Safety and Compliance Services, Incfollows Federal DOT guidelines for drug and alcohol testing All specimen collection cups have a temperature strip on them, and the temperature of the urine must fall between and degrees to be an acceptable specimen Below details the portion of the regulation dealing with temperature of urine specimens: DOT Rule CFR Part Section Subpart E - Urine Specimen Collections (b) TemperatureYou must check the temperature of the specimen no later than four minutes after the employee has given you the specimen (1) The acceptable temperature range is 32–°C/90–°F (2) You must determine the temperature of the specimen by reading the temperature strip attached to the collection container (3) If the specimen temperature is within the acceptable range, you must mark the “Yes” box on the CCF (4) If the specimen temperature is outside the acceptable range, you must mark the “No” box and enter in the “Remarks” line your findings about the temperature (5) If the specimen temperature is outside the acceptable range, you must immediately conduct a new collection using direct observation procedures

I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below You cannot tell me that you cannot have a "defective cup" and/or a "defective strip" due to storage temperatures or manufactured and that the manufacturer of this cup never has "never" had a batch of cups that don't read properly It happens in all products that are made from time to time Nothing made is always "perfect" and functioning properly It also isn't proper protocol/conduct for an "office person" to advise a patient that: "Well since it is not the right temperture it means that your "urine is dirty" thereby meaning you must be doing drugs" and we are going to tell the employer that, as the office person informed This statement is slanderous in implying that because it "wasn't the right temperature" that the person must be on drugs! This office is a Safety and Compliance office, not a certifiedl medical lab, nor is it the DOT It is simply using DOT supplies, which could be old supplies, outdated and defective As in any testing (even in pregnancy testing over the counter product can be positive and when tested by a doctor and sent to a certified medical lab can come back negative), a second party (whereby sent to a medical labl) to review your findings makes the result conclusive If this specific urine specimen had been sent to a "certified laboratory" not read by a layman, the results would have showed NEGATIVE for any drugs in it, for which this office failed to do, relying soley on a cup that could have been defective and by a reader who had an attitude and wasn't reading it right [redacted]
