Review: I want my parts back

I bought a bike for NorCal scooters and told the owner it was not getting the kind of gas mileage I was expecting. He agreed and had his mechanic work on it. I was amazed that the mileage went up from ~ 45 mpg to ~ 70 mpg but then about 2 weeks later, the motor burned out. I was kind of mad but told him to find out how much it would cost to get it running again. He said he would look into it but I didn't hear from him for about a month. I had my wife stop by and ask what the status was and he said he had tried to contact me and had a motor but couldn't get me so he gave up. I wanted to take the bike then but he convinced me that he would find a motor and fix the bike. About a month later I stopped by to ask what the status was and he said he was still unable to fix it so I told him I give up, give me the bill, put it back together and I would have someone pick it up. When the tow truck brought the bike to my house, the first thing that happened was when he back the bike off his truck, the back brake fell off. the when we look the rear strut was not connected to anything. I talked to the owner and he said he would get a parts list so I could tell him what parts were missing but to this day has never delivered and now even refused to acknowledge that he has my parts. Even though his mechanic apparently did something to the engine that caused it to burn up, I never complained till being ignored but have now given up hope of him returning my parts without legal action. I really can't believe anyone would say they didn't return a bike to the original condition or at least return the parts. This business would work on the engine of a car and then throw it in you back seat and say they couldn't do anything so pick up your car or better yet, remove the engine all together as say you car never had an engine when you brought it in.Desired Settlement: I just want the parts he took off my bike returned.

Business' Initial Response

[redacted] bought a 150 cc scooter from us. He brought it in for its first 300 mile oil change and the oil was burnt. He was advised not to ride a 150 cc scooter wide open especially when it is brand new and not broken in. He brought it in for several more oil changes and as time went by the bike was looking dirtier and more beat up every time. The bike was being abused and it looked like an off road dirt bike covered in mud and oil.

Mr. [redacted] had his bike towed to our shop on 7-24-13 and stated on the phone that "it just stopped running "after inspection the motor it was locked up We informed him he had destroyed the motor. He was over 5000 miles so there was no warrantee. Mr. [redacted] wanted us to take the motor out to see what went wrong. As we suspected the rings were melted from heat and the piston rod was blue form overheating The oil was so burned it stunk up the entire shop

We asked Mr. [redacted] to come look at the damage himself We told him we could put a new motor in it for $500.00 plus labor but he did not respond We have the work order showing how many times we tried to contact him By the time we reached him the motor was no longer available We tried for months to get a replacement motor but they were back ordered.

Mr. [redacted] decided to come get his bike and bring it back when he had a replacement motor he sent a tow truck to get it and was not there when they picked it up. The bike was signed for and as far as I know all the parts were there over a month went by before he came to the shop claiming he was missing parts We have no idea what was missing and if he had misplaced them or they ere lost in transit We asked several times for a list we would give him parts if we had them because what he was describing was bolts and brackets he never got us a list Instead we received the rude and delusional letter which I am including As well as a copy of his work order

This individual destroyed his bike and now wants it repaired for free Oh and pick up and delivered back to him free as well.

Lets Fact from Fiction.

(Fact) The bike was ridden for commuting to work along Folsom/Sunrise which has a speed limits of 35/45 mph. Where he got his story about burnt oil in the first 300 miles (hahaha)??? Interesting and what a joke.

(Fact) The bike was running fine except for gas mileage which hadn't changed since the day I bought it. I brought it in and had it tuned up and the mileage increase by

50% but the motor seized about 2 weeks later.

(Fact) I brought the bike in and asked him to find out what was wrong and I didn't hear from him for along time but didn't think much about it since it had taken him over a month to replace the muffler that had fallen off and I figured a motor would have taken much longer.

(Fact) After I didn't hear from him for a while, I had my wife stop in and ask him what was up and he said he had had a motor and had tried to contact me (which I can't say if he did or not cause I didn't get a call) I told him just to fix it and I would pay for it. A month later he said he still couldn't so I told him I give up and just put the bike back together and I would have someone stop by and pick it up. I paid off my bill in full and left.

(Fact) About two weeks later (I wanted to give him time to actually put it back together) I had a tow truck pick up the bike and bring it to my house. When the driver backed the bike off the truck, the back break fell off. Me and him started looking and saw the back strut hanging and the muffler attached to nothing. There was nothing to attach anything to. He couldn't even believe it. That afternoon I call the lady in the shop and told her. The next week I brought pictures to his shop to show him (I guess he forgot this). He told me that he would look around for the parts and I agreed. He then told me he couldn't find them but he would give me a parts list so I could go through and circle the parts that were missing (How am I supposed to know everything that was missing without a parts list). After several times of calling and going back and asking for the parts list, he said he couldn't find it but would go back to the manufacturer and get it. A month later, still nothing.

(Fact) I figured I was being plaid a fool so I decided to start getting things in writing so I sent a letter telling my expectation for getting my parts back and of course was ignored. After another month I sent a certified letter telling him what my expectations were and also include the damages his shop had done to the bike. This was I guess the rude letter that after what 8 months of him keeping my parts, ignoring me with platitudes, he is expecting me to continue to wait or just give up. How dare someone actually demand their rights. In his reply to my letter, I was called a bully, an extortionist and delusional? Hmmm,,, Interesting..... To me it doesn't sound like he ever planned on returning my parts.

This has nothing to do with money, but respect and ethics. I brought the bike into his shop to get fixed which he apparently could not or would not do. I paid for and expect the bike to be returned in the same condition it was brought in. Not missing pieces. I didn't ask for the motor until close to 6 months after he refused to even give me back the parts he took.

In conclusion, I do not accept their response because about 90% of it is a provable lie.

If you would like pictures of the bike and missing parts, please let me know and I will gladly upload them. It has been sitting in the garage since it was delivered waiting for the promised parts so I could get a motor and install it(easy for me to do, not sure why the shop couldn't after what 9 months).

1- He destroyed his own motor no question about it

2-He signed for the bike and did not pick it up himself so we have no idea if there were parts left behind lost in transit or after he took position of it from the tow company

3-We have three of these bikes in stock for parts he thinks we would waist our time steeling when we have three of the bikes in the yard The issue has always been that he did not know what parts he needed and we could not get a schematic showing a parts list That part of his story is true we did try and could not get a build sheet from the manufacturer However he never got far enough to need these parts as you need to motor first and we do not have one The bikes in the yard are old with warn out motors but the mounting is the same If he had put a new motor in the bike and came to us and said hey I need this bolt and that mount we wold have and still will give it to him The thing is his motor is blown up and not worth re installing "as is" and he dose not have a replacement motor So he is creating an issue where on dose not really exist to try and have a reason to complain hoping to get a new motor and have it installed for free which is what is not going to happen Again his mechanic is welcome to come by and pick out what ever mounting brackets and hardware he needs free of charge no more to say on this matter

Review: I went to Nor Cal scooter to buy my first scooter. When I walked in I was told by the sales associate I was interested in a new scooter and I had two friends that just bought scooters. I did not see the one I originally wanted.. I asked are these all the same.. the sales associate stated yes they are all the same. Same make, model, and year. Said only one that is different is the one in the corner. Stated that is was older, different body style and cheaper. I explained that was not the style I wanted. Told him if they are all the same then I kind liked the all white one. Sales associate grabbed it right away and rolled it off the floor to get it ready so I could drive it home. I was so excited!! I asked again these are all the same...I was told yes.. Same year 2014, same price, same body.. In the two months I have had my scooter I have had little issues with it. Day two of having it I started it and let it sit on kick stand while letting it warm up and the bike fell over. When I told [redacted] (the owner this) he said that's because the idol was too high. other little things like the fender falling off, the handles bar dropping when I first got it, and the rubber over the bolts already being cracked caused me to look around the bike. That is where I noticed the Vin Number and Manufacture date state the bike is 2012. I was sold and paid for a 2014 even my title was put in 2014. [redacted] told me nobody looks at that information but me, and it is the same bike nothing changed.. I told him if I was told that I had the choice of a 2012 or a 2014 all exactly the same for the same price I would chose the 2014. He told me that is odd to him. I told him I was told it was a 2014, paid for a 2014, and I want what I paid for. He said you got what you paid for and that was a scooter with no miles on it. He proceeded to show me his registration from his truck to try and show me that the date on the title does not matter and they don't ever match. And that I would not understand it and it is hard to explain.Desired Settlement: I told [redacted] I would like what I paid for and wanted a 2014. He said he cant exchange the bike because of title, then it was because it is scratched, then it was because I put stickers on it. Then he said if the bike was 100.00 off on show room would you have gotten it then? I said no 100.00 is not worth the 2 years it sat around to me. He offered no other solution. Did say I am sure my people never even noticed it was a 2012 because they look the same. I want what I was told I was buying.

Review: I purchased a Moped from them on 04/11/2015, within days of having it; it began to leak oil from the engine. I contacted Nor Cal Scooters on 04/16/2015, through their email address listed on their website, and requested to have them take a look at it. I never received a reply. I called their store on 04/17/2015 and spoke with [redacted] the owner of the shop. He said to bring it in and let them have a look at it. I dropped the moped off to their shop on 04/21/2015. The moped had been leaking oil daily. [redacted] contacted me via phone call on 04/21/2015, the same day I dropped it off, and said they had tested it and that it was not leaking. I asked if they could test it for another day and see if it would leak, considering it leaked daily when I was using it, I wanted to be sure that it was taken care of. [redacted] called me the next day 04/22/2015 and said it wasnt leaking and that I could come pick it up. I went in to their store on 05/02/2015 and requested a refund. The employee working at the time stated that [redacted] the owner was the only person who could help me with that and that he was out of town and would return Tuesday 05/05/2015. I called Nor Cal Scooters today 05/05/2015 and spoke with [redacted]. I asked if he was going to be there for the rest of the day, I wanted to come in and get a refund for the Moped, he stated that he would not give me a refund and then began to argue with me about the oil leak and California return laws. I ended the conversation because [redacted] was growing increasingly rude and we were unable to compromise. I believe California civil section code 1723 applies to this situation due to Nor Cal Scooters not properly displaying their return policy and the defect with the Moped. I requested a refund for this product because the product was sold to me brand new and immediately had an issue. The owner of Nor Cal Scooters refuses to refund me for the purchase price. The Moped was in Nor Cal Scooters possession from 04/21 - 05/11. The moped still has the oil leak and is missing bolts now.Desired Settlement: I want a refund for this defective product. I gave Sacramento Motorcycle Dismantling an opportunity to fix the oil leak. The shop says they fixed the issue but it continues to leak oil. And it is missing a bolt from the exhaust pipe now.
