Sirs:      Yes, Russell Pajestka Company installed a roof on [redacted]'s home completed on July 31, 2014. After which the area received numerous rain events with no leaks. On October 2, 2014 their was a major storm pass over the  [redacted]'s home with winds in excess...

of gale (50mph) force winds. Which as per our Labor Warranty item 4 on the back of contract states: "4. Labor Warranty does not cover damage to roofs caused by lightning, gale (50mph), hurricane, tornado, hailstorm, impact of foreign objects or other violent storm or casualty, or damage to roofs due to settlement, distortion, failure or cracking of the roof deck, walls or foundation of a building. Warranty applies to roof. Not responsible for content damage during warranty period." Therefore, our warranty only applies to the Roof & the warranty also states that the Russell Pajestka Company is not responsible for content damage during the warranty period. Therefore this storm on October 2, 2014 voids any labor warranty.       We received a call from [redacted] on November 5, 2014 stating he has a leak, the call was sent to one of our sales agents &[redacted] called [redacted] back on Nov. 5, 2014, [redacted] told [redacted] that we will have the guys come by on Thursday Nov. 6, 2014. [redacted] said that he will be home all day so anytime is fine. As a courtesy, being the roof warranty was voided on October 2, 2014 from the Wind Storm; On Nov. 6, 2014 [redacted] & [redacted] stopped by to check roof, they nocked & rang doorbell with no answer, they went ahead an got on roof to inspect roof & area which [redacted] stated the leak was. Then, We received a call from a [redacted] on Monday November 10, 2014 stating that she was upset that nothing was getting done. So as a courtesy again, we had [redacted] set an appointment with [redacted] on November 11, 2014 @ 9am to inspect the roof again & being able to go inside to see exactly where the leak was [redacted] was able to locate the problem caused by the high wind & repair. Normally we charge $250.00 for this type of repair but as a courtesy we waived the charge.       As for the interior damage, which resulted in this complaint, which is not covered by our warranty even if the warranty was still in effect, as a courtesy I had [redacted] another represented of Russell Pajestka Company make an appointment with [redacted] for Monday November 24, 2014 @ 10:00am to inspect interior damage & take photos.We here at Russell Pajestka Company strive to keep & make all of our customers happy, but the customer's need to understand the limits of warranties.Sincerely,[redacted]?

Revdex.com:Not having seen the contract that was an attachment, I was unaware of the stipulation quoted at item #6.  While I don't agree that this stipulation should be in a contract when someone does work for a person who has listed the property for sale, knowing that no matter what kind of materials used or possibly poor labor practices they won't be held liable seems to be improper and should be changed so show that the business is being run by responsible people.  However, I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Sirs,Sorry I forgot to send a reply to the Revdex.com.After receiving the complaint from the Revdex.com on 6-1-2015, I made an appointment with [redacted] 6-3-2015 Wednesday evening. to inspect issues. I meet with [redacted] at 7:30pm 6-3-2015. And informed him that the roofs Labor Warranty was...

voided with the recent storms, but I would get him courtesy repair. I tried to schedule one of my repair men to come out 6-8-2015 Monday morning to do a courtesy repair on roof due to the fact the roofs warranty was voidedin accor[redacted]ce with our roof labor warranty in our contract.Warranty States: Line item  4. states Labor Warranty does not cover damage to roofs caused by lightning, gale (50mph) wind, hurricane, tornado, hailstorm, impact of foreign objects or other violent storm or casualty, or damage to roofs due to settlement, distortion, failure of cracking of the roof deck, walls or foundation of a building. Warranty applies to roof. Not responsible for content damage during warranty period.Upon trying to schedule a courtesy repair for Monday morning June 8th [redacted] refused to allow our repair man out, since he was wasn't able to be home, but he did state that we could come out after 5pm. I explained we didn't need to enter the home just excess to the roof, and we need to work on roof in the early morning before the shingles heated up so we could work on roof, but he still refused to allow use to come out Monday for a courtesy repair.We will still try to do [redacted] a courtesy repair to his roof, if we [redacted] will allow me to send out a repair man in the morning to properly be able to inspect and repair anything we findTo date the roof warranty was voided with the mass of spring storms producing hail and high gale force winds, releasing Russell Pajestka Company from any Labor Warranty.Sincerely,[redacted]Russell Pajestka Company
