Review: The issue is that the home was built on a crawl space with a window well access. During the building of the home (beginning in the winter of 2013 and completed in April 2014) the interior of the window well opening did not have a rock base french drain and was not covered by a plastic window well cover. By the time I moved in on October 15, 2014, (and unknown to me) the window well had frequently flooded allowing mud and a significant amount of water to enter the crawl space.

This mud and water was not completely removed by the sump pump, leaving standing water, mud and significant moisture. Therefore, mold began to grown on the construction debris left of the crawlspace floor, the insulation form board on the wall, the sub flooring, joists, and entered the HVAC system.

From the beginning of my moving in, I noticed an odd odor in my first floor area, but until the cold came and the windows were shut, then I knew something was wrong and began my journey of answering this question. Below is a list of chronically events I have done up until this point and surprise, surprise after I stopped the water intrusion, the crawl space has remained very dry but mold does exists and will need remediation. I believe the builder is responsible for this payment as the problem was created by his construction oversights. Let me know, if I am thinking in the wrong direction.

Chronology of time of events as they relate to the crawl space of my house:

Moved in on October 15, 2014. Was raining that day.

For the first month I noticed an odd odor in the first floor of my house and could not figure out what it was.

November 20, 2014, I had the sales representative from [redacted] HVAC come and give me an estimate to clean the duct work in my house and install a REME system in both air handlers to kill mold, bacteria and other pollens. Work was scheduled for Monday, November 24, 2014. First noticed water standing in window well and the wet dirt inside the crawl space on November 20th, 2014.

November 24, 2014, [redacted] HVAC came and cleaned all ducts in the house and added the REME system to both air handlers.

Workman vacuumed the attic space from the construction debris that was left in that space. On this day was my first hand look at the water, mud and construction debris in the crawl space. The odor was awful .... very musty and smelled like mold. I called [redacted], the builder, and gave him this information about the wet crawl space, no rock drain or cover for the window well (therefore rain water easily filled the window well and leaked into the basement). He said he does not cover his window wells or use a french drain of rocks in the interior of the window well. He reminded me that we live in an area with a high water table. I was fully aware of this having come from another geographic area that the same issue. I asked to send someone out to clean and vacuum the crawlspace. He replied he would have someone come tomorrow to remove the debris but not vacuum it out.

November 25, 2014, I opened the window well area before the workmen arrived and removed a wet, muddy and mold growing saturated particle board from the interior entrance to the crawl space. Pictures of this board are included in the attachments with this letter.

I set the board out near my trash can.

[redacted] sent 4 men over to clean the crawl space of debris and pictures of this debris are also enclosed. They told me they were not there to vacuum the crawl space. They did dig the dirt from the interior of the window well (about 12 inches down) and put in rocks for a french drain. They also placed a plastic window well covering over the top to stop rain water from entering in.

On Tuesday November 25th and Wednesday November 26th, 2014, I spent 4 hours vacuuming dry dirt, construction debris and dust, wet mud out of the crawl space. Pictures of the crawl space taken on this day and the debirs I removed are being sent in separate emails. The mud in the sump pump was 2 to 3 inches thick. It was obvious that the water and mud entered the crawl space through the window well and a small hole on the south perimeter of the wall and concrete floor. Everywhere else showed no signs of water or mud intrusion.

I removed debris from 3/4ths of the interior of the crawlspace on this day.

On Tuesday Dec 2, I completed the removal of the final fourth of mud and dirt debris.

Mold smell continues to come into my first floor and so I do not use my first floor heater. I called [redacted] HVAC and they came on Friday December 5, 2014, and checked all the duct work for possible leakage of the moldy air.

Smell continues to be bad on my first floor and crawl space area. First floor heater remains off. On December 13, 2014, [redacted] HVAC returns to seal all first floor ducts as they enter the floor on the first floor.

Smell continues in crawl space and when the first floor heater is turned on, the smell becomes worse in the house. Therefore, I have kept the first floor heater off and use my gas fireplace to heat the downstairs. I frequently crack a window on the first floor to provide fresh air ventilation.

I contacted [redacted] of Sussex County during the first week of December 2014, and they would come and give me an estimate of mold remediation after a mold test was done independently of them.

I contacted [redacted], LLC of [redacted] and requested a mold test from them. The mold test was done on Tuesday, December 16th, 2014 and the results were sent to me late in the day of December 19th,2014. The results are also being sent to you via email.

Results indicated a very high level of Aspergillus veriscolor, a mold known to be in dirt and mud. This is a mold that has a very musty smell (the smell I have smelled all along )and has created more asthma symptoms and skin lesions for me (another indicator of the high amounts of this particular mold) .

On Saturday, December 20, 2014, I had the square dirt hole holding the main water line into the crawl space dug out about 12 inches, filled with gravel and covered with concrete to stop any ground moisture from entering the crawl space.

On Monday, December 22, 2014, I called [redacted] and requested an appointment for an appraiser to come and give me the cost for mold remediation. The appointment was set for Tuesday January 6, 2015, as the mold specialist was on Christmas vacation.

On Tuesday, December 23rd, 2014, I left a letter in [redacted]'s office mail box in Lewes, De containing the mold test results, the EPA guidelines in reading these tests, the EPA guidelines in the mold remediation process, and that my appointment with [redacted] was on January 6, 2014. I further stated that I had spent $3800.00 so far, and since this last portion was for mold removal and that the cause of mold had to do with the construction of the home, I would asking him to pay for this. To this date, I have not heard from him.

On Tuesday, January 6, 2015, [redacted] of Sussex County came and assessed the crawl space for mold remediation. Appraisal will be

completed by the next day.

On Wednesday, January 7, 2015, I received an email from [redacted] of the cost estimate for mold remediation. I forward this information with a note to [redacted] and asked him to pay for this service due to the water entering the crawlspace prior to my moving in. I asked for him to respond asap. as it can be scheduled the following week.

As of the morning of Friday, January 9, 2015, I have not heard from [redacted]. I went ahead to the [redacted] Office and arranged for the mold remediation to be done and got it scheduled for January 20, 2015 (the soonest time they had open). I paid $3,000.00 as a deposit for this work. I also called [redacted] HVAC and asked for a pressure test on my first floor HVAC system to close any further gaps in that system and to clean the interior of the air handler removing any mold spores from that system.

January 9th, I am emailed my attorney, [redacted]s to consult with him regarding the matter.

On Monday, January 12, 2015, I talked with [redacted]s by phone and he would write a letter to [redacted] for a possible response to this matter.

AS of 4pm on Friday January 16, 2014, I have not received any communication from Mr. [redacted] and are requesting assistance from you.Desired Settlement: [redacted]r pay for this mold remediation or reimburse me in cash or certified check for this cost.

A check was paid in full by the Developer for a satisfactory completion and an Occupancy Permit was issued by the City.The property was sold some 5-6 months after completion to a [redacted] The Developers customer.A (1) year waxranty Was issued to the developer by Russ Palmer Builders on the condominiumunits which exph'es on the 17m of April 2015.The Developer has the option to have Russ Palmer Builders address any items that would be covered by this warranty for items that would be warranted and included in our signed contract, specification sheet, and notes only.
