On August 3,  2015, Manager [redacted]ound E[redacted] unit had been vacated.  Trash left in the unit and unit left in filthy condition.  Call was made to [redacted] and message left that her account would remain open as she was again past due with prior rent.  The same...

day mysel[redacted], (owner), and [redacted]r (bookkeeper) were all in the office when [redacted] returned my early call.  She advised that she moved out Sunday and had errands to run and was going to call when she received my message.  For the duration of the call she continued to raise her voice at me.  She stated that some of her stuff had gotten ruined.  I asked why she did not leave it for me to see.  She said her sister was moving and had a truck s she moved it while she had use of a truck.  When I asked why she had not called us on Sunday, she said did not want to bother me on a Sunday.  **We are available 24/7 and other customers have no problem calling all hours  of the day or night**She then told me that I can come to her home to look at the stuff that was moldy and rusty, she advised that photos were taken, however never offered to me to view.  She indicated that she left a big box to show the dampness and mold on it.  The box that I found had a completely different person on the shipping label(which did not match her information).I further inspected the unit found NO marks on the ceiling, floor or the metal walls to indicate moisture or mold.  As well as the units to either side of this one have had  no issues what so ever.   Along with any of our rental units.Every customer signs the same rental agreement at the time of rental.Our Rental contract states the following:2.       TERMS;  The initial term of this agreement shall commence on the __ day of ____, 20__.  Thereafter, this agreement shall continue on a month-to month periodic basis until such time as either Owner or Occupant shall provide the other with a written notice of termination at least thirty (30 DAYS prior to the conclusion of the final monthly rental period).3.   RENTAL PAYMENT(S):  Occupant shall make all rental payments to Owner on the first of each month in advance of each monthly rental period,  with the first rental installment due and payable upon commencement to the terms of this Agreement aforesaid.  The initial rental installment, however, shall be pro-rated for the portion of the calendar month yet remaining.  Then a pro-ration amount from the ___ day of _____ 20__ to the ____, 20___ will be paid.  Occupant shall pay to the Owner a late charge of Five Dollars ($5.00) for any monthly rental period for which Occupant makes a rental payment hereunder more than five (5) days past the date upon which the rental installment is due.   Owner need not accept any late rental payment(s) in any event, but Owner may, at Owner’s election, alternatively declare Occupant to be in default of this Agreement.  There will be a one (1) month minimum charge on all unit(s) whether the unit(s) has/have been used or not, once this Agreement is commenced.  If the Occupants vacate their storage unit(s) before the end of calendar month, there will be no pro-ration of rent provided to the Occupant by the Owner.4.  SECURITY DEPOSIT:  Owner reserves the right to keep the security deposit if proper notification is not given, as stated in Item 2 hereinabove.6.  INSURANCE AND HOLD HARMLESS;  Occupant acknowledges and agrees that the Owner shall not maintain insurance coverage relating in any manner whatsoever to any item(s) and/or material(s) which Occupant stores at the Facilities hereunder.   Occupant shall solely be responsible for obtaining and maintaining any insurance which Occupant may desire respecting business of storing goods for hire, but is contrarily a landlord renting space for Occupant’s self-service use. Occupant is storing goods hereunder at Occupant’s own risk.   Occupant agrees to indemnify and hold harmless owner from and against any and all claims, liabilities, and costs, inclusive of reasonable attorney’s fees, which Owner may or does incur relating in any manner whatsoever to any intentional and/or negligentact and/or omissions of Occupant, or otherwise relating in any manner to the actions of Occupant, at any time during the term of this agreement or thereafter.  The provisions shall survive the termination of the Agreement.   When I asked [redacted] if she had checked on the unit in the last 3 years that she has been renting, she advised that she had not.  Even though she had placed her payments in the office door drop box, at no time had she gone to her unit.   Grace period applies to rental payments only.  [redacted] did not provide a 30 day written notice as our contract indicates, as well as she moved out of the unit on Sunday, August 2, 2015,  arrival time of:  4:10 pm, and left the facility at 5:09 pm.  In our 8 years of business, we have not had a single complaint.  We strive for the best customer service and that is what we provide.   I, myself am available 24 hours a day, 7 days a week, holidays included.  I meet customers at all hours and never received anything but POSITIVE feedback.We will not consider any reimbursement of rental fees.  Nor any refund for the a ledged damaged items.   Based on the terms of the contract, we are not responsible for items in the units.If more information is needed in regards to customer and payment history and the signed contract, please contact me directly at [redacted] and I will be more than happy to assist in the matter.Sincerely, [redacted]rA-C Airport Storage, Inc.
