It is true that I agreed to do the construction job in question and it is also true that there were obstacles to mebeing able to complete the job, but I feel that this complainant has misrepresented the problem and my intentions.It is true that I "upcharged" the complainant for materialsWhenever I
am responsible for obtaining materialsand delivering them to the job site, I upcharge to cover my time and expensesIf the complainant wanted to use histime and resources to purchase the materials and deliver them to the job site, that would have been perfectlyacceptableI do not however, work for freeI made it very clear what I was charging for the materials before obtainingthe deposit, and I feel that if the complainant had a problem with those charges, he should have addressed that issuebefore I actually went to the trouble of ordering, purchasing and delivering the materials.It is also true that during the course of this project, the total estimate for the job did changeThe change waspredicated on a problem with the way the concrete bases, meant to support columns, were placed by the complainant'smasonI did not contact for the masonry work and it was not a part of my estimateWhen the bases were improperlyset, it then became apparent that I had only two choices with this jobOne was to set the columns on the existing bases,which would have made the final project unsightlyThe other option was for me to perform additional, unplanned work(involving additional labor and materials) in order to modify the project so that it would work with the existing basesthat had been set.When I first presented this issue to the customer, we came to an oral agreement that the additional labor wouldbe $and that I would have to price out the additional materialsI then priced out the additional materials thatwould be needed to overcome the issue of the improperly set bases and, in the end, it was the additional materials thatthis customer disputed.I do not see how he could expect me to bear the expense of fixing an issue that another contractor created andthat I could not have foreseen at the time of the original estimateAny reasonable person understands that an estimateis just that, an estimateI frequently encounter problems through the course of a job that require modifications forboth materials and laborIn the end, I cannot complete the job without being paid for my time and expenses.I am sorry that the complainant is unhappy, but I feel that he has been unreasonable to work with and unwillingto see my point of viewPlease let me know if you need further information from me.Sincerely,Stephen JLeonard
