacted] (Referenced above and copy attached).   Unfortunately, there are several mis-statements or mis-understandings on the clients complaint.   As for clients...

statement that her repair order for a “used 2013 Hyundai” I’m unaware of any line on our repair orders that define a vehicle as new or used, by definition any vehicle coming in for service is a used vehicle. Even a new vehicle sold today by California law would be classified as a used vehicle as soon as it hit the streets, so any vehicle coming into our Service Department would have that classification, unless it was still unsold and in our inventory.   On the repair order, the inspecting technician had recommended new tires due to age of tires as they where showing cracks. (Client declined).   Client did not pay $50,000 plus for the vehicle, Sale price of the vehicle was $34,300 with an additional savings of $2,500 in factory rebate. The vehicles MSRP was $44,520.   Client purchased a “Un-registered Factory Executive Vehicle” on 12/14/2013. The vehicle had 6,596 miles on it at time of purchase and as disclosed on contract and all DMV paperwork. The vehicle was sold on a Used Vehicle Retail Installment Sale Contract (RISC) as required by California law. Additionally, client signed and initialed a “Vehicle Prior History Disclosure” form which additionally identified the vehicle as being a “Unregistered Factory Executive Vehicle” Thus the reason for the over $10,000 in savings from MSRP that the client benefited from by purchasing the Factory Demo with 6,596 miles on it.   The document that client is referencing is the MSRP on the vehicle. As previously stated the vehicle was “Un-registered Factory Executive Vehicle” in fact this was also noted on the MSRP which client is in possession of that this was “Demo for Kavita Patel”   Based on the above and the fact that the vehicle had 6,596 miles on it at time of purchase, I cannot see where client was at any point under the impression that the vehicle had not been previously used.   The ’Smog Rating” that the client is referring to is the emissions label on the MSRP of the vehicle, it rates vehicles from 1-10 on emissions in comparison to all other new vehicles on the market at the time. A 5 rating only suggested that the vehicle produces average emissions which for any luxury sedan is on par. This has nothing to do with wether a vehicle will pass emission testing in a future date.   The “Engine Restoration Required” is not written on the repair order, what is written is “Technician also recommends engine performance restoration service” Nothing indicating a “requirement”. This is a fuel system cleaning.   I will respectfully decline the clients request for a refund of $50,000 for all the above reasons mentioned above.

Re: Complaint #[redacted]    [redacted],    I was on vacation last week and was just made aware of this issue. ** was the fiancee manager that took acre of Mr. [redacted]. ** is no longer with the company and I do not know how this mix up happened, I will be looking into it. ...

We will certainly correct this matter with our client, I will see if Wells Fargo will return the contract and waive any interest or fees. If not, I will absorb these fees and make good with the client.   I certainly apologize for any inconvenience.       [redacted] A. [redacted] General Manager

[redacted],    I’m in receipt of the follow-up letter our client wrote to my response (complaint ID#12809395)   Thank you for your assistance in trying to resolve these issues, I certainly do not like having issues with clients. Unfortunately I do not see where our business has done anything outside our normal business that would lead this client to the point she feels she is entitled to a full refund. None of her statements have been fully accurate nor do they match the document trail she herself has copies of. I welcome your feedback if you see any different or understand how I can resolve this matter with the client in a meaningful and fair way.   If you can acquire written authorization from the client authorizing me to share copies of the sales contact and MSRP, I’d be happy to share them with you so you can review with the client, or [redacted] could share them with you directly, in either case I think it would be clear to you that there were no mis-statements about price in my first response.  [redacted] is looking purely at base MSRP, she did not purchase a base model, she purchased a vehicle with added packages and factory options. As for inland freight, that is part of every manufacturers MSRP, not just Hyundai’s. I do not calculate the MSRP nor do I print them, those are calculated and printed from the manufacturer and associated with the base vehicle, options and freight which also determine the final cost top the dealer.   I reviewed the purchase contract again, and the $2,500 rebate is clearly stated and calculated on line 6e per California law.    In fact we did not have the tires in stock (so yes, we would have to order them and any item we are out of stock on we “special order” to get the item delivered faster for a client as opposed to a normal stock order). There is a misunderstanding on price, we did not quote $1,100 per tire, the quote was for all 4 tires. The quote is precisely $1,084.17 for the 4 tires plus $60.00 for mounting and balancing.   We do not sell tires for our brand that cost $1,100 per tire, nor have we ever charged any client $1,100 per tire.   As for battery, they infact are a bit more expensive on the Genesis as the car has so much modern electronics the load capacities are much higher and the battery much bigger than our typical Hyundai battery. We realize there are off brand batteries that can be purchased at a lower cost, they may or may not have the required load capacities.   The client indicates that she asked and no know one knows what an “Engine Restoration” is. I clearly addressed this in my initial response (see below)   The “Engine Restoration Required” is not written on the repair order, what is written is “Technician also recommends engine performance restoration service” Nothing indicating a “requirement”. This is a fuel system cleaning.   To my knowledge I’m not aware that the client took this vehicle to any smog inspection station and that it failed, so I’m not aware of any need to make an appointment with a Referee Station, (typically a Referee Station gets involved when a vehicles has failed multiple smog inspections or an owner cannot afford to make the needed repairs to make a vehicle smog compliant). That being said, if a Referee Station has agreed to look at the vehicle under these circumstances, I welcome it as it should help clarify the clients concerns.    If you have any feedback you would like to share with me, I would certainly appreciate it.           [redacted] General Manager
