Complaint[redacted] drafted a contract for a new 30 year roof including Ice and Water shield and it was fully executed and settled with payment in full. Ice and Water shield is impenetrable material installed over the roof decking as an extra precautionary measure to protect the home. My home experienced leaks in two rooms after only 7 months post-installation. After failed attempts to get the owner, [redacted], to deliver on his promise to have his job foreman, [redacted] return to my home, I hired an independent Adjuster to inspect the work. The Adjuster found there was no ice and water shield used on my home. If the Ice and Water shield had been used as the contract stated, the leaks would have been prevented and subsequently, the damage to my home would have also been prevented. I've attempted to resolve this matter with [redacted], Owner, Class A Roofing and Repair to no avail. The contract further stated there was a seven (7) year warranty. I've requested the warranty in writing along with his company's certificate of insurance and have not been provided either at this date.Product_Or_Service: 05/06/2014Desired SettlementI would like [redacted], Class A Roofing and Repair to: provide a copy of certificate of insurance; provide the seven (7) year warranty as customarily provided in writing; install ice and water shield in each valley at a minimum, with matching shingles replaced; install a chimney cricket with step flashing at the chimney area; reattach the wiring to the gutter drain pipe; replace the external flashing; and reimburse the $250.00 fee incurred for independent adjuster inspection; repair of the master bedroom ceiling: mask and prep for paint (including light fixture), seal the surface area with latex based stain blocker, paint the ceiling, paint the crown molding, replace damaged drywall/sheetrock tape, mud and prep, scrape the surface area and prep for paint, paint the walls and ceiling; replace two (2) tack strips, section of damaged padding, rest retch corner and clean carpet. I would like all work to be completed by individuals duly licensed, legalized, and authorized by law to perfoBusiness Response I personally went out and looked at the problem. There was no need for my foreman to go out. The problem was snow and ice trapped in the valley, preventing water to flow out naturally. I explained this to the homeowner and her attorney([redacted]) why the water got in. The ice and snow where well above the valley and flashing line. 1.5 feet away from the ridge( the peak ) of the roof ,that's where the water got in and ran down hill from there. No fault of installation or product used. Ice and water was used in the valleys on this property. Homeowners attorney said there was no inspection done on the property. Even so, ice and water is an underlayment beneath the shingles and would take shingle removal to access physical sight of product, which would void warranty if another party did so. Again homeowners attorney [redacted] said hadn't been done. Before Feb.20th -21st-22nd,which dropped 3 inches of snow and ice, it had rained over 25 inches since June 2014 installation time. No breaches before or since the ice and snow blockage. According to the homeowners attorney [redacted]. Which I'm confident as well there are no active leaks. Like I stated to the homeowner it was an act of God leak which talking to a couple of insurance companies they don't cover the roof part( which there's nothing wrong with the roof ) but they would cover inside damage. The homeowner informed me that she was dropped by her insurance. This is why she is pursuing this matter with my company. The insurance we carry is general liability and workmans comp. Which basically covers us during the process of the installation. My warranty covers labor defects only. Which there are none, note, no active leaks per the conversation I had with the homeowners attorney. We did an excellent job on the roof and were highly recommended for this client. I also gave her back $500 on landscape lights we supposedly damaged that she never replaced. We also excepted a joint check from her previous insurance company which was roughly $12,400 and we charged $8,400 so she kept the balance for her own needs (inside work) to help her out. Which my company had to pay taxes on in the sum of $1,586. Plus $500 is $2,086 minus $8,400 is $6,314 which translates to no profit for my company. So much for trying to help someone out. Her list of demands as you can see is way beyond what we would do if we were at fault. Wanting something for nothing is neither fair or deserving on are part as much as we helped this client out. We are not a fault for ice and snow damage. I can not be any clearer. Any further action by this homeowner or her attorney to defraud or slander my name or company will end in my attorneys office [redacted]. Thanks or the soap box. [redacted]
