To start off this contract was not for $34,000.00 but for $32,000.00.This was approximately a $40,000.00 job. Then they were going to get the machine and operator so I changed the price to $30,000.00. That was only part of the discounts. The reason we never got to $40,000.00 was they were... getting procuring the permit, hiring the engineer, and hiring the architect. When we contracted in September house and property was being developed, so I had no involvement in retaining walls, property drainage or even steep slope clearance permits.They hired us to purchase all necessary parts and equipment to build a pool., which essentially made them the general contractor. To this point, we are basically similar to a Internet site which they ordered the pool kit from. We delivered some of the supplies on December *, 2016. Frank and 2 man crew delivered the (list attached,) and Mr. signed that he received this delivery. To address some of their other erroneous statements. 1. The contract was not predicated on our ability to procure a permit. (B [redacted] responsibility). 2. She states that we were not familiar with local regulations and not responsive to her inquiries. ( B [redacted] responsibility.) and we had helped them speaking with Camille in the building dept numerous times. 3. She states that this type of pool in not conducive to their property. ( Engineer should have advised her prior before entering into a contract with us) 4. She stated that we sold her a liner that shes claiming we were going to retrofit into the pool. (Quite the contrary, we were building the steel around the FREE liner worth $2000.00 we gave her). 5. She states that we take no responsibility which is true, because as a sub contractor for this project we are being guided by the general contractor who are the B [redacted] s. At this point, we have not done any pool, construction, building work at all. All we done is for fill the order for the pool to this point. We have offered to relieve them of their obligations to the contract and return $8800.00 the $4200.00 which included approximately $2200.00 custom steel, $390.00 pick up and delivery of the pool kit, 20% restocking fee to our distributor, delivery of supplies in December and the pick up of said supplies this year. We didn't even charge for the hours and hours of telephone support with the B [redacted] and Camille at the building dept. all winter long.. To wrap up this conversation on April **, 2017, Mr. B [redacted] said they had the permit, but did not have the machine or the operator. We found someone to dig the hole and cart the dirt away, only to find out that Mrs. said the town gave them the go ahead to apply for the permit. Yes we did install the liner years ago and the liner was wrinkle free and fit perfect.( see attached sign off sheet), we also installed new rimlock coping, (their particular coping has a multi purpose functionThis is where the liner attaches at the top of the poolIt is also a
concrete recepitorIt's decorativeIt is true that we had to return to snap the liner back in the track because Mrstated that he didnt have the money nor the time to pour the concrete deckThis was a no charge service callLast year, I did return to find out that Mrpumped out all the water from the shallow end, leaving only the deep end fullHe cleaned out the leaves and then re filled the pool without hiring someone to put the liner vacuums on the pool to bring the liner up into its proper placeWhen I came to the house the liner had pulled away from the skimmer faceplate causing a major tear below itI had made an offer to install a new liner for cost Mrwould pick up the tab for the waterHe stated they were selling the house and asked if we could just patch it for himI felt his pain and I patched the liner for himHe gave me a $tipMrshad verbally berated me from hello, she called me a little man, she said I had no respect for woman, ( I was raised by a single mother and have nothing but respect for women), hense I did call her a pain in the ***I was quite insulted coming from someone who has no knowledge of the pool businessA list of my credentials: Im a year vet in the industry, I've just been invited to teach my 3rd class on liner installation for the industry, and I've been quoted in The Pool and Spa news which is a national magazine times, so I am not just a new kid on the block

This problem has been taken care of and the warranty honored. We have made sure that the manufacturer honored their warranty. Our own warranty is being honored, however took some time as we no longer hold a license in the county where the customer lives. We have contacted a licensed contractor in...

her area who will be installing the liner, and will be paid for by us.
