I am rejecting this response because: Mr.R[redacted] is not being truthful in many areas,starting with the financing,I checked my credit to see if anybody had checked my credit,and according to [redacted] . com no one has even checked my credit. I asked Mr. R[redacted] what my credit score was,and who he had checked to get loans from,I got no response at all. Where the vehicle is financed doesn't really matter anyway,this complaint is about the condition of the vehicle,the brakes have failed ruining the rotors within days of purchase,that is not a minor repair as stated by Mr R[redacted],I believe this is covered by the 15 day lemon law. Mr R[redacted] did not replace the tires out of kindness,they were so dry rotted they were a safety issue,they wouldn't hold air. Mr. R[redacted] was notified of the light and power door and air conditioning defects before I signed the contract and he agreed to fix them,after 7 weeks and 2 trips to a repair shop,all that happened is,one power door got fixed,and they broke the power door lock in the process of fixing them. The 2nd trip to the repair produced no results except I was told again,we need to order special parts for the interior lights,same as I was told weeks ago when the van was at the repair shop originally. Mr R[redacted] informed me the other day the parts were in,it took 2 months. The air conditioning issue which is hot and cold air at the same time,this can't be normal as I've been told by mr R[redacted],nothing has been done there,its not going from hot to cold too fast as mr R[redacted] said,it blows pure hot out of the left side while blowing ice cold out at the right side. The main concern is the engine,it has a loud noise coming directly from the motor,and idles at all different speeds now also. I took Mr R[redacted] directly to the moise,and his reply was "OH that's Normal!" for those models,no its not normal. I'm at the point where I'm done dealing with mr R[redacted],to prov emy poinht,now mr R[redacted] says for me to take it to a ASE cert shop for repair,again he is not doing this out of kinjdness,he is doing because under the lemon law he is obligated to fix it,engine noise,brakes,lights air conditioning. Mr R[redacted] even pointed out to me that these cars are bought from an auction and we don't have time to check everything all out before we sell them. Mayb e it is time to start checking vehicles before selling them to make sure they are road worthy. Mr R[redacted] was notified on all these other items the very next morning,like the tires. Approx. 1 and half months after telling them the tires won't hold air due to dry rot,the younger man said let me price tires and get back with you,2 weeks later I called to ask what about the tires?,he said that they dropped the ball on this one,and agreed to get tires finally,upon the condition that I pay half of the tires,when the tires were put on,mr R[redacted] informed me that he paid for the tires,as well he should have,the original tires were unsafe and didn't hold air. There is evidence that someone has worked on the air conditioning before,there is an access panel that has been broken,that is the panel to access whats wrong,I believe the part is about 1200 dollars according to mr R[redacted] and he said theres no way I'm paying for that repair. I'm at the point where I'm fed with mr R[redacted] from all the constant lies about my van,the problems he [redacted] or won't fix,and if he thinks this vehicle is so good,then give me back my down payment,he can keep the 2 pymts I've made as rental; fees,this vehicle was smoked in before I got it,I can tell from cigarette burns on the door arm,and small burns on the seat. These were there when I got the vehicle. The problems with this van are not minor as mr R[redacted] says they are,or he would take it back and resell it. Because I gave himj more than fair chance to fix the defects and I was just ignored. Mr R[redacted] hoped I'd just go away,but I'm not. This is covered under the lemon law and I'm pursuing it as such. Loud engine noise is normal for this model,I think not. I want my down payment back,and I also think I'm entitled to my payments of 500 also under the lemon law. Now all of a sudden mr R[redacted] is offering maybe a repair,nope! I want a refund,he knew of these issues way before the 15 day period and these are not minor repairs as according to him. Also I would like to see DATED credit check papers and the bank denials as to where he supposedly attempted to get this vehicle financed,his comment to me was why should I let the banks make all the profit,I'll finance it and keep the profit for myself. I bet he can not produce any papers about the credit,I checked to see if my credit was checked as little as 10 days ago,AND IT HAS NOT BEEN CHECKED,which explains why he couldn't tell me my credit score or where he attempted to get credit,becuase there is no proof that he did. I demand a refund from mr R[redacted],the noise is super loud now and the van no longer idles properly,there is definitely something seriously wrong with this van.It is unsafe and I can't use it for what I bought it for,to drive to albq for VA visits. I contacted [redacted] used cars on Oct 7th,and they informed myself and my wife that we could get a vehicle financed with only 1000 down,a 2009 VW Jetta thru bank financing. The salesmans name is [redacted] on the used car lot,and we've spoke with several times right up till oct. 11th,and no problem getting a vehicle,my wife has way over 7 years employment thru [redacted] And [redacted] with no interruptions,so I think what mr R[redacted] tols us was completely false the whole time.

This customers main concern was engine noise that he was convinced was a major mechanical issue. We listened to it and did not hear anything out of the ordinary. We still sent it out to a 3rd party independent mechanic shop to get another opinion. Their diagnosis was no mechanical issues. Mr [redacted] still complained of a "horrible" noise upon cold starting, so it was sent to a 2nd independent 3rd party shopfor another diagnosis. These shops stand to make money finding something wrong with a vehicle and repairing it, so when the 2nd diagnosis was the same as the 1st (no mechanical issues) we concluded both shops were not wrong .Mr [redacted] obviously does not believe us so we offered a compromise for him to find a shop that [redacted] agree with him and give us a mechanical issue to fix. Since he can not do this in the three months he has had this vehicle we must conclude this vehicle did not have any mechanical problems with the engine and close the file on this complaint. We wished we understood the true nature of this complaint but we [redacted] not be baited by personal insults, and wish Mr. [redacted] the best. It has been our experience when a customers main concern is addressed not once but twice and a resolution cannot be reached a compromise is offered to the customer and he does not accept the compromise, the customer either knows the mechanical issue does not exist or has another agenda. In conclusion after 3 months of dealing with this we must conclude the diagnosis we obtained were correct, as Mr [redacted] has had plenty of time and opportunity to at least get a diagnosis we can work on. [redacted] bought a used 2007 Dodge Grand Caravan Vin # [redacted] from us on7-23- 2015.This van was financed in house as a last resort due to this customer getting turned down on financing with every lender we use. If this customer believes he was lied to I wish he would go arrange his own...

financing. He is aware of some of his credit issues but we think in denial to the extent of how far these go and his role in taking responsibility for his credit issues. During the sales process this customer brought up the power sliding door not working and the courtesy lights not working which the company agreed to fix. He also brought up the objection that the air conditioner went from cold to hot too fast for his liking. He was informed we would fix the courtesy lights, which the parts are in and he has been informed he may take it by the shop when-ever he likes to have this fixed. We agreed to have the power door fixed which we did. This customer was informed we would check the air conditioner thermostat but did not think that it could be set to get warm slower to his liking, that that was probably the way this van was. This van was sent out to an outside shop the power door was fixed, the courtesy lights were diagnosed and the parts ordered to fix them and the thermostat was checked and found to be operating correctly. This customer is convinced that this thermostat should work differently than it does. The shop we sent it to informed us that this was up to factory specs and that is what we have to go by. The tires had good tread left and were not discussed during the buying process but the company went ahead and put a set on in an attempt to satisfy this customer. We believe we have gone above and beyond what is required of us to do but it seems to make no difference with this customer. Since the engine noise is the main concern of this customer it is also our main concern. The horrible noise this customer is referring to was checked by two independent unbiased 3rd party shops with nothing found wrong with the vehicle. If this customer can find an ASC certified mechanic to diagnose this with an engine problem even though this is out of the 15 day period we would be interested in taking care of mechanical issues. If this customer is interested in driving this van for a while devaluing it considerably by smoking in it and getting a full refund we are not interested in allowing him to do this to us. This van might need brakes and rotors, used cars sometimes do. We fee I as a company we have went above and beyond on this customer and are not willing to continue to work on this van for free for him. If it needs brakes and rotors as a normal wear and tear item he should have them fixed. We would love to trade this customer out of this van. All he needs to do is to arrange his own financing as we are no longer interested to provide the service of in house financing to this customer. In summary if this van actually has an engine problem that can be diagnosed by a certified mechanic then we are very interested in taking care of this matter, the brakes and rotors are a minor wear related issue and should be taken care of by him. The thermostat [redacted] either need to be on cold if he wants air conditioning or if he wants heat he can turn the thermostat and get heat. If this customer really believes he was lied to he is welcome to get his own financing and pay us off. In fact we encourage this.Our reputation is fair and honest treatment of customers and we stand by this and work very hard to maintain this reputation.
