I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.The attached note was sent to *** at Revdex.com yesterday (3/23) detailing why Ryan's Home Center has not resolved my complaint. There continue to be issues of: 1) non-responsiveness; 2) a leak which they claim to have fixed - but is still leaking (they say they're not responsible, but it was in my contract with them for them to repair this area and there was no leaking at all until after they worked on that area); 3) edges of siding not meeting properly/not laying against house - here they give me a story of us needing to wait until warm weather (the problem has now existed for months) and then that we need to deal with the manufacturer of the product. We only paid Ryan's Home Center (NOT the manufacturer) and Ryan's is not standing behind the product they sold me nor the installation of it - which did NOT turn out well at allWe have no confidence that Ryan's will ever be appropriately responsive and we are convinced they will not rectify the problems that exist. We are left with the unfortunate choice of getting others to fix these problems - but we will continue to inform others of our dissatisfaction with the company, it's owner and their work.

Report Concerning Chimney *** *** Residence Mr***, I have had several email messages from you concerning the chimney leak and the vinyl siding project completed at you residenceI have spent some time reviewing the matter the following are my conclusions. In your
earlier email messages you stated that your wife had made numerous attempts, without result, to contact meI have reviewed the company phone records and have only be able to identify three incoming calls attributed to both of your phone numbers from the period of November 1st to presentI have included a log of the calls in this reportI spoke with your wife on all three occasionsAnd I visited the property and witnessed rain water dripping inside the firebox of both fire places. I am of the opinion that I have no responsibility in causing the leak or correcting the leakMy interpretation of the facts is as suchOur contract had no provision for repairing a leak in to the chimney, fireplace, or fireboxTo specify clearly our agreement was to replace the vinyl siding on the chimneyThe rotted wood underneath the siding on the chimney and to prevent any further water from running behind the siding so that no further wood damage could occurThat has been accomplishedAdditionally, during the course of the siding installation at your residence work was stopped several days because of rain and at that time there was no report of any chimney, fireplace leakThe leak was first reported to me, by your wife, On December 1st I can’t state as fact but I feel confident that there was some considerable rain fall between the dates of November 1st, the completion date of the project, and November 24thI chose November 24th as a significant date because of the weather event on that dateI have added to this report a copy of the November 24th weather that included high winds up to 50 mphIt is my contention that the high winds on that date damaged the chimney and caused the leak. Included are photos of the chimney or vent pipesIt is clear, by the old sealant, that there have been ongoing attempts to seal the chimney pipesThe area of concern is below the hood where the pipe penetrates the cap, in the photos the solder joints appear to be crackedMy company does not get involved in that type of repairAs a courtesy, during ***’s inspection of the chimney, He applied clear silicone to the cracksI would have expected the silicone sealant to have worked for a longer period of timeHowever, with the very cold winter and snow load it could have prematurely failed. In reference to your concerns about the laps of the vinyl sidingIt has been my past experience that they will close when the weather gets warmSometimes the panels become deformed as a result of stacking the boxes in the warehouseIf that does not turn out to be the case, the warranty claim will have to be handled through the *** *** Products warranty departmentI have discussed the matter with the supplier and there is no getting around the procedure. My recommendation to you is to have a chimney company investigate the leak in the chimney cap and possibly make an insurance claim based on the weather report from that period of timeAs for the siding laps, if you do not want to wait to see if warmer weather resolves the issue you can start the warranty process at any time by going to royalbuildingproducts.com and filing a claim.
