This situation is unfortunateThis customer owned one of two vehicles impounded from private property and is mad because they believe they were wrongly towedThe blame usually falls on the tow company when in reality we are only responding to a phone call from an individual claiming to be
the owner and/ or agent of the property to authorize the removal of such vehicleThere are strict guidelines put forth by the Public Utilities Commission of Colorado to insure the legality of the nonconsentual towRyan's Recovery is a member of the TRPC (Towing & Recovery Professionals of Colorado) whose main focus is to keep its members up to date with all the rules and regulations put forth by the PUC. In this case we were called to a residence in the residential neighborhood of *** to impound two vehiclesThe individual calling claimed to be the owner of the property and was authorized to have these two vehicles removedWe recorded all this individuals information and had him sign our tow slip as the authorized partyWe then notified the local law enforcement of the private property impound and the towed the vehicles to our impound yardSome time after mid night these two customers began calling wanting to retrieve there vehiclesThey were very irate about the situation and they were demanding there vehicles backThe driver that answered the phone informed them that the office was closed and would be open at 8amThey could retrieve their vehicle at that time for no additional charge or they could pay a $after hours gate fee to retrieve the vehicle at the [present timeThis is fully compliant with PUC regulations and company policy because of the potentially dangerous situation this could raise for my employeeWhen cars are impounded, emotions are often elevated and with possible alcohol consumption that could come with such late night releases, the potential for violence is elevated and therefore frowned upon by myselfWe did ultimately released the vehicles to them with the gate feeAlso, by law, we are only allowed to disclose the authorized individuals information to law enforcement and /or the PUC for fear of retaliation towards the property agentWe did not violate any PUC regulations during this tow nor should the blame fall on usWe just did the job we were called out to do

Unfortunately this customer will never understand that we were just responding to a call from someone willing to legally take on the responsibility of authorizing this tow. This is not personal on our side nor is it more than 5% of our business. It is not not our responsibility to put a no parking sign in the ground every place that is private property. Do you have a private property sign in the drive way at your house?  As far as signs ironically appearing, I have no idea what she is talking about. Neither I, or anyone from this company have anything to do with these signs appearing.   Like I said before, we followed all the laws put forth by the PUC. If they deem necessary, they will initiate there own investigation into this mater and possibly provide this customer with all the authorized parties information so she can take them to court.  Hopefully this satisfies the needs of the Revdex.com as I feel that I have thoroughly explained my position.

I am rejecting this response because:There were NO signs stating that the parking lot that was private property -- private meaning that it belonged to the owner of just one of the five condos in the building. We were visiting another condo owner in the same building and were instructed to park there as it looked very much like the lot belonged to the entire five-condo building. There was nothing to lead us to think that the entire lot was restricted parking in any way. The PUC requires signs to be posted that cars will be towed at owner's expense. There were no signs.And, for the record, we did not call after midnight. We made our first phone call (to law enforcement) at approximately 10:30 p.m. -- as soon as we discovered our cars were missing. It took us about 30 minutes and several phone calls to find out where our cars were. We were visiting [redacted] for dinner. That was the plan. We had to get our cars back so that we could return to [redacted] as planned as we had obligations. Interestingly enough, there are now signs up in that very parking lot. They were first spotted by our friends (who own a condo in the building) on Saturday.
