Initial Business Response / [redacted] (1000, 10, 2016/07/11) */ Here are some verifiable facts to consider: On November 10, 2014, I met with the client for a free one hour consultationWe discussed the various irrigation options for the siteThe pros and cons of sprinklers, drip, valves and a timer system were discussedThe client requested an inexpensive drip system at that timeThe fact that drip saves water and money at installation was contrasted with the ongoing need for maintenance I drew up a written contract detailing the scope of work, cost, and time framesThe client and I both signed it on 11-18-14, and 11-21-An excerpt is included in this letter for referenceAt no point did the contract or any verbal agreement stipulate that any faucet would be replacedThe contract was for a simple above-ground drip hose system with micro jets, hooked up to existing faucets and, or valves On April 1, 2015, I arrived at the site, and as always for all my clients, I knocked on the door, and rang the bell to let them know I was there(Why would I want to be bitten by their dog?) I installed the system as contractedThe system functioned flawlessly It should be noted that my warrantee period is one year, and it covers any defective parts and any defective workIt does not cover maintenance, abuse, destruction by others or wear and tearHowever, I will always go the extra mile, answer questions, and do simple repairs for free In June of 2015, I was contacted by the client, and told that the system was not workingOn June 20, I arrived at the job site and met the clientAfter a brief review, I determined that the system had been trashed by dogs, and/or goats and/or wild animalsOne solid brass Y connection had also crackedI replaced the cracked Y under warranteeI explained that the animal damage was not a warrantee issue, but that I would gladly get the system up and running at no charge as an extraI replaced several emitters, and several lengths of drip hose, and cleaned the filtersThe system was again up and running flawlessly The client, asked me to replace a faucet on the houseI explained that it was not part of the contract, and that would replace it for time and material at my usual labor rate of $per hourThat rate is similar to air conditioning, plumbing or auto mechanic rates, and is thus a fair rate considering my licenses, bonds, insurance and college education as a licensed contractorI felt it was not necessary to write up a contract for a faucet replacement, since I considered the client a friend/acquaintance Later that week I returned to replace the faucetAt that time I knocked, and rang the bell and got no answerSigning a contract for work is implied permission to enter and do the work, further more there were no gates or fences which I had to crossIt is not reasonable to drive one hour round trip, and not complete the workSo I completed the faucet replacementIt worked flawlesslyI then brought the invoice to the door and knocked and rang the bell againIt is reasonable to expect payment at the time of work, no?
