Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below The roof did get replaced and I have no issues with thatIt was the second half of the work that is the issue (soffit, gutters, fascia, and freeze board)As far as address the leak in my houseWe had a leak in the home when we first moved in over years ago and we had a professional come in and fix the issue and install a french drain around the house, it has leak drop into the house since then, only know that have no gutters on my house due to SJ&Awe started this Job at the end of July for the gutters and was dealing with it up until mid-September, to start and job and leave a house without gutters for months is unacceptableI lost trust in him and did not feel it was ever getting done so I wanted my money back (which he said twice he would give me back but I still have yet to receive anything) to hire a proper company to do the workI also have every text, email voicemail and 90% of the text are me asking him when his crew is coming outI have many pictures of the house and damages that are dated leading up until the first complaint.I have record that the check has been cashed and cleared and the work has not been completedA reputable business would not have an issue refunding a client if they are unable to perform the work or provide the materials in a timely manner In [redacted] theft by deception is considered a crime and can be charged as a felony given the total cost of the job that was left uncompleted, as stated by my attorney If a refund cannot be fulfilled in the next business days, I'll have no choice but to proceed with filling a police report and proceeding with my caseI really hoped this could be resolved amicably without invoking a third party I would say that a simple [redacted] search will confirm that "***" [redacted] has dealt with these issues in the past and is very aware of the law Regards, [redacted]

Response: Mr [redacted] signed a contract that clearly states on the reverse side that SJ&A Construction cannot control certain circumstances. I had his roof replaced in a timely fashion, and without incidents. The facia, soffit, freezeboard, and gutters were the second faze of the project and did...

not have a projected start or finish date. Mr. [redacted] had told me prior to the roof that he had a problem with water leaking into his basement as well as cracking his foundation. My goal was to ultimatly help him with his foundation and the ongoing leaks in his basement. Those problems were however ongoing issues that Mr. [redacted] stated himself that had been ongoing for 5+ years. I hired James [redacted] to do all of the 2nd faze (soffit, gutters, facia, freezeboard) of work and could not control the situational delays that happened as a result. Mr [redacted] is a well known contractor and has always done exceptional work and I did not believe there would be any problems during this process. Mr [redacted] was supplied all materials and started doing the work until I was told his [redacted] had a [redacted]. I stayed in close contact Mr. [redacted] and with Mr. [redacted], informing him of the delay. The situation was beyond my control and I sincerely wanted to get Mr. [redacted] the best work possible for his home. I had conversations with Mr [redacted] on atleast 15 occasions and tried to find other contractors to finish the already started job, if Mr [redacted] could not. Everyone I contacted was booked up for 2-3 weeks. I sent someone over to protect his home from being damaged further during rain eventhough the damage to his property was a pre exsisting problem. I offer to send a new contractor over as soon as they were available but Mr [redacted] said he did not want that and that he only wanted a refund. The materials have been bought and part of the job has been done. I will send a copy of the back of the contract he signed agreeing to the terms, if necessary. I also have documentation of conversations between us, as well as all phone calls and payments. The information he is claiming is in-accurate and I will be glad to produce all the documents I have. I do want the customer to be satisfied but I was told by him that he didnt want me to finish the job or contact him again.
