Thank you for reaching out to us to let us know a complaint was filed against RVA Property Solutions. The case number I am referencing today is ***We had a property that was vacated by a previous tenant. The vacating tenant left the property in disrepair. We began marketing
the property for rent as the renovations were being completed.Ms *** apparently saw the property for rent on ***. We do not own *** or have any means to control what is put on there platform. We placed the property up for rent online (not on ***) and *** scraped the information and updated there own website. *** uses data they get from county websites to fill in there own fields for house information. We do not, and cannot, supply or update the data. *** has 100% control. I have a picture attached of what shows on ***.We do not provide washer and dryer or refrigerators to any of our homes. This is an internal policy that we clearly and repeatedly tell our rents through the application processWe do though sell the appliances to renters who do not want to supply there own.Ms *** entered the property on three separate occasions to check on the progress, and gave no indication of dissatisfaction of the renovation. Mrs *** was originally scheduled to move into the property on February 7. Several days before the move in she called and asked to push the move in date back to February 15. We agreed to allow her to do that. When she showed up on February to move in she informed us that she did not want to move in until the end of the month, and did not want the lease to start until then. In a rental property, during the application process, the day the tenant wants to move in is crucial in the decision making. Based partly on Ms ***'s move in date she was chosen as the resident and all the other applicants were told the property had been rented. Her then unwillingness to move in at the agreed upon date had cost the landlord expenses of over $600. Ultimately we compromised and she agreed to move in on February 20.She then decided on February that she did not want to move in at all. Even though we agreed to give her a washer/dryer and refrigerator on February because of the misconception she had from the *** postingDespite having nothing to do with it, or any control over it.I have attached the signed lease from Ms ***. On page 3, paragraph titled 'Security Deposit', the security deposit is clearly stated as not refundable unless you meet the terms of the contract, which Mrs *** certainly did not do. Also on page 3, paragraph titled 'Notice Required to Terminate', there is a second clause that termination of the lease requires one months rent. Which is the same as the security deposit.We spoke to our attorneys on the matter and it was there position that Ms *** not only is not entitled to her security deposit, but there is a contract in place that she is violating, which is the lease. Ms *** should be responsible for the security deposit, the first months rent, and then a one month penalty for notice of terminationIn total Ms *** should owe in excess of $2400. This does not include the $loss of rent when she pushed back the move in date.At RVA Property Solutions LLC we strive very hard to balance being a good business owner and providing good service to our community. Upon reflection, ultimately we decided to return Ms ***'s security deposit and not enforce the lease, despite contrary recommendations from our attorney's. We returned Ms ***'s security deposit on February 17, the day she made this complaint to the Revdex.com. We returned it without any knowledge that she had made the complaint, and did so solely in our commitment to providing customer service that is well beyond the industry standard
