We are responding to a complaint in regards to *** *** of *** *** *** *** *** The Revdex.com Complaint ID *** We received this letter in our office Wednesday, September 13th via USPSThere are several discrepancies in her complaint that have no standing
The contracted services totaled $2,700.00+tax for the services that are listed below In her complaint she has stated that it was $2, The contract stated nowhere that acres would be mulched If this would be the case then we should have mulched he lawn areas, driveway and patio areas, and all exterior surfaces Mrs***’s statement of “finally starting” work would imply that we were late in our service While Mrs*** did originally request that the service be completed by May 13th, it was made clear to her that we would more than likely not be on the job site until the first week of June at the earliest, as our scheduled work for the Spring is typically booked the previous Autumn *** also insisted that our crews should have been out working in her yard on a Monday during a thunderstorm The date of completion was made clear in the initial meeting and via email I had let her know that we might be able to fit the job in while doing her neighbors yard but that did not work out due to weather delays, and our obligations to work scheduled months in advance Email to Mrs*** on 4/20/from Ryan H***- “***, Thank you for the returned contract I see you have requested that the job be completed in by May 13th, Unfortunately I know that we cannot have it done by then I have co-scheduled the job for the same day at the ***'s which is towards the end of May.” Response from Mrs*** on 4/26/17: “Hello Ryan, Sorry for the delay in my responseFlu bug going around this house! I am ok with the schedule you can meet later in MaySome spring clewas done by the other company to cover the deposit I paid them, but I am not going to continue with their serviceAt least the worst of the fall left over work was started and some bed edgingI prefer to use your company and get all the work done well Please advise once you know the scheduled datesMany thanks!” The “imaginary” line as Mrs*** put it was verbally agreed upon during our initial meeting, written down in my notes, and also made it on my crew notes but not clearly to the customer notes that are stated belowThis is how the foreman knew of the green flag mentioned and the “imaginary” line was a direct line of sight to the neighbor”s landscape bed The stated services are below Landscape areas and planting beds will be cleaned of leaves, weeds, and other winter debrisAll debris and leaves will be hauled awayEdging of landscape beds, minor weeding of mulched areas, and installation of shredded hardwood mulch to inches deepPrice given is to match your existing mulch type. Service to be performed April 1st-June 30th If you would like this service to be completed by a certain date please put that date in the following blank space, every effort will be made to meet your requests Services are scheduled on a first come first serve basis Due to weather conditions all dates may not be honored The morning the crew showed up to complete the work Mrs*** had a lengthy discussion with our crew foreman going over the project During which the foreman pointed out that the un-mulched areas beyond the green flag were not part of the contract At this point she attempted to persuade our crew to do the area anyways The crew foreman contacted me to inform me of the situation I instructed my crew to work on the front yard has there was nothing in question with the extents of the work to be done and to notify the customer that I would be there after I had finished with another meeting I that morningThe elapsed time was exactly 1hr min till I was on site to talk with Mrs, *** While I did not have the area in questions explicitly in the contract, at no point did we discuss mulching the entire wooded area or the acres based on the complaint , although we had discussed mulching to the green flag Furthermore our contract clearly states that mulching and clean up is to be completed in “existing mulched areas”, the area in question was not previously mulched and therefore not part of the contracted area to be mulched The area in question is not a landscape bed, but a wooded area of the property, that was mulched to a point (the green flag) and that is the service we provided. When I arrived on site I spoke with my entire crew in more detail to find out exactly what was said, after which I asked *** if we could step into the back yard to discuss what was in question Upon hearing her complaint of what she wanted versus what was on the agreement, I asked her if I could go out to my truck to get my notes and the work orders At this time I instructed my crews to stop working and take a break I showed her both my written notes and the notes that had made it into our work order system This then set her in to a highly agitated state, were she was yelling and screaming to the point my crew could hear completely at the street 200+ feet away After a 20+ min discussion I once again explained the extents of the work and what was going to be done Given that Mrs*** was obviously not satisfied and as a compromise based on this unique situation I verbally told *** that we would clean up and mulch the area that I had quoted up to the green flag In addition and at no extra charge my crews would then cut down and spray any brush and weeds past the green flag (the area in question) She agreed to this and my crews performed the work At no point did *** mention wanting a credit for any work. *** praised my crew on the work that was completed and how hard they worked, and even told me what a great job they had done in an email Email from Mrs*** on July 13, “One other point, I was quite happy with the work your crew didThey were terrific and very professional” We invoiced *** on June14, for the contracted amount $2,700.00+ sales taxes of $ *** sent payment in for $2,which we received on July 10, Included on the invoice was a note that she was taking $off for “*** family labor and materials” At no time was a discount ever discussed, she just decided to take the discount herself Shortly after receiving the note with her payment I was working in her neighbor’s yard and took the attached pictures of the area in question You can clearly see that the area had not previously been mulched and the area had not been mulched. After seeing that the work Mrs *** gave herself a discount for had not even been completed I emailed her the pictures I had taken from the neighbor’s yard The following is the email that resulted
