[redacted] is [redacted] bent on trying to create a stir because he is unhappy that our service department is not open in DecemberNonetheless we need to continue to focus on making sure everyone has their Christmas presents as we do every year, and we will do that, Grinch be darned

[redacted] As I am guessing your probably already know, Saturday is the one day that we do NOT allow service pickups.And apparently you do not know that you are not talking to anyone but me here, this is nothing more than an automated system forwarding messages back and forth between you and me.Regards,***

We disagree with several of Mr [redacted] comments, but the question of having him pick up his bikes is not one of themWe have have invited him to do so on numerous (MANY) occasions, as indicated in the email he pastedMr [redacted] contacts us, we discuss him getting them, then he disappears or more months at a time, this has been going on forever as he states.The problem is we need to have an agreed pick up time because the bikes have to moved out of their storage location, which may require some time tomove the bikes in front of them.Regards, [redacted]

[redacted] has heard back from us more than once, including the very day he wrote this note, about three hours previous to writing itHe clearly does not understand that our service department is closes in the month of Christmas, as it is every year, so we can focus on assembling bikes for giftsWhile he seems interested in reading our web site,he apparently missed the large heading on the service page during DecemberHe is hell bent on trying to bully his way around the annual department closure.Contrary to what he reports here, [redacted] told our staff that he waited almost six times longer to change the oil than we and the manual recommend during break in periodThis fact is stated right from his own comments on the ticket when he dropped off the bikeOther previous correspondence from him implies abuse that would void a warranty, such as discussions about changing sprockets to increase speed etc.Nonetheless we DO have a six month warranty on engine PARTS, as clearly stated on our web site in the section [redacted] is encouraging all to readIf we do find any indication that the parts were defective in our carefully documented review the parts will be provided at no chargeHowever this cannot be determined until the service department is re-opened in JanuaryNo amount of harassing emails, phone calls, or threats will change thisWe have made commitments to customers to have their Christmas presents ready and we will meet those commitments

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaintIn its response the business did not offer any resolutionAll I got was again, just as before excuses as to why they cannot resolve the problemWhat this business does not seem to comprehend is that Texas lemon law prescribes rather precise time frames as to when a vehicle has to repairedAnd a statement in November, after the bike is already days in their shop, that they will get to it in Janurary is most certainly nt in line with Texas lemon law In addition, the next problem this business faces is that they are committing fraudTexas law prescribes that the title and tax stubs have to delivered in about 3weeksWe are now at month and I have neither my bike nor the titleThis is the text book case of fraudSame applies to the tax stub.
In closing I have lost my confidence in the bike, it is already a legal lemon and that this business will be able to service the bike into the future, and since there are very few repair shops willing to deal with a bike where no rair manual is available, I am asking again for the repurchase as lined out in Texas lemon law.
I am in the process of preparing a criminal complaint and a report to the Texas state tax authorities, but that has very little impact on the bike itself

*** does not seem to understand that that lemon laws do not apply to abused vehicles and neither does warranty, although we will often cover it or lower prices dramatically if the customer is reasonableUnfortunately I do not count repeated harrassment in the waning days before Christmas as reasonableObviously *** is quite focused on himself with little regard for the hundreds of people waiting for their Christmas giftsOnce again, for the or 30th time, service is closed until the first of the year
