S&R Landscaping of Leominster, MA quoted me via email $1,200 to repair fence at my home and requested 50%, or $600 deposit, to schedule the 1-day long job (per the owner), and said he was two weeks out and scheduling into beginning of July. I sent him $600 which he received on June 19th which owner confirmed to me via email. After not hearing from him, I emailed him on July 1, July 14, July 16, and July 22 as king him if he had scheduled my work. On July 24, 2014 he emails me that he has me down for the 24th (meaning August 24th which is 9 weeks away and not two weeks). I wasn't happy about the wait but didn't say anything and waited. On August 19 I email asking if we are still on for Aug. 24th, and he responds to me on 8/21/14 that he can't make it on August 24th but without offering an alternate date. Then, owner was the first to offer to return my deposit on August 21st if I wasn't happy with the situation. I said that I would prefer to have the work done. Again, I didn't hear from him for another week so I sent an email saying that I assuming my deposit will be returned to me soon. On Sept. 1 owner emails me that the check will be mailed out at the end of the week. On 9/9/14, owners tells me he mailed my deposit to me on 9/8/14. I sent various emails telling him I did not receive the check. I said I wanted it by the 11th and then I gave him one more chance to hand deliver it to me on 9/13/14 before taking other measurers. However, it is 9/15/14 and the check that was allegedly mailed to me on 9/8/14 has not reached me. I do not think that I should wait 3 weeks for my deposit to be returned to me (which it still hasn't) after waiting 9 weeks for a 1-day job. Owner has been very rude through this entire process including sending me an email asking me not to email him any more. Well, I would like my money back for work that owner refused to do.Desired Settlement$600 deposit returned to meBusiness Response I'm writing in regards to this email. This is the first time I have heard about this from the Revdex.com. [redacted] was completely rude to me since day 1. After we agreed for me to send back the money, she harassed me the ENTIRE time and when I realize I had the check and letter returned to me with the wrong address she wanted me to deliver it thru paypal or some other service. She was nasty about the entire ordeal so I made her wait. I will send her a check out this week. This is a full week after the second time he has promised to send me my deposit back. First time, it was on September 1 and then claimed to have the check sent on 9/8/14 which I never got. Then, a second promise to the Revdex.com on October 20th, and no check yet. I think he has every intention of keeping my $600 . I doubt he would be this rude and try to steal my money if I were not a woman. If [redacted] had any intention of returning me my money, he would apologize for allegedly mailing the check to the wrong address, and then make every effort of delivery (including hand delivery or paypal) which I do not think to be unreasonable suggestions.This is completely unacceptable when he received my deposit on June 19 (more than 4 months ago), and decided to return my deposit on August 21, 2014 (more than 2 months ago). He doesn't start to grasp the idea of who is rude and unprofessional. I wonder how long he would wait if I owed him $600-probably not 4 months or over 2 months, and he would be hounding me via email and telephone on a daily basis if I owed him $600. [redacted] has been contacted by the Revdex.com and MA Attorney General's Office various times and has been ignoring both agencies hoping that the agencies and I will go away eventually and that he will keep my $600 for work he did not do. I will escalate this situation and not end here. Final Business Response Was mailed out today at 3:30Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)No check has been received as of November 19th. Since I already sent [redacted] a 93A letter on November 3, 2014, that states he has 30 days to resolve this matter I will be filing a claim in middle seconds district small claims court on December 4, 2014
