was a resident of an R.WSelby & Coproperty *** Apartments located at XXXXX Rose Avenue, Los Angeles CA) from 7/2/to 7/I've recently received a deposit refund of $out of an $deposit
The apartment was not ready for mountil 7/3/I completed the mochecklist on that day with the help of Susana Babonoyaba, the on-site property manager, and noted several pre-existing conditions including carpet stains in the living room and bedroom as well as paint peeling/flaking/smearing/drops on cabinets, countertops and carpet/flooring in the living room, bedroom, hallways, bathroom and kitchenI asked that these issues remain uncorrected as I did not want the apartment to be repainted with my furniture inside
After giving written notice of my intent to vacate the apartment, I requested an in-person initial inspection to occur on 7/16/at 2pm and an in-person move-out inspection to occur on 7/31/at 2pmSusana never showed up to conduct either inspection nor did she attempt to rescheduleThis is in violation of the California civil code
Upon vacating the premises on 7/23/2016, I cleaned the apartment from top to bottom including all rooms, the ceiling fan, cabinets and refrigeratorThe unit inspection report that accompanied my partial deposit is a fabrication (Yealla ***, an employee of RWSelby & Coadmitted as such in an email note dated 7/29/2016); it does not indicate the pre-existing paint/carpet conditions throughout the apartment nor does it have my signature or initials on either pageThe company is charging me after the fact to fix what they failed to do so before I moved in and is claiming the charges are to prepare the unit to their standards for the next tenant, which is in violation of California civil code
Given R.WSelby & Co.'s history of levying unreasonable rates for repairs and cleaning costs (they've settled no less than two civil suits since for the same behavior, I am left to assume that my only recourse is taking my complaintsI have already filed a request for mediation via County of Los Angeles Department of Consumer and Business Affairs and have begun reaching out to lawyers specializing in landlord/tenant law with the goal of bringing another class action lawsuit against this deplorable organization
