On June 3, Ryland Homes' Division Presidnet replied to your email requesting the refund of earnest money that was provided by your wife when she went under contract with Ryland to build a houseWhile you were never a party to
that contract we extended the courtesy (just as we are doing now) of replying to your emailYour wife received loan approval from your firm and we proceeded with construction of the home meeting our contractural obligationsSeveral months later your firm issued a loan denial with no explanation whatsoever of the situation causing/surrounding the denialRyland was left to assume that the requirements of the loan were not met leading to the denialWe retained the earnest deposit based on Paragraph #of the contract which requires the buyer to "comply with all requirements of the lending institution providing the mortgage loan"The deposit was retained as "liquidated damages" to partially offset the upfront costs (permits, engineering, material and labor)of building the home and to offset the potential costs and expenses incurred while marketing the home with your selections, which may or may not be acceptable, to a subsequent buyerAs stated in the email of June 3, 2015, our position has not changed

The response from Rykand is not correct at all whatsoeverI never received the email referenced hereinFurthermore, Ryland changed its position for not returning the earnest money to my wife at least three times during the course of arguing through email with them about returning itThey were provided detailed emails with regard to the reason my wife couldn't qualify for the loanAdditionally, my firm only ha delete the initial pre qualification, then it was passed ** a third party firmMB Financial, and a complete independent mortgage broker that is not related to me or my firmHe is a W-employee of that companyHe provided a standard letter stating that my wife no longer qualified for the loan at the time of the denialWe were trying to do the "right" thing by letting Ryland know she would not qualify for the loan any longer and they just stepped on the little guy in the name of big businessWe *** not be satisfied until the earnest money is returned and had hoped this wouldn't turn into a legal matter or social media battleI have no intention rooms of stopping this complaint until the earnest money is returned

Review: An attorney (Ms. [redacted]) was hired to address the unethical practices and tactics of Ryland Homes and their Sales Representative, Ms. [redacted], at "[redacted] Ryland Homes was advised, verbally and formal written letter, to cancel/void the townhouse contract and return the full refund of the deposit that they received by Mr. & Mrs. Darrell and Ondrea L.R. Jackson.

There was a verbal guarantee that my husband and I would be able to close in February/March timeframe. We complied with the required steps (e.g., qualifying for mortgage, home selection and upgrades, and etc.). We were very excited with our selection and the pace and/or timeliness of the processing of the paperwork.

Immediately after we signed our contract, Ms. [redacted] informed us, several times, that the building date would be pushed back; which in turn delayed our original closing date. Additionally, Ms. [redacted] did not disclose to us that, before our home would be built, Ryland Homes must sale all other homes and/or SPEC homes in that community.

I have received, at least, two e-mails (can provide to you if necessary) suggesting the groundbreaking to begin the building of our new townhouse...which never happened. My husband and I feel as though we (the 'BUYER'S) do not have any rights and that we are being "jerk-by-a-chain" by Ryland builders.

Ryland Home's deceptive sales tactics has caused and continue to cause us financial and marital complications due to us having to live at separate locations until the completion of our (PROMISED) townhouse. Please feel free to contact me if additional information is required.

We are requesting your office to investigate Ryland Homes deceptive sales practices and tactics. We are also requesting your assistance in the cancellation of our contract and a full refund of our deposit given to Ryland Homes.Desired Settlement: Cancel/Void existing contract and refund full deposit monies that was given to Ryland Homes.
