RE: Revdex.com Complaint ID [redacted]

Dear Representative Revdex.com,

First, in regards to the above mentioned...

complaint, the date that this happened was July 30, 2014. The property address that this occurred at was [redacted]. Please ?nd the attached MLS printout dated today August 13, 2014. Please also note the date highlighted that the property status was changed from active to contingent status August 1, 2014.

Secondly, to fully understand what transpired it is important to explain that this type of thing happens often then ?rst time buyers buy a house. First time buyers get very protective and possessive for the property that they are buying and this begins from the moment their purchase contract is accepted. As mentioned by the buyer, their contract was accepted the night before (July 29, 2014), they were probably at the property showing it off to their friends and relatives because they had approximately 12-15 people all in the house which they technically did not own, they just had a purchase agreement accepted, as a matter of fact as of today August 13,
2014 it is still in a CONTINGENT status which also permits it to still be shown by REALTORS®.

Thirdly, [redacted] had scheduled a showing for the property July 30, 2014 through [redacted] as required by the showing instructions in the Multiple Listing Service; she had every right to be there and show the property. She could still show the property and write an offer on it today, because of the current MLS status. When [redacted] was approaching the house that she had the approval to show, there were many people in the house and as she escorted her clients into the house the buyers were very rude and really did not want her there with potential buyers (They felt the house was theirs and [redacted] was intruding in their home with her clients).

There probably was a lot of tension and [redacted] continued to professionally show the property to her clients as she was hired to do. This angered [redacted] and her family/friends. [redacted]'s agent did not identify himself/herself and to this moment it has not been con?rmed that [redacted]'s agent was even present. There was no one professionally dressed or stepping up and stating their position, which may have caused further tension, because [redacted] very well may have been in the home with her family and friends unrepresented and without permission. Because any REALTOR® would have explained this situation to their clients and would have not impeded
[redacted] from showing the home, since the home was not truly theirs and would not be until title transfer and they had the keys and ownership according to the tax record. I can imagine the air was thick enough to cut with a knife and [redacted] was treated very rudely by [redacted] and her family and friends, as if they were threatening her purchase to buy the home.

[redacted] must have overheard [redacted]'s conversation with her clients, that the house was still ACTIVE and that they could potentially make a secondary offer, especially if [redacted]’s offer could not perform, which may be the reason it is still in a CONTINGENT (Continue to show status 13 days later., it is not even PENDING) Fourthly, per MLS rules the listing agent did not have to change the status from Active to Contingent for 72 hours meaning the status could have remained ACTIVE (Still being shown) until August 3, 2014 (2 days after [redacted] showed the property). The Status was changed on August 1, 2014 as stated earlier and it is and still probably being shown by REALTORS® today. If [redacted]’s offer to purchase was a strong contract to purchase, it probably would have been put in PENDING STATUS within 72 hours (which would have permitted no more showings).

Fifthly, [redacted] in her complaint called the of?ce of [redacted] to complain about how she felt she was treated, by [redacted], in reality [redacted] was the one who was very rude (borderline hostile) to [redacted] and her clients. If [redacted] could have stopped [redacted] from showing the above mentioned home to her clients they would have. [redacted] probably felt threatened that someone was going to get her house, I only wish her agent would have explained things a little better to her and everything probably would have been different.

Lastly, When [redacted] called the office she talked to a “[redacted]”. That [redacted] was me, [redacted] licensed Broker in the State of Ohio and actively selling real estate for over 27 years. [redacted] was very angry and obnoxiously rude. She asked me who I was and I responded with my full name “[redacted]”. I asked her kindly, “to whom am I speaking” with, she refused  to state her name and wanted to continue asking questions, “Are you familiar with an agent by the name of [redacted]'s nickname) she said, and I responded “ye” and asked her again” who this please” and” what was this about”. She immediately went on a tirade on how rude I was and just started shouting and making threats. Conversation consists of two or more people asking and answering questions. I never had the opportunity to have a conversation or ask her any further questions as she continued with her shouting and making threats as if that would have gotten her point across better by being louder? So I hung up the phone. I will not listen to someone who cannot keep their composure or have a civil conversation. I never knew her name until I received your letter.

Her statement in the complaint where she claims that I was “asking her if she got the house or not‘? and her claim that reads “Said they are in this for the money they would be losing out if she didn't show these people the house that day" is an outright false statement. I would gladly swear on a Bible or take a lie detector test to prove I am stating the truth” in no way or form di I say those words"; I have my doubts [redacted] would be willing to do the same. As I mentioned I have been selling real estate actively for over 27 years, Russell Real Estate Services has been selling real estate for over 50 years. Over 97% of the clients that have responded to our surveys handed out on every transaction would recommend us to a family or friend. We would not be as successful as we are or still be in business if we acted nothing but professional; it is too bad that some adults have to make false statements and can’t carry a conversation. I hope [redacted]'s ?nancing works out and I hope she still gets the house, but I also think she needs to take responsibility for her own actions. I am not interested in having any further conversations with someone who cannot tell the truth. I will also note she is not a client or customer of Russell Real Estate Services.

Respectfully,
